following deficiencies from the perspective of the Planning Department;
1. I understand from Connie that the Planning Department has not received a letter of credit with
a value of 125 % of the estimated construction costs for plants, irrigation system, mulch and
edgers. This letter of credit must be submitted, is held for one year from installation, and is
released upon final acceptance of the landscape elements.
2. The number of trees planted on the East and West property lines is less than that shown
the previously accepted plan. The number is, however, consistent with a discussion I had
with Tim at Metro Cabinets earlier. I previously requested that a revised landscape plan be
submitted so that the file could accurately and completely reflect the agreement about plantings
on these 2 property lines. I have not seen or received a revised plan to date.
3. The shrubs have not been installed; nor have the sod or seeding. For that reason I cannot
accept the landscape installation for purposes of a) releasing the letter of credit for landscape
and irrigation improvements, or 2) starting the clock on the 1 year plant and irrigation system
guarantee.

HOUSING
Construction is 7 and 10 gauge mild steel, rated for +/-20" W.G. Hopper is 12
gauge, 600 sloped, pyramid type, one per module, one total. Bottom
discharge is an 18" square flanged opening.
DUST LADEN AIR INLET
The collector's high inlet creates a general downward air flow pattern in the
filter section to optimize the filter performance. Top and front inlet locations are
standard on each module. Each filter column is protected from direct dust
impingement by an internal baffle plate.
DUST DISCHARGE
Hopper discharge complete with gate and insert section to increase dirty-air
plenum capacity.
FINISH
Mild steel assemblies are painted with an exterior color of blue. Interior is
primed with blue.

DIRECT DRIVE FAN
Direct drive fan field mounts to the top/side of the collector. Fan motor is
20 HP 3450 rpm 208/230/460/60/3 TEFC. Fan housing and wheel are
constructed of mild steel. Includes exhaust silencer.
EXPLOSION RELIEF VENTS
Quantity (1) 2311 x 24" explosion relief vent with weather cover located on the
top/side of unit. Explosion vents do not prevent explosions; they are only a
means of limiting overpresssure in the event of a deflagration to maintain the
structural integrity of the collector.
ULTRA-TEKTM FILTERS
Each cartridge contains 121 square feet of media for a total of 1,452 square
feet per module. The media has a filtration efficiency of ~9.99% as measured
using methods defined in ASH RAE report #RP-531. It is 13.8" wide and 26"
long and includes a neoprene gasket which provides an airtight seal to the
tubesheet.
FILTER CLEANING
Each module is shipped with factory assembled cleaning system. Cartridges
are automatically cleaned by pulses of compressed air. Cleaning is controlled
by a factory preset, solid state timer.
Photohelic@ pressure gage which initiates compressed air cleaning on a preset
pressure drop. Photohelic@ is a registered trademark of the Dwyer
Corporation.
FILTER ACCESS
Filter cartridges are accessed from outside the collector through round access
ports on the front of the unit. Each port provides access to two filter
cartridges. No tools are required for filter removal/installation. Filters are
angled 15 degrees for easier servicing.
REQUIRED SERVICES
The collector requires 90 to 100 PSIG, clean, dry compressed air based on a
10 second pulse interval. Timer requires 110 VAC.

THIS INDENTURE between the City of Prior Lake, a municipal corporation,
organized pursuant to the laws of Minnesota (the "Grantor"), and Guy J. Selinske and
Mary K. Selmske, husband and wife as joint tenants, an undivided one-half mterest, and
Metro Cabinets Company, Inc., a Minnesota corporation, an undivided one-half interest
(collectively the "Grantee ");
WITNESSETH, that Grantor in consideration of the sum of Eleven Thousand Seven
Hundred Four and 21/100ths ($11,704.21) Dollars to be paid upon closing, and other good
and valuable consideration, the receipt whereof is hereby acknowledged, does hereby grant,
bargain, convey and warrant to the Grantee, their successors and assigns forever, all the tract
or parcel of land lying and being in the County of Scott and State of Minnesota described on
Attachment A attached hereto (such tract or parcel of land is hereinafter referred to as the
"Property") :
To have and to hold the same, together with the hereditaments and appurtenances
thereunto belonging or in anywise appertaining to the said Grantee, their successors and
assigns, forever, provided as follows:
1. It is understood and agreed that this Deed is subject to the covenants,
conditions. restrictions, and provisions of an agreement entered into between the Grantor and
Guy J. and Mary K. Selinske dated October 3, 1994, and consented to by Metro Cabinets
Company, Inc. on August 2, 1995, entitled "Development Agreement" (hereafter referred to
as the "Agreement"), and that the Grantee shall not voluntarily convey this property, or any
pan thereof, without the consent of the Grantor until a certificate of completion releasing me
Grantee from certain obligations of said Agreement as to this Property or such part thereof
then to be conveyed, has been placed of record. This provision shall in no way prevent the
Grantee from making transfers permitted by the Agreement or mortgaging this Propeny in
order to obtain funds for the purchase of the Property hereby conveyed and for erecting
improvements thereon in conformity with the Agreement, any applicable redevelopment plan
and applicable provisions of the zoning ordinances of the City of Prior Lake, Minnesota-
Promptly after completion of the improvements in accordance with the
provisions of the Agreement, the Grantor will furnish the Grantee with a Certificate of
Completion in the form attached to this Deed as Attachment B. Such certification by the
Grantor shall be (and the certification itself shall so state) a conclusive determination of
satisfaction and termination of me agreements and covenants of the Agreement and of this
Deed with respect to the obligation of the Grantee, and their successors and assigns, to
comtcuct in:.provements and the dates for the beginning and completion thereof, it being the

