AGENDA ITEM: CONSIDER APPROVAL OF A REPORT REGARDING STONEBRIAR
PARK
DISCUSSION: Introduction
The purpose of this agenda is to update the City Council on the status of
Stonebriar Park and to receive direction with regards to future
improvements.
History
In 2005 the City of Prior Lake completed a Comprehensive Parks Plan that
was utilized as part of the 2030 Comprehensive Plan. This parks plan
identified specific service area criteria for neighborhood park development.
These criteria included up to a half-mile service areas and service density
of 500-1,000 households. These neighborhood parks also targeted
approximately 5 acres for park development. The plan did include a
secondary classification called "Mini Park." These parks were intended to
address limited, isolated or unique recreation opportunities.
On May 21, 2007 the City of Prior Lake approved the Final Plat and
Planned Unit Development (PUD) for Stonebriar located in the southwest
quadrant of CR 12 and TH 13. The PUD approval included dedication of
just over one acre and $35,400 for the purposes of constructing a TH 13
trail "rest stop" and a "Mini Park." The park is to include a play structure for
ages 2-5. This park is meant to supplement the existing Willows Park
which serves as the neighborhood park for this area.
The inclusion of this park was a result of the September 5, 2006 City
Council Concept Review for the project. The City Council directed the
Developer to include atot-lot or small play structure at this trail "rest stop"
location. The City Council was concerned with children younger than 5
years of age crossing CR 12 to access Willows Park as this development
was intended to provide entry level new house construction.
Based on this requirement, public park land and additional funds were
dedicated for construction of the park. Additionally the development was
marketed to the public and the park was included in the marketing and
development plans. Thirty-one of the thirty-three lots have homes
constructed on them to date. Most, if not all, of the owners very likely
assume that this area will be a city park.
The City's current Capital Improvement Plan identifies improvements to this
park including construction of a pergola structure and benches along the
trail in 2010 and the play structure in 2011. The funds for these specific

improvements were provided by the developer are currently preserved in
the Capital Parks Fund.
Current Circumstances
On March 24, 2010 the City received a petition from six Stonebriar families
requesting that the City construct the play structure this year and delay the
pergola construction until next year. The residents noted the need based
on the large number of young children in the development.
The Parks Advisory Committee reviewed the petition at their April 15, 2010
meeting and recommended the City Council consider the request. The
funding for both improvements has been reserved in the Capital Park Fund
and the City required staff labor is approximately the same for the play
structure and pergola. Staff concurs that there is higher demand currently
for the play structure than the pergola.
Conclusion
City Staff recommends the City Council authorize construction of the play
structure at Stonebriar Park in 2010 and the pergola in 2011. Staff will
revise the CIP accordingly.
ISSUES: This park raises some serious policy questions regarding this park. Prior to
proceeding with this park improvement, staff believes it is important for the
city council to evaluate several questions related to construction of this
park:
1) Does the park conform to the City's Comprehensive Park Plan?
The existing Willows Park meets the City's Comprehensive Plan
requirements for this property. However the plan does note that in
instances where roadway barriers such as CR 12 are present the
City can have "mini parks" to meet area needs.
2) Does the park fulfill a public purpose?
The proposed park will serve as a "rest stop" along the TH 13 trail
system which currently extends from Sunray Circle to Panama
Avenue along TH 13 and over to Village Lake Drive. Currently
residents can bike or walk to downtown Prior Lake from this area of
town via the trail and sidewalk system. The park will also provide
play equipment for ages 2-5 which is currently not available at the
Willows Park.
3) Can the City abandon the Park Land?
This land was dedicated for Public Park and could be vacated with
ownership returning to the original property owner most likely
Ryland Homes. This action would require an amendment fo the
PUD for Stonebriar as the park was required as part of that
agreement. Furthermore the residents of Stonebriar purchased
their homes understanding this park would be constructed.

4) Could the park be maintained by the Stonebriar Homeowners
Association (HOA)?
The City cannot permit operation of a private park on public park
land nor can the City require the HOA to maintain a public park.
The HOA documents and bylaws were not set up to facilitate this
type of maintenance. The City is subject to safety regulations
related to play structures and is required to inspect and maintain
accordingly.
5) Could the park be modified to a natural low maintenance park?
The park plan could be altered; however, the City has a contract
with Stonebriar requiring construction of the play structure. The
City could return the $35, 400 to the Developer of Stonebriar
however that would not absolve the City of contractual
requirements. This action would require and amendment to the
PUD for Stonebriar as the park was required as part of that
agreement. Furthermore the residents of Stonebriar purchased their
homes understanding this park would be constructed.
Based on the above issues Staff recommends that the City make the
improvements as stipulated in the PUD and Development Contract with
Stonebriar. Staff does believe that as part of the PAC park system
sustainability review being undertaken in the near future that the criteria for
new parks should be reviewed and considered for modifications.
FINANCIAL The funding for this park was specifically dedicated by Stonebriar and is
IMPACT: available in the Capital Park Fund. Tonight's direction is not meant to be
approval of improvements but rather to provide direction to Staff on how to
proceed.
ALTERNATIVES: 1. Provide direction to Staff on future improvements for Stonebriar Park.
2. Defer this item for future consideration.
