Prior Lake, MN 55372-1714 CITY COUNCIL AGENDA REPORT MEETING DATE: SEPTEMBER 21,2009 AGENDA #: 5M PREPARED BY: ROSS BINTNER, WATER RESOURCES ENGINEER AGENDA ITEM: CONSIDER APPROVAL OF A RESOLUTION APPROVING PLANS AND SPECIFICATIONS AND AUTHORIZING ADVERTISEMENT FOR BIDS FOR THE 2009 WATER QUALITY POND MAINTENANCE PROJECT(CITY PRO. JECT #09-013) DISCUSSION: Introduction The purpose of this agenda item is to seek approval from the City Council for the plans and specifications and authorize advertisement for bids for the 2009 Water Quality Pond Maintenance Project (#09-013). Historv The City of Prior Lake owns the majority of the stormwater conveyance and treatment systems that provide flood protection and water quality treatment of rainwater runoff. Periodic maintenance is required to keep the system in good working order, and maintain the mandated average designed level of service. The City of Prior Lake inspects its entire stormwater system on a 3-5 year rotat- ing basis. The result of these inspections triggers minor maintenance work that is completed annually by City Staff. Inspections also lead to large full pond dredging projects which occur biennially (currently every odd year). On May 18, 2009, Council accepted quotes and authorized surveying and testing of 7 water quality ponds in preparation for the City's biennial pond maintenance project. On September 3, City Staff held a public informational meeting, offering resi- dents the opportunity to comment on the proposed plans. At the open house persons from 2 homes were represented. City Staff explained the proposed de- sign and took comments on the proposed plans. The informational meeting re- sulted in one site visit to follow up on comments from a resident. Current Circumstances The project includes storm sewer, excavation, turf establishment, tree planting, erosion control, and appurtenant work. The construction of this project is pro- posed to be funded through the Water Quality Fund. At this point the project design is complete and it is appropriate to seek City Council authority to advertise for bids. A copy of the plans is available in the En- gineering Department for review. Once the bids are received, City Staff will pre- sent the bids to the City Council for its consideration. If the bids received are higher than expected, the City Council can elect not to move forward with award- ing a contract. www.cityofpriorlake.com RICollnci\12009 Agenda Reportsl09 2\ 09120rJ9~ t1Ji2t'~6~a 0'9-~)952 .447.4245 ISSUES: FINANCIAL IMPACT: ALTERNATIVES: Maintenance of City water quality ponds entails the winter excavation of years of collected muck and sediment. This material is left over from sediment and nutri- ent laden water flowing to the pond over the course of its design life. As a pond continues to fill, its effectiveness at reducing further pollutants decreases unless it is restored to its original design volume. In addition to restoring water quality ponds to their design volume, vegetation restoration and pipe repairs are planned. While the majority of work will take place in the winter months, some spring vegetation planting and turf establishment is planned. This project will be funded by the Water Quality Fund, capital improvement ac- count #602-49420-530. The bid is set up to maintain as many ponds as possi- ble, under the approximate remaining capital improvement budget of $133,500.00. The Engineers Estimate is $141,000.00 for all seven ponds, but recently bid prices have been extremely competitive, meaning there is a chance that all seven ponds could be maintained this year. If the low bid includes one or more of the alternate ponds over the $133,500.00 amount those alternates will be dropped from the 2009 project, and postponed until the next water quality pond maintenance project, planned for January 2011. The alternatives are as follows: 1. Approve Resolution 09-XX approving plans and specifications and authoriz- ing advertisement for bids for the 2009 Water Quality Pond Maintenance Pro- ject (#09-013). 2. Deny this item for a specific reason and provide staff with direction. 3. Defer this item until a future date. Prior Lake, MN 55372-1714 RESOLUTION 09-xx A RESOLUTION APPROVING THE PLANS AND SPECIFICATIONS AND AUTHORIZING THE ADVERTISEMENT FOR BIDS 2009 WATER QUALITY POND MAINTENANCE PROJECT #09-013 FOR THE CITY OF PRIOR LAKE, MINNESOTA Motion By: Second By: WHEREAS, Periodic maintenance is essential to the continued function of the City's stormwater and water quality infrastructure, and; WHEREAS, The Water Resources Engineer has prepared plans and specifications for the 2009 Water Quality Pond Maintenance Project (Project #09-013), NOW THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF PRIOR LAKE, MINNESOTA as follows: 1. The recitals set forth above are incorporated herein. 2. The plans and specifications for the 2009 Water Quality Pond Maintenance Project #09-013, a copy of which is attached hereto and incorporated by reference herein, are hereby approved. 3. The City Manager shall prepare and cause to be inserted in the official newspaper of the City and in the Construction Bulletin an advertisement for bids for the making of the improvement pursuant to the attached plans and specifications. The advertisement shall be published not less than 21 days prior to the bid opening, shall specify the work to be done, and shall state that the bids will be received by the City Manager at which time the bids will be publicly opened at City Hall at 4646 Dakota Street SE by the City Engineer. No bids will be considered unless sealed and filed with the City Manager and accompanied by a cash deposit, cashier's check, bid bond, or certified check payable to the City of Prior Lake in the amount of five (5) percent of the amount of such bid. 4. The City reserves the right to reject any and all bids for any reason as determined solely by the City Council. PASSED AND ADOPTED THIS 21st DAY OF SEPTEMBER, 2009.
