Introduction
The purpose of this agenda item is to accept the Feasibility Report and schedule
a Public Hearing to be held on January 19, 2010 for the 2010 Improvement
Project. In addition a number of additional resolutions are needed to proceed to
the next step for this project.
Historv
Each year the City reconstructs street segments that are scheduled for
reconstruction as part of its Capital Improvement Program (CIP) and have
exceeded their useful design life. The City uses the Capital Improvement
Program and its Pavement Management Program to plan for infrastructure
improvements and the financing of capital improvements. Since this is a County
State Aid Highway, the City must plan and coordinate our CIP with the Scott
County Highway Department's Transportation Improvement Plan.
At its August 17, 2009 meeting the City Council adopted Resolution 09-107
authorizing staff to prepare a Feasibility Report for the 2010 Improvement
Project area as outlined in the CIP.
The project area considered in the report includes portions of Butternut Beach,
Sunset Shore, Spring Lake Townsite, Auditor's Subd #12, and Christies 1st
Add'n. A map of the project area (Exhibit 1) is included in the Feasibility Report
and includes County Road 12 (Spring Lake Road) from Walnut Ave to 900 feet
west of Howard Lake Road. The proposed improvements include street
reconstruction, storm sewer, storm water quality, concrete curb and gutter, and
appurtenant work. City utilities under the street are also proposed to be repaired
or reconstructed based on need. Selected sections of sanitary sewer are
proposed for replacement. Watermain is proposed to be replaced for certain
street segments. The design, bidding, and construction for this project will be
coordinated by the Scott County Highway Department.

ISSUES:
Other City Programs:
In 2008 and 2009, the City introduced a driveway reconstruction program to
residents located within the reconstruction project area. This program will
continue for the 2010 project. The urban reforestation program will also
continue for this project. The rain garden program will not be offered to residents
on this project as City Water Quality dollars are being allocated toward the
Northwood Park and Sunset Hills Park water quality improvements.
Real Estate Appraisals:
The real estate market has changed in recent years and valuations continue to
decline. Since this County Road project is unique, it is recommended that the
City conduct real estate benefit appraisals for this project. The real estate
benefit appraisals will be conducted on several homes to get an idea of how
much the improvements will increase the property values. The City has received
proposals from two firms that specialize in this type of appraisal. The two firms
are Nagell Appraisal and Consulting and BRKW Appraisals Inc. Each firm
provided a quote to conduct 6 appraisals for the price listed below:

City Staff is recommending that the City enter into a professional services
contract with BRKW Appraisals Inc. for real estate appraisal services. The City
has asked that the appraisals be completed prior to the proposed January 19th,
2010 Public Hearing.
Parking Restrictions:
Because only 6 foot shoulders are proposed on this project and because this is a
State Aid route, a resolution restricting parking on CSAH 12 between 1 mile east
of CSAH 17 to 0.4 miles west of TH 13 is required for County State Aid funding
eligibility. The City has previously approved similar resolutions for CR 82 and the
CR 12 Phase 1 and 2 projects. Because of the lack of right of way, the County
did not pursue wider shoulders for on street parking. Scott County will be
submitting the plans to MnDOT in December. This resolution is needed for the
MnDOT plan approval process.
Cooperative Agreement Amendment:
On April 16th, 2007, the City and County entered into a Cooperative Agreement
for the County Road 12 project. This Cooperative Agreement included all four
phases of the project including the construction phase. Per the original
Cooperative Agreement, the City and County agreed to amend the Cooperative
Agreement once final design plans and costs were completed. An attached
resolution authorizes an amendment to the Cooperative Agreement that sets out
the City's estimated cost share for this project.
The Assessment Review Committee met on November 17,2009, at which time
the following issues were discussed and recommendations made:
Street and Storm Sewer Reconstruction:
Pursuant to the Assessment Policy, the street and storm sewer reconstruction
should be assessed at up to 40% of the total project cost against the benefiting

