(clear water discharge into the municipal sanitary sewer system)
Ralph,
Attached is a copy of the application and the City Council Resolution granting the variance for the
above-referenced property. The variance was granted based on the fact that the property's lower
level is below the OHWL of Lower Prior Lake and sump pump discharge cannot flow away from the
house during the winter season. The sump pump discharges to the lake during the summer months.
The variance was granted in July 2001, although the application was not received until August 2004.
The annual charge associated with the variance is based on a 120-day clear water discharge of 100
gallons per day into the City's system at the City's adopted sewer billing rate. Please see that this
charge is included on future water bills for the property. A City representative from Public Works
Utilities will inspect the property as required each spring.

CRITERIA FOR PERMIT
Dangerous condition such as ice buildup or flooding on either public or private property ~

understand this application is not a permit and that no clear water discharge into the municipal sanitary sewer
system is allowable without a permit.

A permit is issued for winter discharge of clear water into the sanitary sewer for the above application. Any
conditions/charges are indicated on the application. This connection can be made no earlier than November 15 and
must be removed by March 15. Faiture to remove and properly seal the connection will result in a sewer bill
surcharge of $100 per month after March 15. The City will inspect the property after March 15.
This permit is issued in accordance with Prior Lake City Code, 5ection 705.

WHEREAS,
on December 7, 1998, the City Council appraved Ordinance 98-18 amending
Section 705 (previously Title 9, Chapter 5) of the City Code concerning discharges
into the sanitary sewer system; and
WHEREAS, the property located at 15305 Breezy Point Road SE is situated such that during
the winter season the sump pump discharge cannot flow away from the house;
therefore, it must discharge clear water from the sump pump to the City's sanitary
sewer system; and
WHEREAS, the property located at 15305 Breezy Point Road SE can discharge clear water
from the sump pump to the lake during the summer season; and
WHEREAS, during the winter season, the property located at 15305 Breezy Point Road SE is
not in compliance with Section 705 of the City Code, concerning discharges into
the City's sanitary sewer system.
NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF PRIOR LAKE:
1. The above recitals are incorporated herein.
2. The City Council grants a variance to Section 705 of the Ciry Code to the property located at
95305 Breezy Point Road SE, allowing the discharge of clear water into the City's sanitary sewer
system during the winter season (November 95`~ through March 15t°).
3. An annual fes of $34.20 wifl be billed to the residence at 15305 Breezy Point Road SE for
treatment of the clear water. (This amount is based on a 120-day clear water discharge af 100
gallans per day inta the City's system at $2.85 per 10p0 gaAons per the City's adopted sewer
billing rate.)

Dear Ms. Schweich:
On 7uly 16, 2001, Prior Lake City Council passed and adopted a resolution granting a variance to
Section 705 of the City Code for your property. I have enclosed a copy of the approved variance
application for your records. This will allow you to discharge clear water from your sump pump
into the City's sanitary sewer system during the winter season (November 15 through March 15).
This variance will result in an annual charge added to your water bill, based on the City's adopted
sewer billing rate. The 2005 charge of $43.80 will appear on your December ls` bill. This is
based on a 120-day clear water discharge of 100 gallons per day at the City's current sewer
billing rate of $3.65 per 1000 gallons. There is no increase anticipated for 2006; however, this
rate is subject to change without notice. This charge will appear during the first billing period
beginning in 2006 and every year thereafter.
Also note, as stated on the variance application, your home will be inspected each spring to
ensure that your sump pump has been disconnected from the City's sanitary sewer system. The
City will contact you each year to make arrangements for this inspection.

Dear Mr. Schweich:

Dear Mr. Schweich:
In 1998, the City iiegan inspecting properties as part of the above referenced projec~ to ensure that
all residences were ~n compliance with the City Code. The City's ordinance proh~bits discharge
of storm water into,~the City's sanitary sewer system. It was discovered that your property has a
sump pump that di~charges into the sanitary sewer. It is our understanding that l~ecause of the
property's unique circumstances it is not possible for the sump pump to dischai-ge elsewhere
during the winter months. However, the sump pump can discharge into the lake during the
summer season. -
We are currently finalizing the details of the Cross-Connection Reduction Progr'am. As your
properiy cannot b~ in compliance with the City Code during the winter months,:' a variance to
Section 705 of the City Code is required and is on the July 16`'' City Council Agenda. I have
enclosed the application form for you to fill out and return. This variance would require a
connection that a(lows the sump pump to discharge into the lake in the summer season, and into
the sanitary sewer: in the winter season.

SUB3ECT: Cy Schweich Sump Pump Problem

About a year ago I visited Cy's house with Greg Ilke to discuss the unique problem tha.t
Cy has in attempting to comply with our sump program. Crreg agreed that it was a unique
problem and probably required a unique solution. Greg also indicated that the City
wauld get back to Cy with a recommended solution. It was also agreed that Cy would
not be found in violation in the meantime.
More recently, Cy called to inform me that he had not heard back from the City, but had
received a written notice that he was in violation, and would be charged a penalty.
Consequently I called you and suggested that he be sent a note stating that the penalty
would not apply, and also asking for the Staffto meet with him to resolve the issue. I
understood you to agree that tlus made sense.
A few days ago, Cy called me again to ad.vise that an inspector had just visited to
determine if he was now in compliance. He also said that he still had received nothing
from the City in terms of a suggestion of how to deal with the problem, and had not
received any sort of communication relieving him of the pena.lty.
Simply stated, the lower level of his house is situa.ted below the lake OHWL so he has to
pump water from his sump in the winter. Where to pump it is the dilemma.
Would you please have someone follow up on this ASAP. I would be glad to brief
anyone on the }ustory if helpfuL Also I would appreciate being advised. of what we're
going to do.
