HomeMy WebLinkAbout11E - 2010 Offical City Fee Schedule AGENDA ITEM: DISCUSSION: CONSIDER APPROVAL OF THE 2010 OFFICIAL CITY FEE SCHEDULE Introduction The purpose of this agenda item is to consider approval of the 2010 Official City Fee Schedule in accordance with the city council's bylaws. The fee schedule identifies those types of service charges and license fees charged on a user basis to recover city-associated costs as directed by the City Council in an effort to reduce reliance upon the property tax. The intent is that the user who benefits should pay the ultimate cost of the service provided. Historv Staff reviews the fee schedule as a part of the annual budget process and makes recommendations for changes or additions as needed. Current Circumstances Attached is the proposed 2010 Official City Fee Schedule that lists fees, service charges, escrows and securities. Park Support Fee should be removed from the Fee Schedule as it is a fee assessed as part of the development contract processing and not with the building permit. 2 - 3. Sewer Rate has been segregated into two components per City Council approval on November 16, 2009: Sewer Rate and MCES Rate. Any changes to the Sewer Rate and MCES Rate will be considered at a future date when a Utility Rate Analysis is presented by staff to the City Council. 4 -7. Tower Antenna Rentals are charged to companies that have placed their antennae on city-owned water towers and/or poles. The fees have historically been negotiated and are incorporated into standard antenna agreements. Therefore, staff recommends that the antenna rental fees be removed from the Fee Schedule. 8. On-Sale Intoxicating License fee increases were approved by the City Council in March, 2008 for the years 2008-2010. The change from 2009 to 2010 is $330. The new fee would be effective with the July 2010 renewal date for on-sale intoxicating liquor licenses. 9. Bingo/Gambling License has been separated into two permits (Temporary Gambling Permit and Gambling Premise Permit) to provide greater clarity as to the purpose of the fee. 10. Fertilizer License fee should be removed from the Fee Schedule. The City does not monitor fertilizer companies. State statute restricts the use of phosphorus in fertilizer. i (}q '"j ji) 11. Driveway Permit fee increase from $10 to $30 is needed to cover a greater portion of the costs for inspecting driveway improvements for impervious surface issues and width requirements. Actual cost is estimated at $66. 12 -16. Excavation and Grading Permits and Escrows. Historically, the fees associated with excavation and grading permits have been based on the UBC graduated fee schedule which is based on soil movement. Because residential earth moving is quite different than a commercial or development grading project, a separate residential excavation and grading permit is recommended for projects less than one acre. Residential projects greater or equal to one acre would be subject to an escrow comparable to a commercial/developer escrow. Securities for both residential and commercial/developer restoration have historically been charged. This security should be added to the Fee Schedule. 17 - 19. Right of Way Permits and Securities. The City operates an on-line program called ROWA Y for processing City Right of Way permits. A registration fee of $25 was approved by the City Council on March 3, 2008 to cover a portion of the City's annual costs for the program. This fee should be added to the Fee Schedule. In addition, Staff will begin implementing this program for issuing Landscaping Right of Way Permits which would require Landscaping companies to pay the $25 annual registration fee and to utilize the online ROWAY program. The $250.00 Right of Way Permit is an existing fee. Clarification should be added to the Fee Schedule that this fee is waived for companies that have franchise agreements with the City on the basis that such fees are part of the franchise fee paid to the City. Staff is recommending that a new escrow in the amount of $500 be collected from companies that do not have franchise agreements with the City to ensure that restoration of yard or boulevard areas is completed for right of way projects. Upon satisfactory completion of the project, the remaining balance of the escrow would be returned to the company. Securities are currently collected when a Right of Way project involves cutting into City streets. This security should be added to the Fee Schedule. 20. The MCES SAC (sewer availability charge) increase of $100 from $2,000 to $2,100 is required by the Metropolitan Council Environmental Services. The fee helps pay the capital costs of construction of the Metropolitan sewer interceptor system. This rate has increased incrementally by $50-150 each year since its inception and will continue to increase over the next four years according to the Metropolitan Council. 