properties. The remaining amounts should be recovered through the general ad
valorem property tax.
Assessment Map:
The Assessment Review Committee recommends assessing the properties as
shown on the assessment map.
Assessment Method:
The Assessment Review Committee recommends the unit method of
assessment for the 2010 Improvement Project due to the fact that the lots in the
project area are of similar size and/or value. The estimated assessment rate is
proposed at $3,434.00/unit.
Driveway Reconstruction Program:
The Assessment Review Committee agrees to continue the driveway
reconstruction program for the County Road 12 project.
Project Schedule:
In order to keep the project on schedule and to allow the City to complete the
improvement hearing process it is necessary to proceed with approvals at this
time. Both the City and the County propose to use State Aid funds for this
project and as part of that approval the City Council must approve the design
approval and no parking resolutions. These resolutions are the same as those
approved with phase 2 of the CR 12 project.
Should the City Council decide not to approve the feasibility study and related
resolutions the project could be delayed. A delay may increase bid prices. The
County could elect to proceed without the City resolutions with a variance from
State Aid. In this scenario the City's ability to assess the project could be
jeopardized which could result in a larger tax levy burden if the project proceeds.
Conclusion
In summary, the project is feasible from an engineering and economic
standpoint. Approval of the Feasibility Report does not grant final approval of the
project.
The attached Feasibility Report outlines which portions of the cost for the above
project will be assessed to the benefiting properties. If the Council approves the
Feasibility Report, the Chapter 429 special assessment statute requires a Public
Hearing be conducted prior to proceeding with the project to determine if it is to
move forward.
This project is the third phase of a four part project. Reconstruction has already
been completed both on the east and west ends of this project in accordance
with the design approved by the city council in 2004
FINANCIAL
IMPACT:
The 2010 Improvement Project is proposed to be financed by special
assessments, tax levy, municipal state aid, water quality fund, sewer and water
fund, Prior Lake Spring Lake Watershed District grant, private funding, and Scott
County funding. Funding sources and amounts are as shown below:

The above costs are estimated final costs will be subject to actual bids. The
City will be invoiced by the County upon receipt of the bids and the above costs
will be amended to reflect bid prices. City Staff will prepare a payment agenda
in the future for Council consideration upon receipt of the project invoice from
the County.
ALTERNATIVES: The alternatives are as follows:
1. Approve a resolution accepting the Feasibility Report and establish a Public
Hearing date as per the attached resolution
2. Approve a resolution accepting proposals and authorizing the Mayor and City
Manager to execute the City's Standardized Contract for Professional
Services with BRKW Appraisals Inc. for real estate appraisal services.
3. Approve a resolution approving parking restrictions on County State Aid
Highway (CSAH) 12 between 1 mile east CSAH 17 to 0.4 miles west of TH
13 SAP 70-621-23
4. Approve a resolution approving the design and an amendment to the
cooperative agreement with Scott County for the County State Aid Highway
(CSAH) 12 Reconstruction Project SAP 70-612-10
5. Table these Resolutions for a specific reason.
6. Deny the Resolutions.

RESOLUTION ACCEPTING THE FEASIBILITY REPORT AND CALLING FOR A
PUBLIC HEARING ON THE 2010 IMPROVEMENT PROJECT

WHEREAS, Pursuant to Resolution 09-107, the City Council, on August 17, 2009, ordered a
Feasibility Report to be prepared by the City's Engineering Department with reference
to the improvement of County Road 12 from Walnut Avenue to 900 feet west of Howard
Lake Road; and
WHEREAS, The CSAH 12 from Walnut Avenue to 900 feet west of Howard Lake Road Feasibility
Report dated November 24, 2009 contains information that the proposed project is
necessary, cost effective, and feasible.
NOW THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF PRIOR LAKE,
MINNESOTA as follows:
1. The recitals set forth above are incorporated herein.
2. The City Council hereby accepts the Feasibility Report as submitted.
3. The Council will consider the improvement of such streets and areas in accordance with the Report
and the assessment of property as described in the Report for all or a portion of the cost of the
improvements pursuant to Minnesota Statutes Chapter 429 at an estimated total cost of the
improvements of $4,356,475.00.
4. A Public Hearing shall be held on such proposed improvements on the 19th day of January, 2010 at
Prior Lake City Hall, with the address of 4646 Dakota Street SE, City of Prior Lake, Minnesota at
6:00 p.m. Statutory notice and publication requirements shall be followed.

