HomeMy WebLinkAbout01-59 RESOLUTION 01-59 RESOLUTION DENYING A MINOR AMENDMENT TO THE CREEKSIDE ESTATES PLANNED UNIT DEVELOPMENT TO CHANGE THE EXTERIOR BUILDING MATERIALS FOR THE 24-UNIT BUILDINGS MOTION BY: GUNDLACH SECOND BY: ERICSON WHEREAS: the Prior Lake City Council considered the proposed minor amendment to the approved development plan for the Creekside Estates on May 7, 2001; and on May 21, 2001; and WHEREAS: owners of properly within the Creekside Estates PUD have been notified of the proposed minor amendment in accordance with Section 1106.607 (2) b of the Zoning Ordinance; and WHEREAS: the City Council finds the proposed minor amendment to the Creekside Estates PUD inconsistent with elements of the Comprehensive Plan and the Zoning Ordinance which stress high quality design; and WHEREAS: the City Council finds the minor amendment is inconsistent with the character of the development as originally approved inasmuch as the proposed change would decrease the cost and value of the project; and WHEREAS: the City Council finds the minor amendment is not compatible with the stated purposes and intent of Section 1105 Planned Unit Developments of the Zoning Ordinance which require a higher standard of building design; and WHEREAS: this project was approved as a Planned Unit Development which provided the City Council with the ability to require a higher standard and the approved design was deemed to be of the desired level of quality whereas the proposed changes are not. NOW, THEREFORE, RE IT HEREBY RESOLVED BY THE CITY COUNCIL OF PRIOR LAKE, MINNESOTA: 1. The recitals set forth above are incorporated herein as findings. 2.