21 - 22. Seasonal Kayak and Canoe Rental fees have historically been charged for the May 1 - September 30 period: Residents - $50.00; Non- Residents - $100.00. These fees should be added to the Fee Schedule. 23. Lakefront Park Pavilion Rental. A correction has been made that there ISSUES: ALTERNATIVES: RECOMMENDED MOTION: f< ! ~) is a two-hour minimum for rentals that occur Monday through Friday. A one- hour minimum was incorrectly stated on previous fee schedules. The Parks Advisory Committee did recommend an increase in the non residential fee but the staff suggests that this modification be considered next year. 24. Club Prior Rental fees have historically been charged. These fees should be added to the Fee Schedule. 25 - 26. Field Reservations and Softball Tournament Fees. During the 2010 budget process, there was considerable discussion about the level of service provided to athletic organizations and community events and the associated costs being absorbed by the City. The athletic organizations stated that they were unable to pass along a portion of the costs that the City incurs for these services. Consequently, the 2010 City budget was adjusted to reflect the reduced level of service that would be provided. Staff has recommended during previous budget workshops that any additional service requested by the organizations should be provided on a cost-basis and incorporated into an agreement with the organization. 27. Picnic Table Moves. Staff is recommending that the $1 O.OO/table fee is replaced with "cost per agreement" language. The amount would be determined by the cost of staff and equipment needed to move the tables for the event. 28. TIF Reassignment. Staff is recommending that the costs associated with the reassignment of Tax Increment Revenue Notes be passed on to the party requesting the reassignment. Additional Information. A memo prepared by Larry Poppler, Assistant City Engineer, which provides additional details regarding the requests for changes to Driveway Permits, Right of Way Permits, Excavation and Grading Permits and Fertilizer Permits is attached for your reference Revenue categories in the proposed 2010 Operating Budget are based upon the attached fee schedule. Prior Lake has a history of charging fees in proportion to city expenses for services for which a discrete benefactor can be identified. This practice is consistent with our Financial Gold Standards in which we seek to establish a 60-40 relationship between tax levy and non-tax revenue sources. The following alternatives are available to the City Council: 1. Approve the 2010 Official City Fee Schedule as presented 2. Approve the 2010 Official City Fee Schedule subject to specific Council amendments 3. Delay action if the Council requires additional information. Many more driveways are constructed but people do not know they need a permit. The average time to process the permit and perform one site inspection is 1.5 - 2 hours. Some driveway permits are straight forward while others around the lakes are more complicated. Currently the driveway permit fee is $10. Based on a 1.5 hour average the $10 fee does not come close to covering the cost. Based on the 1.5 hour average, the true cost would be $66. Other Cities in the area do not require a driveway fee, however, because of the impervious surface issue and the maximum 24 foot width requirement, the City of Prior Lake should continue to offer this permit. Understanding that the City encourages people to receive driveway permits, a $66 fee may discourage compliance. With that in mind, the Engineering Department recommends a $30 permit fee. Driveway permit.................... ......... .............. .... .......$30 RIGHT OF WAY PERMIT - The City operates an on-line program called ROWA Y for processing City Right of Way Permits. This program requires the Contractor or Utility Company to pay a yearly $25 registration fee. The registration fee helps to offset the online program which has an annual cost of $1,200. We typically have around 10 companies register, so only a fraction of the online costs are recouped. In addition, the City Right of Way Permit fee is $250. Currently the City also requires an LOC when the work involves cutting into City streets. This fee and LOC requirement is waived for those companies that have a franchise agreement with the City. For franchise companies, the review time for the permit is minimal as they understand the City process. A site visit is conducted at some point after construction. If construction included roadway work, inspection is much more substantial. Yard restoration was an issue on one recent Right of Way permit. For this reason, the Engineering Department recommends that a $500 restoration security be taken for non-franchise companies for restoration of yard or boulevard areas. The security would be returned once the project is complete. As with current practice, security for cutting and repairing the street would be done based on 125% of a cost estimate for the street