AMENDMENT TO A PLANNED UNIT DEVELOPMENT PLAN FOR
SHEPHERD'S PATH
DISCUSSION:
Introduction
Shepherd of the Lake Lutheran Church has applied for approval of a minor
amendment to the Planned Unit Development (PUD) known as Shepherd's
Path on the property located north of CSAH 42, south of North Berens Road,
and in the vicinity of McKenna Road and Shepherds Path.
Historv
In 2006, the City Council approved a PUD for the approximately 80 acre
Shepherd's Path mixed use development. The first phase of the development
has been constructed and includes the following:
Town Center: The 30,000 sq. ft. two (2) story building containing the
following:
. Chapel. A 50-seat chapel.
. Community Room. Space adjoining the chapel and
offering an additional space up to 100 people.
. Library and Resource Room.
. Convenience Center. The market area provides a
limited grocery area, pharmacy, banking, and other general
convenience options for campus consumers.
. Beauty/Barber Shop.
. Lounge.
. Fitness Center. A fitness center offering equipment and
services specializing in the medical needs of seniors.
. Technology Center. A space containing computers and
support services.
. Cafe.
Residential Units/Parkina:.
. A four (4) level building containing underground parking,
assisted living, and memory care.
. A four (4) level building containing underground parking
and independent living units.

Safe Haven Youth Center:
. Office/Activity Space. To provide support services,
counseling, life skills training, and recreational options.
. Residential Living. Space for (5) efficiency apartments
and a lounge area. The efficiency apartment units are
targeted to at-risk individuals ranging in age from 15-21.
The apartments have supportive services provided.
In addition, in 2008, the City Council approved a PUD Amendment to the
Shepherd's Path PUD allowing for a 50,000 square foot YMCA Facility, which
has been constructed.
The current PUD Amendment involves a request to modify the campus
monument sign that was previously approved at the time of Shepherds Path
PUD approval. The sign is proposed to be located at the northeast
intersection of Co Rd 42 and McKenna Road (within Outlot A). All entities
(YMCA, McKenna Crossing, Safe Haven for Youth, and Shepherds of the Lake
Lutheran Church) that currently make up the Shepherds Path Campus have
signed a letter of consent.
ISSUES:
Typically, when signage is proposed to be modified for a development, it must
merely adhere to the Sign Ordinance requirements as detailed in Section
1107.500 of the City Code. However, in cases where the signage is part of a
PUD and has been specifically approved and detailed on the approved plans
and in the development contract, as was the case with the monument sign at
issue, a request for a minor amendment to the approved PUD Plan is
necessary.
The applicant is requesting a minor amendment that would involve enlarging
and reconfiguring the campus monument sign (Exhibit A) that was approved
as part of the original Shepherds Path PUD to instead reflect the proposed
monument sign (Exhibit B). The dimensions of the previously approved and
currently proposed signs are as follows:

Section 1106.711 of the City Code allows for minor amendments when they
have a minimal impact on the overall character of the approved Final PUD
Plan. In the case of the proposed sign, it will contain many of the same
thematic elements as the previously approved sign (natural stone).The sign will
be placed in the same location as originally proposed. It does not constitute a
sight obstruction in any way. For that reason, Staff believes that granting the
minor amendment would not impact the overall character of the Final PUD
Plan.
If the minor amendment is approved, the first phase of the sign will include the
column portion of the sign that lists the campus tenants. As additional future

housing is constructed, and revenues captured, the second phase will allow for
the remaining portion of the sign to be constructed.
The City Council must review the proposed minor amendment to the PUD plan
and determine whether the amendment is consistent with the purpose of the
PUD.
FINANCIAL
IMPACT:
Approval of this minor amendment would improve visibility for campus tenants,
thus assisting in creating awareness of opportunities on the campus, and
possibly encourage future construction on the existing vacant campus land,
which will contribute to the City's tax base.
ALTERNATIVES:
The City Council has the following alternatives:
1. Adopt the resolution with conditions approving the Minor PUD Amendment
for Shepherd's Path.
2. Deny the resolution approving Minor PUD Amendment.
3. Defer this item and provide staff with specific direction.
Staff recommends Alternative #1 with the following conditions:
1. The sign shall be located in the previously approved location within Outlot
A of the Shepherds Path Plat.
2. The sign shall be located so that all sight lines are preserved once the final
sign is constructed.
3. A sign and building permit shall be applied for and issued prior to sign
construction.
4. Prior to sign and building permit issuance, the resolution of approval and
Exhibit B shall be recorded at Scott County.
RECOMMENDED
MOTION:
A motion and second to adopt a resolution approving the minor amendment to
the PUD Plan for Shepherd's Path subject to the listed conditions. (A minor
amendment requires only a majority vote of the City Council).

A RESOLUTION TO APPROVE A MINOR AMENDMENT TO THE PLANNED UNIT DEVELOPMENT
PLAN KNOWN AS SHEPHERD'S PATH

WHEREAS, Shepherd of the Lake Lutheran Church has submitted an application for a minor
amendment to its Planned Unit Development known as Shepherd's Path; and
WHEREAS, The Prior Lake City Council approved the Shepherds Path PUD on June 26, 2006; and
WHEREAS, The Prior Lake City Council approved a Major Amendment to the Shepherds Path PUD
on April 7,2008, allowing an enlarged and reconfigured YMCA facility; and
WHEREAS, All entities that make up the Shepherds Path Campus as of April 5, 2010 have
consented in writing to the proposed modified sign plan (Shepherds Path, YMCA, Safe
Haven for Youth and Mckenna Crossing); and
WHEREAS, The Prior Lake City Council considered the proposed amendment to the Shepherds
Path PUD Plan on April 5, 2010; and
WHEREAS, The City Council finds the proposed PUD amendment is compatible with the stated
purposes and intent of the Section 1106 Planned Unit Developments of the Zoning
Ordinance.
NOW THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF PRIOR LAKE,
MINNESOTA as follows:
1. The Recitals set forth above are incorporated herein.
2. The amended Planned Unit Development Plan is hereby approved subject to the following
conditions:
. The sign shall be located in the previously approved location within Outlot A of the Shepherds
Path Plat.
. The sign shall be located so that all sight lines are preserved once the final sign is constructed.
. A sign and building permit shall be applied for and issued prior to sign construction.
. Prior to sign and building permit issuance, the resolution of approval and Exhibit B shall be
recorded at Scott County.
