Prior Lake, MN 55372-1714 August 27,2009 Monte Giles 14020 Shady Beach Road Prior Lake, MN 55372 RE: GRADING 14020 SHADY BEACH ROAD Dear Mr. Giles, I spoke with you on August 24th, 2009 regarding a private culvert in the front of your yard south of your driveway at 14020 Shady Beach Road. You are inquiring whether or not the private culvert and hole in the yard requires a permit to be filled. You stated that other property owners on Shady Beach Road have filled in the culverts on their property after which water in the private culvert on your property has backed up into your front yard. You stated you would like to eliminate the culvert on your property to address the drainage issue and asked that I advise you in writing whether a permit from the City is required for this work. The purpose of this letter is to respond to that request. This is a private culvert system and the City has no authority over its operation. However, your property is in the Shoreline District and therefore requires a grading permit if the amount of fill is over 10 cubic yards. After viewing the property, the work involved with filling the hole would likely be under 10 cubic yards and therefore no permit would be required. You should consider the fact that filling the culvert will change the drainage characteristics of your yard. You may want to consult with an engineer or landscape architect. These professionals can also advise you on how to avoid creating drainage issues with your neighbor. Once the work is complete, please seed or sod the area as quickly as possible to avoid an erosion Issue. Prior Lake, MN 55372-1714 August 19, 2009 (" Monte Giles 14020 Shady Beach Road Prior Lake, MN 55372 RE: DRIVEWAY PERMIT 14020 SHADY BEACH ROAD Dear Mr. Giles, I have viewed the City Council video in which you claim that the Prior Lake Engineering Department has not gotten back to you regarding a driveway permit application. These statements are simply not true. This spring you had met with an Engineering Department representative to discuss your driveway situation. At that time, a driveway permit was given to you. Since that time the Engineering Department has not received a completed permit application from you. I received a voicemail message from you on July 30th and promptly returned your call, leaving you a message. Since I left that voicemail message, I have not heard from you. Attached is another permit application. Once it is filled out and received by the City, the Engineering Department can process the permit so you can get started on the driveway construction. The permit fee for this driveway permit is $10.00. As you are filling out the permit, if you have any questions, call me at (952) 447-9832.
