HomeMy WebLinkAbout01-101 RESOLUTION 01-101 RESOLUTION PROVIDING FOR THE VACATION OF A PORTION OF THE RIDGEMONT AVENUE RIGHT-OF-WAY ADJACENT TO THE PROPERTY LOCATED AT 15543 RIDGEMONT AVENUE MOTION BY: MADER SECOND BY: PETERSEN WHEREAS, the City Council adopted a resolution initiating the vacation of a portion of the right-of-way for Ridgemont Avenue legally described as follows: LEGAL DESCRIPTION: That portion of the platted 2 rod roadway as shown on the plat of CONDON'S WOOD DALE, Scott County, Minnesota, lying southerly and easterly of the following described line: Commencing at the northwest corner of Tract A, Registered Land Survey No. 83, Scott County, Minnesota; thence South 00 degrees 00 minutes 00 seconds West along the westerly line of said Tract A, a distance of 20.00 feet to the point of beginning of the line to be described; thence South 67 degrees 00 minutes 00 seconds West a distance of 18.00 feet; thence South 00 degrees 00 minutes 00 seconds West a distance of 135 feet more or less to the intersection with the westerly line of said Tract A, and there terminating. WHEREAS, notice of the hearing has been duly published and posted in accordance with the applicable Minnesota Statutes, and WHEREAS, a Public Hearing was held on said petition on Tuesday, September 4, 2001, at 7:30 p.m. in the Council Chambers at the Prior Lake Fire Station #1; and WHEREAS, the City Council then proceeded to hear all persons interested in said petition and persons interested afforded the opportunity to present their views and objections to the granting of said petition; and WHEREAS, the portion of the said right-of-way is not necessary for the maintenance of public utilities; and WHEREAS, the City Council of Prior Lake has determined that the vacation of said right-of-way would be in the public interest. NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF PRIOR LAKE, that: 1. (952) 447-4230 / Fax (952) 447-4245 AN EQUAL OPPORTUNITY EMPLOYER Commencing at the northwest corner of Tract A, Registered Land Survey No. 83, Scott County, Minnesota; thence South 00 degrees 00 minutes 00 seconds West along the westerly line of said Tract A, a distance of 20.00 feet to the point of beginning of the line to be described; thence South 67 degrees 00 minutes 00 seconds West a distance of 18.00 feet; thence South 00 degrees 00 minutes 00 seconds West a distance of 135 feet more or less to the intersection with the westerly line of said Tract A, and there terminating. 2. The vacation of said right-of-way is in the public interest. 3. This vacation is subject to the following conditions: a) The property owner must quit claim a 10' wide easement for drainage and utility purposes along the westerly boundary of the property. b) The resolution will not be recorded until the petitioner has submitted a quitclaim deed for the necessary 10' wide drainage and utility easement along the north lot line to the City. 4. Upon completion of the above conditions, this Resolution will be forwarded to the Office of the County Recorder, Scott County, for appropriate action.
