Prior Lake, MN 55372-1714 CITY COUNCIL AGENDA REPORT MEETING DATE: OCTOBER 5, 2009 AGENDA #: 5D PREPARED BY: AL FRIEDGES, PARKS & FLEET MAINTENANCE SUPERVISOR AGENDA ITEM: CONSIDER APPROVAL OF A RESOLUTION AUTHORIZING EXPENDITURES FOR MATERIALS FOR SPRING LAKE TOWNSHIP PARK IMPROVEMENTS DISCUSSION: Introduction The purpose of this agenda is to seek City Council approval of a resolution authorizing the expenditures of funds for materials for the Spring Lake Township Park Improvements. History On July 21, 2003, the City Council approved an Orderly Annexation Agreement (OAA) with Spring Lake Township. As part of the OAA the City agreed to develop two parks; one located on Raymond Avenue and the other one located on South Shore Drive. The OAA specified the parks should include a play structure, picnic shelter and other amenities at each park. The OAA required that the improvements be completed by December 31, 2009. The land is presently owned by Spring Lake Township. The City cannot expend money on improvements to property it does not own. The OAA provides that ownership of the land will be transferred to the City, at no cost to the Township. The transfer will allow the City to expend funds on the improvements. City and Township staff met several times over the last year to develop a plan for the improvements at the parks. On March 19, 2009, the City Parks Advisory Committee approved the plan and directed that it be taken to the Township Board and City Council for consideration. On May 18, 2009, the Spring Lake Township Board approved the plan. On September 8, 2009, the City Council approved a resolution accepting the plan for the Spring Lake Township Park Improvements. An update of the City Council's approval of the plan was discussed at the September 17, 2009 Parks Advisory Committee meeting. Current Circumstances South Shore Park The curbing around an existing play structure will be modified to meet current Consumer Safety Products Guidelines for fall zones around the play equipment. Additionally, a 20 x 40 picnic shelter will be constructed and equipped with picnic tables and garbage containers. The standardized City park sign will be installed identifying the park. Raymond Avenue Park Staff will clean up the existing site; construct a 20 x 40 picnic shelter; and install picnic tables, grills and garbage containers. A 200 foot long by 8 foot wide fishing pier with 3 boat slips will be installed with a wood chip trail connecting the existing parking lot to the picnic shelter and fishing pier. The standardized City park sign will be installed identifying the park. ISSUES: City staff typically constructs amenities such as picnic shelters and fishing piers during the winter months to maximize staff utilization. Staff is prepared to construct the picnic shelters and fishing pier/boat slips at this time. The picnic shelter and fishing pier design are the same as we have constructed and used in other city parks in an effort to save money on design and structure engineering fees. In addition to the construction of the picnic shelters and fishing piers/boat slips, staff will install the grills and tables, haul aglime and sand, install the park signs and perform grading and seeding. The City can't expend funds on these improvements until the land is transferred to the City. The City Attorney's Office is currently working on the land transfer with the State of Minnesota and Scott County utilizing the tax forfeit land statutes. Therefore these expenditures will be contingent on the transfer of property. FINANCIAL The City Council anticipated that the improvements would need to be funded IMPACT: and thus provided $85,000 for the improvements to South Shore Drive and Raymond Avenue parks in the Capital Improvement Program. Quotes for the lumber for the two picnic shelters were received from Monnen's Lumber and Westerman Lumber. The quotes are displayed in the tabulation below: Vendor Cost Westerman Lumber $16,337.00 Monnen's Lumber $17,200.00 Quotes for the concrete floors for both picnic shelters were received from Cavanaugh Concrete Company and Franek Concrete & Masonry. The quotes are displayed in tabulation below: Vendor Cost Clausen Concrete $3,360.00 Franek Concrete & Mason $3,840.00 Quotes for the floats, lumber and hardware were received from Minncor and Follansbee Dock Systems. Funding is available in the Capital Parks Fund to complete these improvements. Approve a resolution approving purchase of the materials and expenditures needed for Raymond Avenue and South Shore Drive parks. 2. Defer action on this agenda item to a date certain for a specific reason. 3. Deny this agenda item for a specific reason and provide staff with direction. NOW THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF PRIOR LAKE, MINNESOTA as follows: 1. The recitals set forth above are incorporated herein. 2. City Council authorizes staff to expend up to $75,693.17 for the materials for Raymond Avenue and South Shore Drive parks. 3. Funding for these improvements shall come from the Capital Parks Fund 4. The expenditures shall not be made until the Raymond Avenue and South Shore Drive Park properties have been transferred to the City. PASSED AND ADOPTED THIS 5t" DAY OF OCTOBER 2009.
