CONSIDER APPROVAL OF A RESOLUTION TO RECEIVE AND
REJECT ALL BIDS FOR THE ERIE AVENUE AND EAGLE
CREEK AVENUE RAIN GARDENS (CITY PROJECT #02-08).
DISCUSSION:
HISTORY
Rainwater gardens are proposed in the downtown area to take the
place of traditional storm water ponds. The City received a
$75,000 grant from the Metropolitan Council to support this
experimental project. The gardens will utilize less space and can
be landscaped to blend in with downtown amenities. The gardens
are required in order for additional development to occur
downtown,
On September 15, 2003, the City Council approved Resolution 03-
158 approving plans and specifications and authorizing
advertisement for bids for the Downtown Rainwater Gardens that
are proposed along Eagle Creek Avenue south of City Hall and
along Erie Avenue west of Lakefront Plaza. The Rotary garden
which is proposed in conjunction with the Erie Avenue garden,
was bid as an alternate,
CURRENT CIRCUMSTANCES
Bids were received and opened on September 30, 2003, Two
bidders submitted bids. The bids have been checked and
tabulated. The low bid was submitted by Giles Brothers
Contracting in the amount of $126,926.30 for the base bid and
$12,170,00 for the alternate (Rotary Garden), This was
significantly higher than the engineer's estimate of $74,300 for the
Erie and Eagle Creek gardens and $10,550 for the Rotary garden.
As a result, staff is recommending to reject all bids for this project.
Staff proposes to re-bid this project in conjunction with the Main
Avenue and Dakota Street reconstruction project that is scheduled
for 2004. We will ask the Metropolitan Council to extend the grant
period, We do not anticipate that there will be any opposition to the
extension.
FINANCIAL IMPACT:
There is no fiscal impact resulting from this item.

ALTERNATIVES:
There are three alternatives for the City Council to consider:
1. Approve a resolution to receive and reject all bids for the
Downtown Rainwater Gardens, City Project #02-08.
2, Deny this item for a specific reason and provide staff with
direction.
3. Table this item until some date in the future.
RECOMMENDED
MOTION:
Staff recommends adoption of Alternative NO.1.

The City of Prior Lake wants to improve the quality of downtown runoff water
as part of the redevelopment of the downtown area and is proposing to construct
rainwater gardens at Erie Avenue and Eagle Creek Boulevard; and
Pursuant to an advertisement for bids for the Downtown Rainwater Garden
project, City Project No. 02-08; and
The following bids complying with the advertisement were received, opened,
and tabulated according to law:

The City Council has determined that bids received for the Downtown
Rainwater Garden Project were significantly higher than the engineer's estimate
and have determined that it is in the best interest of the City to reject all bids.
NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF PRIOR LAKE,
MINNESOTA that:
I. The recitals set forth above are incorporated herein,
2, The Mayor and City Manager are hereby authorized to receive and
reject all bids for the Downtown Rainwater Garden Project.
3. The City Manager is hereby authorized and directed to return to all
bidders the deposits made with their bid.
4. The City Council authorizes City staff to re-bid the project in
conjunction with the Main Avenue and Dakota Street Reconstruction
Proj ect.
Passed and adopted this 6th day of October, 2003.
