Historv The Planning Commission conducted a public hearing on this request on February 22, 2010 (minutes attached). The Planning Commission recommended approval of this preliminary plat subject to the following conditions: 1. A Wetland Replacement Plan application, along with a wetland delineation report, must be submitted to the City for review and permitting prior to any grading on this site. The plan must be consistent with the requirements of the Subdivision Ordinance. 2. The comments in the City Engineer's memorandum, dated March 7, 2006, must be addressed with the final plans. All utilities and roads must be constructed in conformance with the Public Works Design Manual. 3. Provide a copy of the approved Watershed District permit for this site prior to any grading. 4. Provide a revised reforestation plan demonstrating how tree replacement requirements will be met. 5. Provide a revised landscaping plan that provides at least two front yard trees per lot and at least two trees per frontage on corner lots. Current Circumstances The proposal calls for a single-family development consisting of 5 single-family residential lots and an outlot on 28.86 (net) acres. Total Site Area: The total site area consists of 29.69 (gross) acres. Veaetation: There are several stands of significant trees on this site, particularly in the northern portion of the project. The project is subject to the Tree Preservation requirements of the Zoning Ordinance. Wetlands: The project site contains 36,361 sq ft of wetland. The wetland will be protected by a conservation easement. Access: Access to the site is from Sunray Boulevard, originating at Trunk Highway 13, north of the site, through the Maple Glen 1 st/2nd Addition developments and future access to Outlot A will be from 180th Street to the south. 2030 ComDrehensive Plan Desianation: This property is designated for Low to Medium Density Residential uses on the 2030 Comprehensive Plan Land Use Map. Zonina:, The site presently is in the R-1 Zoning District (Low Density Residential). The R-1 district is consistent with the proposed R-LD designation. This district permits a maximum density of 4.0 units per acre. The density (net) for the proposed plat is 1.3 units per acre. PROPOSED PLAN Lots: The preliminary plat consists of 5 lots for single family dwellings and one outlot. The lots range in size from 13,362 square feet to 94,449 square feet (existing dwelling site). The minimum lot area and lot width in the R-1 district is 12,000 sq. ft. and 86 ft at the front building line. Streets: This plan does not propose any street improvements at this time. The proposed lots have current access from existing streets (Sunray Court and Wedgewood Lane). The plat does include the dedication of public right-of-way for the extension of Sunray Boulevard to the south past the platted lots. Parks: Section 1004.1000 of the Subdivision Ordinance requires 10% of the net area of the site for parkland dedication. The net area for the project is 28.86 acres, which would require 2.89 acre park. The site benefits from an adjacent 4.9 acre park located to the north in Maple Glen 1st and 2nd Additions. The developer will be required to make a cash dedication in lieu of land. Sanitary SewerlWater Mains: Sanitary sewer and water mains are currently in place along Sunray Court for Lot 1-4 of Block 2. The Development Contract will contain language specifying that sanitary sewer and water service will be extended to Lot 1, Block 1 when the Outlot A is developed. 2 ISSUES: FINANCIAL IMPACT: AL TERNATIVES: RECOMMENDED MOTION: Setbacks: In the R-1 Use District, the minimum front and rear yard setbacks are 25 feet. Side yard setbacks are required to be a minimum of 10 feet. The proposed setbacks will meet or exceed the R-1 requirements. LandscaDina: The Subdivision Ordinance requires two front yard subdivision trees per lot. Corner lots require at least four trees. This plat requires a total of 10 subdivision trees. Tree ReDlacement: The applicant has submitted an inventory identifying 2,445 caliper inches of significant trees on the proposed phase site. The Zoning Ordinance allows up to 35% of the significant caliper inches to be removed. The number of significant inches removed over and above these percentages must be replaced at a rate of a 1/2 caliper inch for each inch removed. This plan proposes to remove 33.95% of the caliper inches. The tree inventory will need to be revised in the future to confirm which trees will be impacted by grading of the future phase. Fees and Assessments: This development will be subject to the standard development fees at final plat including park dedication, trunk street and utility service charges, and utility connection charges. The applicant proposes to subdivide the property to allow 5single family dwellings. All of the proposed lots conform to the R-1 minimum requirements and will not exceed 3.6 units per acre in density. There is no budget impact as a result of this action. Approval of the project will facilitate the development of the area and increase the City tax base. The City Council has three alternatives for action on the application: 1. Adopt a resolution approving the Preliminary Plat for this development subject to the listed conditions, with the finding that the preliminary plat is consistent with the intent and purpose of the Zoning and Subdivision Ordinances. 2. Deny the Preliminary Plat on the basis that it is inconsistent with the purpose and intent of the Zoning and Subdivision Ordinances and/or the Comprehensive Plan. In this case, the Council should direct the staff to prepare a resolution with findings of fact based in the record for the denial of these requests. 3.
