CONSIDER APPROVAL OF A RESOLUTION APPROVING THE
WETLAND REPLACEMENT PLAN FOR MYSTIC LAKE GOLF
COURSE, CITY PROJECT #03-44
DISCUSSION:
Historv
On January 18, 1994, the City Council passed Resolution 94-01
adopting the permanent rules of the Wetland Conservation Act
(WCA) of 1991. Along with this, the Council also assumed the role
of local government unit (LGU) for making WCA determinations for
landowners. The purpose of WCA is as follows:
1, Achieve a no net loss in the quantity, quality, and biological
diversity of Minnesota's existing wetlands;
2. Increase the quantity, quality, and biological diversity of
Minnesota's wetlands by restoring or enhancing diminished
or drained wetlands;
3. Avoid direct or indirect impacts from activities that destroy or
diminish the quantity, quality, and biological diversity of
wetlands; and
4. Replace wetland values where avoidance of activity is not
feasible or prudent.
Current Circumstances
As part of the Mystic Lake Golf Course conditional use permit, the
SMSC (Shakopee Mdewakanton Sioux Community) has requested
approval of a wetland replacement plan for the project. The reason
a replacement plan is required is that to reshape, fill, and/or move
existing water hazards and wet fairways, These water hazards and
wetland fairways have steep slopes, minimal vegetation, or are
maintained fairway areas. As such these areas provide minimal
wetland function and value.
The final design calls for 6.8 acres of existing wetland impacts.
Mitigation is proposed through the following combination:
. 1.45 acres of new wetland credit (NWC) from a wetland
banking site that is held by the SMSC and is within the same
major watershed as required by WCA.
. 5.35 acres of NWC from an off-site restoration that is
located within the same major watershed.

. 4.46 acres of on-site Public Value Credit from the creation of
water hazards. Storm water will not be directed to these
water hazards,
Attached is a memorandum from Andi Moffatt of WSB & Assoc.
who has been acting as the City's representative on wetland issues.
Issues
At the time the attached memo was prepared there were still some
outstanding issues to be addressed based on staff's review of the
golf course grading plan. Revised plans were received on
September 30th and all comments have been addressed. No
comments from outside agencies were received during the 30-day
comment period.
Conclusion
1. Staff recommends that the Council approve the Wetland
Replacement Plan for Mystic Lake Golf Course.
ALTERNATIVES:
The alternatives are as follows:
1. Adopt the attached resolution that approves the Wetland
Replacement plan for Mystic Lake Golf Course (City Project
#03-44).
2. Deny this item for a specific reason and provide staff with
direction.
3. Table this item for specific reason.

WHEREAS,
the Shakopee Mdewakanton Sioux Community (SMSC) has prepared plans that
avoid unnecessary wetland filling on the project to the greatest extent possible;
and
WHEREAS,
sequencing criteria has been met; and
WHEREAS,
mitigation is proposed through the following combination: 1.45 acres of new
wetland credit from a wetland banking site, 5,35 acres of new wetland credit from
an off-site restoration, 4.46 acres of on-site public value credit from the creation
of water hazards.
WHEREAS,
the mitigation plan is in accordance with the Wetland Conservation Act and City
of Prior Lake ordinances,
NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF PRIOR LAKE, that
1, The recitals set forth above are incorporated herein,
2, The Wetland Replacement Plan for Mystic Lake Golf Course is hereby approved.

As requested, we have reviewed the Mystic Lake Golfplans and Wetland Replacement Application
dated August 8, 2003, Our review covered the areas ofthe Golf Course within the Fee Land. The
portion of the project that is on the Trust Land was not reviewed as local and State rules do not
apply to this area, Based on the review, we offer the following comments:
Wetland Conservation Act Review
Attached, please find the draft Notice of Wetland Conservation Act Decision and Wetland
Conservation Act Determination Findings and Conclusions for the Mystic Lake Golf Course project
for City Council consideration at their upcoming meeting, Outlined below, please find our review
and summary of the Wetland Replacement Plan:
1. The Wetland Replacement Plan application was received from the applicant on August 8,
2003, The application was initially determined to be incomplete with the additional
information required being provided on August 26, 2003, The application was submitted for
a 30-day agency comment period, The 30-day comment period ended on September 29,
2003, The wetland delineation was field checked by WSB in May 2002,
2. The Mystic Lake Golf Course project includes a total of6,8 acres of wetland impact, Of this
amount, 3.43 acres of wetland impact is subject to the Wetland Conservation Act.
3. This impact is primarily in the form of reshaping, filling, and/or moving existing water
hazards and wet fairways, Theses water hazard and wetland fairways have steep slopes,
minimal vegetation, or are maintained fairways areas, As such, these areas provide minimal
wetland function and value,
4. Mitigation is proposed through the following combination:
. 1.45 acres ofNWC from a wetland banking site, This is Bank Account #1090 that is
held by the Mdewakanton Sioux Community.
. 5,35- acres ofNWC from an off-site restoration
. 4.46 acres of on-site Public Value Credit from the creation of water hazards,
Stormwater will not be directed to these water hazards.

5. Both the wetland impact, banking site, and off-site restoration are within the Minnesota
River-Shakopee (#33) major watershed, The Wetland Conservation Act (WCA) requires
that wetland replacement be on-site if possible. If this is not possible, the replacement site
needs to be in the same major watershed as the impacted wetland, Some on-site
replacement is proposed for this project, The remaining mitigation is within the same
watershed as the impacted site (Minnesota River-Shakopee),\
We recommend that the Replacement Plan Application be approved. The attached documents have
been provided to you for review as part of the Mystic Lake Golf Course review and approval. Once
the Council has approved the wetland replacement plan, these documents will be sent to the
appropriate agencies for their information and processing.

These comments were included in WSB's August 27,2003 memo, It is our understanding that
these comments remain to be addressed,
1, Please indicate Riprap quantities for all storm sewer outfalls per MnDOT plate 3133,
2, Please indicate on the plan that the last 3 joints of all storm sewer pipes shall be tied.
3, Please include a detail of the sluice gate located in the north-west comer of pond GC20,
4, Please verify the information in Item 6 of the Pond Outlet Structures table detail on sheet
3,09,
5, The storm sewer from structure 12 to structure 10 should be rerouted through the regional
treatment basin. This area is outside of the city's jurisdiction but because of the areas
proximity to the Eagle Creek Sub Station the water should be treated prior to discharging
into the protected wetland, This issue has been discussed with the project engineer and it is
anticipated that this will be changed on the next plan.
6. The emergency overflow from pond GC12 should be illustrated on the plan, This issue has
been discussed with the project engineer and it is anticipated that this will be changed on the
next plan,

The wetland replacement plan for the above referenced project was approved by the Prior Lake City
Council on based on the fmdings and conclusions outlined below,

greatest extent reasonable based on site constraints within the project area, For those impacts that could
not be avoided, the proposed wetland replacement plan includes the following impact and mitigation

project is both on Fee Land and Trust Land, This document only provides review of
the impacts and mitigation for the Fee Land,
3, This site is approximately 1 mile east of project within Subwatershed 33,
4. Storm water will not be directed to the water hazards,
Based on these findings, the submitted application is approved, The wetland replacement plan has been
determined to offset the wetland impacts and fully complies with the Wetland Conservation Act,
