RE: NOTICE OF VIOLATION OF CITY CODE
Mr Titus,
It has come to the attention of this office that you have engaged in activity that is in
violation of City Code. An inspection of your property at 5331 Frost Point Circle and the
adjacent drainage path revealed unpermitted excavation and grading.
Specifically, you are in violation of the following:
)0> Ordinance Section 706.300: Permit Required (Excavation and Filling)
This office would like to solicit your cooperation in correcting the violations as noted
above as soon as possible. Attached is a restoration plan for the impacted areas. Please
contact me within 10 days of the receipt of this letter to schedule a meeting in order to
discuss the requirements of this plan. I can be reached at (952) 447-9831 between 8:00
a.m. and 4:30 p.m., Monday through Friday.

Disturbed Drainage Path

[JRemove all retaining wall, geosynthetic material, and fill material from drainage
way.
DRestore channel grade to elevations equal to or below attached survey.
DSeed or sod all bare soils and allow to re-grow naturally.
DProvide receipts and call for inspection after above work is complete.
DDo not disturb, disrupt or alter the drainage path at any time in the future.
Comments:
Failure to complete the above requirements by August 31 S\ 2009 will result in a citation being issued to
the property owner, who will be subject to a summons, and the file will be referred to the Joint Scott
County Prosecuting Attorney for court action. Any remaining work will be directed to a third party and
the property owner will be billed for the cost of corrective action.
* Final inspection and approval of restored site required.
