AGENDA ITEM: SPECIAL ASSESSMENT PUBLIC HEARING FOR THE 2010
IMPROVEMENT PROJECT FOR COUNTY ROAD 12, AND CONSIDER
APPROVAL OF A RESOLUTION ADOPTING THE ASSESSMENT ROLL
FOR THE PROJECT.
DISCUSSION: Introduction
This agenda item is to conduct the special assessment hearing and to
adopt the assessment roll for the County Road 12 Improvement project.

The 2010 Reconstruction of County Road 12, Project #10-011 is included
in the 2010 Capital Improvement Program and has received numerous City
Council approvals to date.
At the January 19, 2010 City Council meeting, the City held the Public
Hearing for the improvements. Since the Public Hearing, the County has
collected bids on January 26, 2010 and awarded a contract on February 3,
2010 to Chard Tiling and Excavating for the County Road 12 project.
The project area considered in the report includes portions of Butternut
Beach, Sunset Shore, Spring Lake Townsite, Auditor's Subd #12, and
Christies 1St Addition. A map of the project area (Exhibit 1) is included in
the Feasibility Report and includes County Road 12 (Spring Lake Road)
from Walnut Ave to 900 feet west of Howard Lake Road. The proposed
improvements include street reconstruction, storm sewer, storm water
quality improvements, concrete curb and gutter, and appurtenant work.
City utilities under the street are also proposed to be repaired or
reconstructed based on need. Selected sections of sanitary sewer are
proposed for replacement. Watermain is proposed to be replaced for
certain street segments. The design, bidding, and construction for this
project will be coordinated by the Scott County Highway Department.
The Assessment Review Committee met on January 12, 2010 and March
26, 2010 to review the project, assessment method, and the proposed
assessments. While the project scope and assessment method remain the
same, the proposed assessments have been adjusted based on the bid
and revised costs.
At its regular meeting of April 19, 2010, the Council approved Resolution
10-035, which declared the cost to be assessed, ordered the preparation of
the assessment roll and established the date of the Assessment Hearing as
May 17, 2010 for the County Road 12 Improvement Project.

Current Circumstances
All benefiting property owners have been mailed a Statement of Special
Assessments, which included information pertinent to their property such as
the total proposed assessment amount and the assessment rate. The
Notice of the Special Assessment Hearing was published in the newspaper
on April 24, May 1, and May 8, 2010.
By statute, the City may only assess a property up to the amount the
property is specially benefited by the public improvement. Special benefit is
defined as the difference between fair market value before and after the
project. The Property owners who believe that the proposed assessment
exceeds the special benefit have a right to appeal their assessments, first
to the City Council and then, if necessary, to District Court. In order to
perfect their right to appeal their assessment to District Court, a property
owner must submit their written and signed objections to the proposed
assessment to the City Manager prior to the Assessment Hearing or
present it to the City Council at the Assessment Hearing tonight. Within 30
days of the Assessment Hearing, the property owner must also file the
appeal in District Court. No appeals were received at the time this report
was prepared. We have apprised each of the property owners of our
Deferred Assessment Program.
Conclusion
The Council should open the Assessment Hearing at the time set forth in
the notice, or as soon thereafter as possible, receive public input and then
close the Assessment Hearing. If certain issues need additional study,
those issues may be referred to the Assessment Review Committee for
evaluation and recommendation; otherwise, it would be appropriate to
approve the attached resolution. Statute requires that special assessments
be certified to the County by November 30. Since property owners must be
allowed 30 days to pay off their assessments interest-free, the assessment
roll must be adopted prior to November 1, 2010.
ISSUES: Streef and Storm Sewer Reconstruction
Pursuant to the Assessment Policy, the street and storm sewer
reconstruction should be assessed at up to 40% of the total project cost
against the benefiting properties. The remaining amounts should be
recovered through the general ad valorem property tax.
Assessment Method and Amount
The Assessment Review Committee recommends the unit method of
assessment for the 2010 Improvement Project due to the fact that the lots
in the project area are of similar size and/or value and therefore receive
similar benefit. The proposed amount to be assessed against the
benefiting properties is $256,165.00. There are 91 benefiting units in the
project area that are being assessed at 40% of the street and storm sewer
improvement costs. Based on the foregoing, the proposed assessment is
$2,815 per unit. This compares with the original assessment estimate of
$3,434 per unit.

The Assessment Review Committee recommends assessing the properties
as shown on the original assessment map.

