PLANNING COMMISSION MINUTES
MONDAY, SEPTEMBER 28, 2009
1. Call to Order:
Chairman Ringstad called the September 28, 2009, Planning Commission meeting to order at 6:00 p.m.
Those present were Commissioners Perez, Billington, Howley and Ringstad, Planner Jeff Matzke and
Community Development Assistant Michelle Czycalla.
2. Approval of Minutes:
The Minutes from the July 27, 2009, Planning Commission meeting were approved as presented.
3. Public Hearings:
A. EP09-124 Premier One Landscapes is requesting property line setback variances from the
Zoning Ordinance for construction of subdivision monument signs.
Planner Jeff Matzke presented the Planning Report dated September 28, 2009 on file in the office of
the Community Development/Natural Resources Department.

The two subject properties are located along Eagle Creek Avenue at 4030 154 Street NW and 4035
Windsong Circle NW. They are zoned R1 (Low Density Residential) within the Shoreland District and
are guided as R-LD (Urban Low Density Residential) on the comprehensive land use map.
The applicant is proposing to install subdivision monument signs on the corner of County Road 21 and

154 Street NW and the corner of CSAH 21 and Windsong Circle. The previous monument signs were
removed when the western portions of these two properties were acquired by Scott County for the
expansion of CSAH 21. Scott County does not allow these signs to be placed in right-of-way areas;
therefore, the association has proposed to place the signs on the corners of private property.
Commissioner Questions
Billington
asked if there were comments from nearby neighbors regarding the placement of the signs.
Matzke
indicated the City has not received any comments from the neighbors. Matzke added that the
association is planning a total of six or seven signs within the subdivision and believes that everyone in
the are has been well informed about the signs.
Perez
asked if Scott County has a variance process.
Matzke
replied the County does have a variance process; however, it is more lengthily and has
stringent guidelines.
Howley
asked if the home owners association understands that these signs are located in utility
easement areas and if the signs need to be removed the association is responsible for them.
Matzke
stated that the City Engineering Department has looked at the location of the signs. Matzke
added that the signs are not located over any piping and the only potential issue may be drainage.
Matzke stated that the signs fit in with the drainage system within these properties and doesn’t foresee
any issues arising due to the placement of the signs.
The public hearing opened at 6:08 p.m.
The public hearing closed at 6:10 p.m.

Views monument signs like these are important in providing direction and adding to the ambiance of the
City.

6. Announcements and Correspondence:
The next Planning Commission meeting scheduled for October 12, 2009 will be cancelled.

The City has received a Conditional Use Permit application from Shakopee Public Utilities

Commission for construction of a utility substation that will appear at a future Planning
Commission meeting.
The compost site will be open the second and fourth Sundays in October and is located
?
northwest of the intersection of County Road 42 and County Road 83.