restoration. The Engineering Department does not recommend any changes to the $250 right of way fee or $25 registration fee. Landscape companies use the City Street to dump topsoil or mulch and progressively use the street stockpiles to complete landscape renovations for property owners. The soil and mulch stockpiles temporarily obstruct the City street. The monitoring and permitting for these activities has now been turned over to the Engineering Department. The Engineering Department would like to run the permitting for this work through the ROWA Y right of way program. This program requires a yearly $25 registration fee. No additional fees are proposed. Security will not be required unless the individual landscaper has shown a history of damage to City roadways or fails to clean up after their work. Each right of way permit for landscaping will be communicated to the Police Department. Landscaping Right of Way Permit Yearly Registration........ ..$25 EXCAVATING AND GRADING PERMIT - Currently the fees for the excavating and grading permit have followed the UBC fee schedule. The fee schedule is a graduated schedule based in soil movement. Restoration security for the work is part of the permit but for small residential grading operations, no security is taken. For commercial or development grading the restoration security is $2,000 per acre. Residential Permit Residential earth moving is quite different than a commercial or development grading project. The Engineering Department recommends a separate residential permit for residential excavating and grading projects under one acre. Projects over one acre will require the applicant to receive an NPDES permit from the MPCA. In those cases the permit should follow the Commercial or Development Excavating and Grading Permit. Recent residential projects have proven that having no security does not encourage quick restoration and completion. An open grading site is susceptible to erosion and unsightly for neighbors. The Engineering Department recommends collecting restoration security for residential grading in the amount of $2,000 per O:\BUDGET\201O\Fees & Charges\201O fee schedule memo - Larry Poppler.DOC 2 acre similar to commercial or development grading (For the purposes of calculation, all impacts will be rounded up to the nearest 0.1 of an acre, min 0.1 acre). The security would be utilized to stabilize the project if the project is not completed within the timeframe specified in the permit. If unused, the restoration security would be returned to the applicant after turf stabilization and permit closeout. It is recommended that the fee for a residential grading permit be $100. This would be equivalent to 2.5 hours of staff time which is typical for a residential project. Residential Excavating and Grading Permit................................ ...$1 00 Residential Excavating and Grading Permit Restoration Security.....$2,0001 acre Commercial or Develooer Permit Inspection for development and commercial projects should be reviewed. Because of staffing and fees collected, the City only reviews for erosion control compliance. This is done on a weekly basis for active sites. Once grading is complete, the City receives grading as-built drawings and soil compaction results. Because of the lack of daily inspection, the Contractor could bury stumps, trees, or other debris on site. They could also mine favorable material and bring back less favorable material to the site unchecked or under excavate ponds. While full time inspection would be too costly to implement, a random daily site visit should be performed to check in on the Contractor. The daily inspection could correct major erosion issues before the next weekly inspection (tracking dirt onto local roadways, dust control, etc.) plus review progress, compaction forces, and unfavorable activities. The cost of this would be about $550 per month ($25 per day). In addition, the standard weekly erosion control inspection would be performed at a standard cost of $400 per month of grading operations. It is recommended that the City collect a time based escrow for grading inspection similar to the new preliminary plat escrow. As work is conducted and the escrow is used up, it must be replenished. The escrow amount should be based on the grading schedule. If the Contractor is planning 6 months of grading, the escrow would be collected based on $950 per month. Fees for site plan review or development review would be collected per the application with CDNR. The Engineering Department recommends continuation of the grading restoration security in the amount of $2,000 per acre. The State Statute restricts the use of phosphorus in fertilizer. The Engineering Department recommends removal of the fertilizer permit and fee from the fee schedule. COMMUNICATION - Some residents are unaware that they need permits for some of these activities. In the Spring, many residents are planning work on their property.