Creekview Circle
Creekview Circle is a private drive whose only access is off of County Road
12. The four properties off of the gravel drive are proposed to be assessed
one unit each. City staff has met with the property owners who have been
offered upgrades on Creekview Circle and they are not interested. They
do not feel that a full assessment to each property is fair and I expect a
number of them will be present at tonight's hearing. The benefit appraisal
completed on Creekview Circle indicates that the proposed special
assessment meets the benefit test and pursuant to statute should be
assessed.
Minnesota Statute 429 does not give guidance on private drive situations,
rather the statute simply states that the assessment must be less than or
equal to the increased value that is created by completing the
improvements (benefit). The statute goes on to say that the property does
not need to abut the improvements.
Since the assessment is consistent with the Minnesota State Statutes, the
recommendation of the staff and the Assessment Review Committee is to
assess one unit to each property served by Creekview Circle.
FINANCIAL The 2010 Improvement Project is proposed to be financed by special
IMPACT: assessments, tax levy, municipal state aid, water quality fund, sewer and
water fund, Prior Lake Spring Lake Watershed District grant, private
funding, and Scott County funding. Tonight's approval does not approve
any payments to the County for the project. Those costs will be approved
by the City Council after the City is invoiced by the County for actual costs.
The Council approved the issuance of general obligation improvement
bonds on May 3, 2010. Final project reconciliation will be prepared when
the project is completed. The anticipated completion date is Fall 2011.
ALTERNATIVES: The alternatives are as follows:
1. Approve a resolution adopting the assessment roll as submitted or
with amendments.
2. Close the hearing and direct the Special Assessment Review
Committee to examine issues or concerns raised at the hearing and
provide a recommendation for Council action at a future meeting.

A RESOLUTION ADOPTING ASSESSMENTS FOR THE 2010 IMPROVEMENT PROJECT
FOR COUNTY ROAD 12
Motion By: Second By:
WHEREAS, Pursuant to proper notice duly given as required by law, the Council has met
and heard and passed upon all objections to the proposed assessments for the
2010 Improvement Project for County Road 12.
NOW THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF PRIOR LAKE,
MINNESOTA as follows:
1. The recitals set forth above are incorporated herein.
2. The proposed assessment for the 2010 Improvement Project for County Road 12, a copy of
which is attached hereto and made part hereof, is hereby accepted and shall constitute the
special assessment against the lands named therein, and each tract of land therein included
is hereby found to be benefited by the proposed improvement in the amount of the
assessment levied against it.
3. The assessments shall be payable on an equal principal method extending over a period of
ten (10) years for paving. The first installment shall be the annual principal plus interest
calculated from the Public Hearing date to the end of this year plus twelve months of the
next year and shall bear interest at the rate of six (6) percent per annum from the date of
adoption of this assessment resolution. To the first installment shall be added two hundred
twenty-eight (228) days of interest on the entire assessment from the date this resolution is
adopted to December 31, 2010. To each subsequent installment when due shall be added
interest for one year on all unpaid installments.
4. The owner of any property so assessed may, at any time prior to certification of the
assessment to the County Auditor, pay the whole of the assessment on such property, with
interest accrued to the date of the payment, except that no interest will be charged if the
entire assessment is paid within thirty (30) days, and the individual may at any time
thereafter, pay to the City's Finance Director the entire amount of the assessment remaining
unpaid, excepting the installment portion appearing upon the current year's property tax
statement.
5. The Finance Director shall forthwith transmit a certified duplicate of this assessment to the
County Auditor to be extended on the property tax lists of Scott County. Such assessments
shall be collected and paid to the City in same manner as other municipal taxes.
6. The portion of the cost of such improvements to be paid by the City is hereby declared to be
$1,430,033.42, and the portion of the cost to be assessed against benefited property owners
is declared to be $256,165.00.

We are currently residing at 3044; 170th Street $V1/, Prirar Lake MN 55372 and have been billed for a sum
of $2700+ dollars in assessment fees for so called property improvement due to road construction. We
believe this out of pocket expense ~ is not justifiable based on the following.
1. We are losing land due to the road construction.
2. Our entrance/driveway is being rearranged and there is ample out of pocket expense for us.
3. Due tc thQ construction !ess parking space wi!I be available for us thus resulting in value lost for
our house
4. We believe that this construction will not increase the value of our property overall rather in
many ways reduce the price.
5. We were not in agreement with the construction of dual sidewalks and now are being expected
to incur the cost of th4 assessrnerat fee for this project.
We would like the city to provide us the data showing that this would indeed bring our property value
up and reconsider the assessment fees.