RESOLUTION AUTHORIZING BRKW APPRAISALS INC. TO PROVIDE
REAL ESTATE APPRAISAL SERVICES FOR THE 2010 CONSTRUCTION PROJECT

WHEREAS, Real estate benefit appraisals are necessary to determine whether and to what extent
the value of property has changed as a result of a city improvement. The incremental
increase in value from before and after an improvement project determines the amount
of special benefit to the property as a result of the improvement. This type of benefit
appraisal helps the City determine whether a proposed special assessment is
appropriate and defensible; and.
WHEREAS, The City does not have the in house expertise to prepare special benefit appraisals;
and,
WHEREAS, The City solicited and evaluated proposals from BRKW and Nagell in accordance with
the City purchase policy for appraisal services; and,
WHEREAS, The low proposal of $4,000 was submitted by BRKW and Staff recommends award of
the City's Standardized Professional Services Contract to BRKW.
NOW THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF PRIOR LAKE,
MINNESOTA as follows:
1. The recitals set forth above are incorporated herein.
2. BRKW is hereby selected to provide real estate appraisal services for the 2010 construction project
for a base price in the amount of $4,000.00.
3. The Mayor and City Manager are authorized to execute the City's Standardized Professional
Services Agreement with BRKW on behalf of the City.
4. Funding for these engineering services will be drawn from the Construction Fund Account #501-
48369-505.

WHEREAS The County of Scott has planned the improvement of County State Aid Highway
(CSAH) 12 from one mile east of CSAH 17 to 0.4 miles west of TH 13 ( the "Highway"
); and
WHEREAS, The County of Scott will be expending County Sate Aid Funds on the improvement of
the Highway; and
WHEREAS, This improvement lacks adequate width to provide for parking on both sides of the road
and therefore in order to qualify the construction as a County State Aid Project, the
City must agree to and adopt certain parking restrictions.
NOW THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF PRIOR LAKE,
MINNESOTA as follows:
1. The recitals set forth above are incorporated herein.
2. The City of Prior Lake prohibits the parking of motor vehicles on both sides of CSAH 12 between
one mile east of CSAH 17 to 0.4 miles east of TH 13 and authorizes the signage and enforcement
as required.

profiles, grades and cross-sections for the reconstruction of CSAH 12 within the limits
of the City of Prior Lake as a State Aid Project and seeks approval of the Plans from
the City Council; and
WHEREAS, The Final Design Plans are consistent with the City's Preliminary Engineering Report
and previous approvals by the City Council; and
WHEREAS, The Final Design Plans contain revised project costs; and
WHEREAS, The City of Prior Lake's share of the cost of the Project is allocated as follows:

4. The Cooperative Agreement is amended and approved to include the City's share of the new
project costs developed as part of the Final Design Plans.
5. The City of Prior Lake shall reimburse Scott County approximately $1,571,202 for the CR 12
Improvement project as estimated above. This amount excludes the City's Administration and
Engineering costs for Street and Utility Construction of $138,690 and street light installation costs of
$127,000. Construction costs will be recorded in the Construction Fund (#501-48369-501) for CR
12 from Walnut Avenue to Howard Lake Road Improvements
6. City Staff is authorized to transfer the following amounts to the Construction Fund #501-48369-501:
. Enterprise Fund Water Utility ($534,429.00) # 601-49303

Notice is hereby given that the City Council of the City of

parcel benefiting from said improvements, whether

INTRODUCTION
On August 17, 2009 the Prior Lake City Council adopted Resolution 09-107, which ordered the
preparation of a Feasibility RepOli for improvements to the project area listed below:
CSAH 12 (also called l70th Street and Spring Lake Road)
(Walnut Avenue to approximately 900 ft west of Howard Lake Road)
located within Township 114 North, Range 22 West, Sections 3 & 4,
Scott County, Minnesota.
SCOPE
This report evaluates the feasibility of reconstructing the street and replacing utilities in the
project area. All existing infrastructure (streets, sanitary sewer, watermain, etc.) was evaluated.
The results of that evaluation form the basis of the recommended improvements. Cost estimates,
funding strategies, and a proposed timeline are also explored in this report.
BACKGROUND
The proposed project area is shown on Exhibit 1. County Road 12 has failing bituminous
surfaces. The existing road width on County Road 12 is 24 feet of bituminous roadway and 0 to
6 feet of aggregate shoulder in each direction. County Road 12 was originally paved in 1974.
The streets no longer meet minimum design standards and it is not cost effective to continue to
patch the streets. The existing typical sections are shown on Exhibit 2.

