AGENDA ITEM: CONSIDER APPROVAL OF A RESOLUTION APPROVING THE
COMMON INTEREST COMMUNITY NUMBER 1192 (BOUDIN
CROSSINGS COMMERCIAL CONDOMINIUM) CIC PLAT
DISCUSSION: Introduction
EFH Development is requesting approval of a Common Interest
Condominium Plat for a four unit commercial building on property
bordered by Boudin Street NE and Timothy Avenue. The staff
recommends approval of this CIC plat as part of the consent agenda.
History
On August 17, 2009, the City Council adopted Resolution #09-110
approving the combined preliminary and final plat for Crossroads. The
final plat consisted of 4.19 net acres to be developed into approximately
44,683 square feet of commercial space in the City.
Current Circumstances
The purpose of a CIC plat is to allow the subdivision of condominium
units into lots for each individual unit for sale to individual owners.
Essentially, the plat creates a lot around the four walls of an individual
unit.
Staff has reviewed the CIC plat and finds it consistent with the approved
preliminary and final plat.
ISSUES: CIC plats do not require a development contract. The required
developer improvements were included under a previous final plat, so a
Letter of Credit is not necessary. In addition, the City fees normally
associated with a final plat were collected under the previous
Developmen# Contract for the Crossroads final plat.
FINANCIAL There are no budget impacts with the approval of this CIC plat.
IMPACT:
ALTERNATIVES: The City Council has three alternatives:
1. Adopt a Resolution approving the Common Interest Community
Number 1192 (Boudin Crossings Commercial Condominiums) CIC
Plat.
2. Deny the resolution approving the CIC plat.
3. Defer this item and provide staff with specific direction.

RECOMMENDED A motion and second to adopt a resolution approving the Common

30LUTION AUTHORIZING THE MAYOR AND CITY MANAGER TO SIGN THE COMMON
INTEREST COMMUNITY NUMBER-1192 (BOUDIN CROSSINGS COMMERCIAL
CONDOMINIUM) CIC PLAT

WHEREAS, The City Council adopted Resolution #09-110 on August 17, 2009, approving the
combined preliminary and final plat for the Plat known as Crossroads; and
WHEREAS, The City Council has found that the Common Interest Community Number 1192
(Boudin Crossings Commercial Condominium) CIC Plat is consistent with the approved
combined preliminary and final plat known as Crossroads; and
WHEREAS, The City Council has found that the Common Interest Community Number 1192
(Boudin Crossings Commercial Condominium) CIC Plat does not create a legal
nonconformity of the site; and
WHEREAS, A11 required public utility improvements and fees were included as a part of Crossroads
Plat.
NOW THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF PRIOR LAKE,
MINNESOTA as follows:
1. The recitals set forth above are incorporated herein.
2. The City Council approves the Common Interest Community Number 1192 (Boudin Crossings
Commercial Condominium) CIC Plat.
3. -The CIC plat and all pertinent documents must be filed with Scott County within 60 days from the
date of final plat approval. Failure to record the documents by January 15, 2010, will render the
CIC plat null and void.
4. The Mayor and City Manager are hereby authorized to execute the CIC Plat on behalf of the City.
PASSED AND ADOPTED THIS 16T" DAY OF NOVEMBER, 2009.
