CONSIDER APPROVAL OF 2010 CIGARETTE LICENSE RENEWALS
Cigarette license renewal applications are due annually in December. At-
tached to this agenda report is a list of the thirteen establishments requesting
renewal of their cigarette licenses. The annual fee for cigarette licenses, as
stated in the current City Fee Schedule, is $250.00.
All applicants have provided completed applications and paid the $250.00 li-
cense fee. The City has on file a copy of the educational materials required by
the City ordinance for each applicant. The Prior Lake Police Department has
reported no problems over the last four years except for the following:
. In 2006 Narayan Gas & Groceries and Prior Lake Shell were cited for sell-
ing cigarettes to minors.
. In 2007 Captain Jack's was cited for selling cigarettes to minors.
. In 2008 Narayan Gas & Groceries was cited for selling cigarettes to mi-
nors.
. In 2009 Narayan Gas & Grocieres was cited for selling cigarettes to mi-
nors.
In each case criminal charges were brought against the clerk and civil
fines/suspensions were brought against the business. At its March 16, 2009,
Council meeting, the City Council required Narayan Gas & Groceries to pur-
chase an identification card reader to ensure that the age of all tobacco pur-
chasers was being verified. Narayan Gas & Groceries complied with this re-
quirement and provided proof of purchase of the equipment. The 2009 citation
against Narayan Gas & Groceries is still pending in the court system. If the
clerk is found guilty the city code provides that the license be revoked. Until
then, under the presumption that the clerk is innocent until proven guilty, the
cigarette license for Narayan Gas and Grocery as well as all renewal requests
including those with the violations summarized above are recommended for
renewal.
The City Council has the following alternatives:
1. Adopt a motion as part of the consent agenda approving the cigarette
licenses for 2010.
2. Deny one or more of the license requests.
Staff recommends Council approve the 2010 cigarette license renewals as
pa of the consent agenda.