The sanitary sewer system for County Road 12 was installed in the mid 1970s. The sanitary
system consists of 12-inch reinforced concrete pipe and 8-inch vitrified clay pipe. The sanitary
sewer for the project area was televised in April of2009. The televising report indicates offset
joints, heavy mineral deposits, pipe sags, and service pipe infiltration on various pipe segments.
The watermain system for County Road 12 was installed in the mid 1970s and consists of 16-
inch ductile iron pipe. The watermain in this area has not shown a history of failure.
The current storm water is conveyed through the County ditch system including corrugated metal
storm sewer pipe at driveway crossings. The storm sewer system carries runoff nOlih towards
Upper Prior Lake. The storm water is conveyed by means of surface flow and storm sewer pipes.
The channel between Spring Lake and Upper Prior Lake is a part of the corridor and includes and
existing large diameter culveli pipe under CSAH 12. Because this region was developed in the
1970's it did not include stormwater rate control, water quality treatment ponds, or volume
control features that are today considered standard practice.

driveway restoration, and bituminous surfacing. All streets in the area are proposed to have a ten
ton design pavement section. The proposed width for County Road 12 is 36 to 48 feet. This
includes two 12 foot travel lanes, a 12 foot center turn lane (for portions of the corridor) and 6
foot paved shoulders to the curb line for the 48 foot width. The typical section also includes a
bituminous walk on the north side of County Road 12 and a 5 foot sidewalk on the south side of
County Road 12. Side streets that tie into CSAH 12 will be reconstructed at the intersection
locations.

The proposed street section as recommended by the County for CSAH 12 includes: 2 feet of
granular borrow, 6 inches of Class 5 aggregate base, 5 inches of bituminous base course applied
in 2 lifts, and 2 inches of bituminous wear course. Subcutting the roadway and placement of the
granular borrow enlarges the scope of the street reconstruction and increases the cost of the
project, but provides for a longer lasting roadway. The typical street sections are shown on
Exhibit 2.
The existing right-of-way is 73 to 90 feet wide. Right-of-entry agreements, temporary easements
and purchased right of way will be necessary for the project. Right-of-entry agreements will be
necessary for driveway restoration.
Creekview Circle is a private driveway shared by 4 residents along the corridor. Once utility
upgrades are concluded, this private driveway is proposed to be paved.

Drivewav Reconstruction Pro~ram
As a part of the 2008 and 2009 Reconstruction Project, the City introduced a driveway
reconstruction program. Residents within the project area could reconstruct their driveway using
the City's Contractor. The driveway work was bid through the large City contract allowing for
reduced pricing on the driveway work. Residents were required to pay the costs prior to
construction, based on the calculation and letter from the City's Engineering Department. This
program is proposed to be continued for the CSAH 12 Improvement Project.

Sanitary Sewer
Proposed sanitary sewer improvements are shown on Exhibit 3. . The televising report indicates
offset joints, heavy mineral deposits, pipe sags, and service pipe infiltration various pipe
segments. It is recommended that the failing portions of sanitary sewer pipe be replaced. Pipe
lining is proposed for the sanitary sewer not scheduled for replacement and where lining is
necessary. Pipe lining will be done by a separate contractor at a later date detelmined by the
Public Works Department.

In areas that the sanitary sewer is replaced, service connections will be replaced from the main
line to the property line. Additional sanitary service connections are also proposed to be replaced
on roads that are scheduled for pipe lining due to infiltration issues.
The homes on Creekview Circle have long services that COlmect to the sanitary sewer main in
County Road 12. It is recommended that additional sanitary sewer main be constructed on
Creekview Circle to reduce the service length.
Watermain
Proposed watermain improvements are shown on Exhibit 4. The existing l6-inch ductile iron
pipe is in good condition, however because the road is being lowered in some areas, various
portions of this pipe are scheduled to be replaced. Water service connections will be replaced
from the main to the property line and new curb boxes will be installed within the entire project
area. All gate valves, hydrants, and curb stops will be replaced. New hydrants will be installed
in accordance with the spacing guidelines outlined in the Public Works Design Manual for the
entire project area.
The homes on Creekview Circle have long services that connect to the watermain system in
County Road 12. It is recommended that additional watermain be constructed on Creekview
Circle to reduce the service length. A fire hydrant should be added at the end of the new main
for flushing purposes and fire protection.