all restrictions and reservations of title contained in Sections 1 and 2 of this Deed be forever

All certifications provided for herein shall be in such form as wIll enable them
to be recorded with the County Recorder of Scott County, Minnesota- If the Gramor shall
refuse or fail to provide any such certification in accordance with the provisions of the
Agreement and this Deed, the Grantor shall, within ten (10) days after written request by the
Grantee, provide the Grantee with a written statement indicating in adequate detail in whAt
respects the Grantee has failed to complete the improvements in accordance with {he
provisions of the Agreement or is otherwise in default, and what measures or acts will be
necessary, in the opinion of the Grantor, for the Grantee to take or perform in order to
obtain such certitlcation.
2. In the event that an Event of Default occurs under Section 4.1 of the
Agreement and the Grantee herein shall fail to cure such default within the period and in the
manner stated in Section 4.2 of the Agreement, then the Grantor shall have the right to
re-enter and take possession of the Property and to terminate and reinvest in the Grantor the
estate conveyed by this Deed to the Grantee, their assigns or successors in imerest, in
accordance with the terms of the Agreement.

CERTIFICAtE OF COMPLETION AND RELEASE OF FORFEITURE
WHEREAS, the City of Prior Lake, Minnesota (the "Grantor"), a municipal
corporation organized and operating pursuant to laws of the State of MiIUlesota, by a Deed
recorded in the Office of the County Recorder or the Registrar of Titles in and for the
County of Scott and State of Minnesota, as Deed Document No. , has
conveyed to Guy J. Selinske, Mary K. Selinske and Metro Cabinets Company, Inc.
(collectively the "Grantee") in the State of Minnesota, the following legally described
property, to wit:

County, Minnesota described as follows:
Commencing at the northeasterly comer of said Lot 1, Block 1; thence North
62 degrees 52 minutes 03 seconds West (record bearing) along the
northeasterly line of said Lot 1, Block 1, a distance of 878.82 feet to the point
of beginning of the land to be described; thence continuing North 62 degrees

the breach of which by the Grantee, its successors and assigns, would result in a forfeiture
and right of re-enrry by the Grantor, its successors and assigns, said covenants and
restrictions being set forth in said Deed and in a Development Agreement executed by and
between the Gramor and Guy J. Selinske and Mary K. Selinske and dated October 3, 1994,
and consented to by Metro Cabinets Company, Inc. by a Consent Agreement dated August 2,
1995 (the "Development Agreement"); and

WHEREAS, the Grantee has to the present date performed said covenants and
conditions insofar as it is able in a manner deemed sufficient by the Grantor to permit the
execution and recording of this certification:
NO\V, THEREFORE, this is to cenify that all building construction and other
physical improvements specified to be done md made by the Grantee have been completed
and the above covenants and conditions in said Deed and Development Agreement have been
performed by the Grantee therein and that the provisions for forfeiture of title and right to
re-entry for breach of condition subsequent by the Grantor contained therein, are hereby
released absolutely and forever insofar as they apply to the land described herein, and the
County Recorder or the Registrar of Titles in and for the County of Scott and State of
Minnesota is hereby authorized to accept for recording and to record the filing of this
instrument, to be a conclusive determination of the satisfactory termination of the covenants
and conditions of said Deed and the Development Agreement which would result in a
forfeiture by the Grantee, its successors and assigns, the right of the Grantor, its successors
and assigns, to re-enter and take possession of the property as set forth in said Deed and the
Development Agreement, and that said Deed and the Development Agreement shall
othef'\Vise remain in full force and effect.

PLAN REVIEW NOTES
METRO CABINETS & AMERICAN GLASS
1. Separate permits and plan review required for plumbing, heating, sewer and water,
electrical and fire suppression systems.
2. Provide engineering for wall and roof structural panels.
3. Gates on the trash enclosure shall be offset to a minimum of 30" and must be
structured in such a way as to block the view of the interior of the enclosing
structure when viewed from the outside. Gates on the trash enclosure shall have
locking devices to lock the gates in the open and closed position. Trash enclosures
shall be constructed so as to conceal trash containers and shall have concrete
floors and aprons.
