RE: Driveway Settlement
Dear Mr. Henkemeyer.
Based on your request I have reviewed the issues related to the settlement in your
driveway. This issue was previously reviewed by the Assistant City Engineer and
Maintenance Supervisor both of whom indicated to you that the City was not responsible
for repairing the settlement. I visited the driveway last week and noted the following:
1) The adjacent older portion of the driveway has begun to settle. The settlement
may actually have begun in the older portion of the driveway even though the
hole has formed along the patch joint.
2) The cause of the settlement is unknown; it does appear the water service may run
where the older portion of driveway has settled.
3) The older portion of the driveway has exceeded its life expectancy and is in need
of repair.
City Staff has reviewed our records and while it does appear the patch was completed
with the project in 1995 (based on visual inspection) we have no information regarding
why patch was completed. The size of the patch indicates that it was most like just to
repair the driveway. Because the driveway patch occurred fourteen years ago there is no
warranty from the City for this settlement. The settlement could be related to many
different factors including driveway age and subsurface material failure/consolidation.
By allowing the hole to remain open surface water drainage is most likely contributing to
the settlement. If the cause of the void is related to the sewer service from the street or
the water service from the curb stop (valve in driveway) to the house it is your
responsibility to repair. Based on the settlement location we do not believe the City has
any responsibility related to this issue.