Storm Sewer
Proposed storm sewer improvements are shown on Exhibit 5. The existing ditch system will be
replaced with concrete curb and gutter and storm sewer piping. The storm sewer pipe system is
designed to convey the 10 year probability storm. The storm sewer system improvements will
consist of catch basins and reinforced concrete piping that routes water from the road surface and
nearby drainage area to the proposed ponds, infiltration basin or large sump manholes.
A permit from the Prior Lake Spring Lake Watershed District was granted for all phases of the
CR 12 proj ect prior to phase 1.
Water Oualitv
Upper Prior and Spring Lake are both classified as impaired water bodies, meaning they do not
currently meet state water quality standards. Extra effort is proposed to mitigate water quality
damage from uncontrolled runoff from CR 12 using both structural and non structural methods.
Structural improvements proposed to promote water quality include; A bioretention system at
NOlihwood Park, an underground infiltration system at Sunset Hills Park, and sump manhole
structures near the Spring Lake outlet channel. As part of previous phases, storm water
improvements including a pond and infiltration basin were constructed at the intersection of CR 12
and TH 13 in 2007 and another pond was constructed in 2007 near the Spring Lake Regional Park
Nonstructural methods are also proposed to promote water quality including; strict stonnwater
pollution prevention measures during construction, reforestation efforts, and targeted intensive street
sweeping. By collecting and controlling runoff and sediment at it sources, these efforts reduce
pollutant concentration and flow volume into the nearby sensitive waters.
Rate and Volume Contro~
The rate and volume control improvement are designed to reduce downstream tributary area by
treating small catchments by infiltrating water into soils to cut volume and peak rates to the
Lakes. The benefits to this approach not only save money by allowing smaller downstream pipe,
but water quality is also benefited through the reduction of water and nutrients that comes from
the area.
Northwood Bioretention: The proposed bioretention improvement has two parts that work in
tandem (see Exhibit 6); an above ground bio-filtration system and nearby tree plantings. The
bio-filtration system is surrounded by trees and planted in native grasses that use deep roots to
utilize the water. The bio-filtration technique allows excess water to soak into the ground in the
shallow depression rather than flow downstream. This alternative of treating water at its source
meets the goals outlined in the City surface water management plan. The park is intended to
remain in active use in the winter for ice skating by creating a valve system that will allow City
Staff to flood the bioretention basin to create the rink.
Sunset Infiltration: The proposed infiltration system is planned to reduce peak rates and volume
by capturing runoff flowing down the ditch line near the Sunset Trail Park and using the sandy
soils of the area to infiltrate.

Watershed District Partnershio,
Costs for the rate, volume and water quality treatment system will be shared by the City and
Watershed. The District has agreed to help create plans for the treatment system and provide up
to $73,000 in matching funds for construction.
Overhead Power Burial and Street Li{!hting
The cost for the burial of the overhead power along this corridor was evaluated. Xcel Energy
provided a cost estimate that exceeded $600,000 for the mainline power burial. In addition to the
mainline burial, each resident must bury their service line from the street to the home connection
point. This cost depends on the length from the connection to the mainline in the street but is
approximately $1,200 per household. Based on these estimates, the overhead power burial does
not seem feasible based on cost. If pursued, a community surcharge would be added to the Xcel
utility bill for each resident in the community who is served by Xcel Energy.
In addition to the overhead power burial estimate, Xcel Energy has also given the City a cost for
street lighting. Upgrading the corridor with shoebox style street lights would cost approximately
$127,000. This would be an assessable component of the project. Upgrading the street lighting
would improve driver and pedestrian safety.
Funding
It is proposed that the benefiting property owners be assessed for portions of street and storm
sewer construction. State Aid Funds and Tax Levy will be utilized for the remaining non-
assessed portion of the street and storm sewer improvements and sidewalk improvements. The
Sewer and Water Enterprise Fund is proposed to finance the water and sanitary sewer
improvements. Water quality improvements are proposed to be paid for out of the Water Quality
Fund and by the Prior Lake Spring Lake Watershed District. Private driveway improvements
will be passed along to those properties participating in the Driveway Reconstruction Program.
The bulk of the project will be paid for by Scott County for the reconstruction of County Road
12.

The estimated cost for the County Road 12 project is $4,356,475. This does not include
easements or right of way acquired for the project. The City's share of CR 12 is estimated at
$1,836,892. The total assessable portion of the project is $781,331 of which 40% is proposed to
be assessed to the benefiting property owners.
With a total estimated project City cost of $1,836,892 and estimated bond issue of $753, 796, the
assessed amount of $312,494.00 would be equivalent to 41% of the total bond issue. Minnesota
Statutes Chapter 429 Special Assessment Bond issue requires that a minimum of20% of the total
bond issue amount be recovered through special assessments.
