Introduction
The purpose of this agenda item is for the City Council to consider accepting
bids and awarding the City's Standardized Construction Contract for the Water
Quality Pond Maintenance Project.
Historv
On September 21,2009, the City Council accepted plans and authorized the
advertisement for bids on this project. Bids were received on October 19, 2008.
The project plans included excavation, maintenance and restoration work on four
to seven water quality ponds in the City. The bid was structured to include four
ponds as a main bid, and three ponds as alternate bid items. The plans and
specifications were approved and advertisement for bids was authorized by the
City Council on September 21.
Current Circumstances
The City received seven bids on October 19, 2008. The bids have been checked
and tabulated. ASTECH Corporation (Asphalt Surface Technologies
Corporation) from St. Cloud, Minnesota submitted the low bid in the amount of
$131,851.00. The lowest bid was 9% or $11,003.22 above the engineer's
estimate of $120,847.78. The bid summary is provided as follows:

ASTECH is a responsible Contractor and has experience in a variety of paving
projects. Although pond maintenance will be a new endeavor for this company it
represents off season work from paving and the project manager has relevant
experience in past employment. Based on the project manager experience and
references related to other projects the City recommends award of a contract to
ASTECH Inc.

ISSUES:
The bid was set up to maintain as many ponds as possible under the remaining
water quality capital improvement budget of $133,500.00. The low bid submitted
allows for the maintenance of six of the seven ponds under the remaining budget
amount including Alternates #1 and #2. Alternate 3 (Pond 6) will be postponed
until the next water quality pond maintenance project, currently planned for
January 2011.
FINANCIAL
IMPACT:
This project will be funded through the Water Quality Fund capital improvement
account #602-49420-530.
ALTERNATIVES:
The alternatives are as follows:
1. Approve a resolution accepting bids and awarding the City's Standardized
Construction Contract to ASTECH Corp for the Water Quality Pond
Maintenance Project (City Project #09-013).
2. Deny this item for a specific reason and provide Staff with direction.
3. Defer this item until a specific date in the future.

Pursuant to an advertisement for bids for the Water Quality Pond Maintenance Project
(City Project #09-013) which includes excavation, maintenance and restoration work on
six water quality ponds in the City; and.
Seven bids were received, opened, and tabulated according to law; and
There are seven water quality ponds that require maintenance and/or restoration work,
therefore the project bid was structured to (1) identify the ponds that must be included
as part of a bid (Schedule 1 work) and (2) three additional alternatives that added
additional ponds; and
The City has $133,500 in the 2009 Water Quality Fund budget for the project; and
Based on available funding and the bids received the City has elected to complete
Schedule 1 and Alternatives 1 and 2; and
The following bids for Schedule 1 and Alternates 1 and 2 were received complying with
the advertisement:

NOW THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF PRIOR LAKE,
MINNESOTA as follows:
1. The recitals set forth above are incorporated herein.
2. The Mayor and City Manager are hereby authorized to enter into the City's Standardized
Construction Contract with ASTECH Corporation (Asphalt Surface Technologies Corporation) of St.

Cloud, Minnesota in the name of the City of Prior Lake for the Water Quality Pond Maintenance
Project (Project #09-013) in an amount not to exceed $131,851.00.
3. The City Manager is hereby authorized and directed to return to all bidders the deposits made with
their respective bids.
4. The funding source for the 2009 Water Quality Pond Maintenance Project is the Water Quality
Fund # 602-49420-530.
