LIQUOR LICENSE FOR THE PRIOR LAKE ROTARY LAKEFRONT JAZZ
& BLUES FESTIVAL.
DISCUSSION:
Introduction
The purpose of this agenda report is to consider approval of a temporary
on-sale intoxicating liquor license for the Prior Lake Rotary for Saturday,
July 10, 2010.
Historv
Non-profit organizations are permitted by state statute to apply for
temporary liquor licenses for events, usually fund raisers, in order to sell
liquor without applying for a full year liquor license. The Prior Lake Rotary
Club, a 501 c3 non-profit, was founded in 1978 and has a long history of
providing monetary and service support to the community. Commitments
include DARE Day event (formerly DARE Bike-a-thon), donation of DARE
police vehicles, funding and maintenance of Rotary Gateway Park, funding
assistance for DARE Officers, funding for purchase of the speed display
unit and lntoxiclock, just to name a few. The Rotary is able to support these
types of community service activities because of its fundraising activities.
Current Circumstances
The newest Rotary fundraiser is a jazz & blues festival to be held on
Saturday, July 10,2010 at Lakefront Park. The event, known as the Prior
Lake Rotary Lakefront Jazz & Blues Festival, offers a free day of concerts
to the public. During the presentation part of the City Council meeting, the
Rotary will provide an overview of the event, and be available to answer
any questions from the Council about precautions which have been
planned to insure a successful event.
The Rotary will raise money to fund the event through sponsorships, and
intends to raise additional money to support its community service efforts
by selling food and beverages, including beer and wine, to the concert
goers throughout the day. In order to do so, a temporary on-sale
intoxicating liquor license is required.
City ordinance does require some additional permits as well. The additional
permits, however, are authorized at the staff level and do not require
Council action. The additional permits include:

These permits are attached for informational purposes.
City staff believes that events of this type, facilitated by non-profit
community service organizations such as the Prior Lake Rotary Club,
support the City's 2030 Vision and Strategic Plan goals by developing
community identity, promoting recreational and leisure opportunities,
encouraging volunteerism and civic duty, and providing economic vitality to
our Prior Lake community.
Conclusion
The Rotary has been meeting regularly with City staff since February of this
year to discuss event logistics, including parking, transportation, signage,
permit requirements, staffing needs and costs, park maintenance concerns,
security, alcohol control, traffic control, emergency planning, and insurance.
Despite not having hosted this type of event in the past, the Rotary has
spent two years planning the event including visiting similar events first
hand to see what works and what precautions to take. They appear to have
made every effort to garner expertise, complete its due diligence, and put
procedures in place to have a successful event. There will need to be
similar effort by Rotarians and their volunteers on the day of the event to
assure that their 'plans are successful.
The Parks Advisory Committee received a presentation on Prior Lake
Rotary Lakefront Jazz & Blues Festival at its May 20, 2010 meeting and
supported the event.
The Police Department has reviewed the temporary liquor license
application, as well as the Outdoor Event and Park Use permits, to ensure
that all requirements and issues concerning liquor compliance and public
safety have been met. The temporary intoxicating liquor license is
presented for Council consideration.
Alcohol Comoliance: The Prior Lake Rotary is taking a number of steps
to ensure that alcohol will not be sold to or consumed by minors.
· Patrons of this event who wish to purchase beer or wine will only be
able to do so by purchasing tickets.
· ID must be presented in order to purchase tickets, and patrons who
have been carded will receive both a wrist band and hand stamp
indicating that are of legal age to purchase alcohol.
· Beer and wine will be sold in locations separate from ticket sales.
· Patrons must present both a wrist band and hand stamp in order to
enter the beer tent. If requested, patrons may be asked to present ID
again.
· Both the entrance and exit of the beer tents will be monitored by
security personnel.
· Beer tents are basically service lines for purchase only and will not
have other seating.
· Patrons will be limited to purchase of two beer or wine at one time.
This is an attempt to prevent the purchase and distribution to underage
concert goers.

· Servers and event staff will participate in alcohol awareness and
compliance training.
Conflict of Interest: Council member Millar is a member of the Prior Lake
Rotary. Although he does not have a direct financial interest or potential
financial benefit from the approval or denial of the permit, he may wish to
recuse himself in order to eliminate the perception of any conflict. However,
the City Attorney has determined that it would not be improper if Council
member Millar wished to vote on this matter.
Likewise, City Manager Boyles and Police Chief O'Rourke are also
members of the Prior Lake Rotary. Under City ordinance, the City Manager
is provided the authority to authorize outdoor events and use of public
parks. He has executed the attached Outdoor Event and Park Use
permits. Similarly, Chief O'Rourke also signs off on Outdoor Event permits
as well. Because the City Manager and Police Chief have no direct or
indirect financial interest or benefit from the outcome of this action, the City
Attorney determined it was not a conflict to execute the permits.
Additionally, the City Manager has not been involved in the discussions
with the Rotary about the conditions imposed on any of the permits. Both
will be present a large portion of the event.
FINANCIAL
IMPACT:
The Prior Lake Rotary has paid the $25.00 temporary on-sale intoxicating
liquor license fee, and all additional fees required for the outdoor event and
park use permits.
ALTERNATIVES:
1. Motion and Second to approve the temporary on-sale intoxicating
liquor license for the Prior Lake Rotary for Saturday, July 10, 2010.
2. Deny the license request, and provide the staff with additional
direction.

PERMIT FOR THE TEMPORARY USE
OF PUBLIC PARK, ATHLETIC FIELD OR RIGHT OF WAY
This Permit Agreement is entered into this day of , 2010 by and between the PRIOR LAKE
ROTARY CLUB, a Minnesota non-profit organization (hereinafter referred to as "Operator), and the CITY OF
PRIOR LAKE, a Minnesota municipal corporation (hereinafter referred to as "City').

the City Council desires to encourage and promote entrepreneurial, fundraising and community
activities that utilize its public facilities and that have a positive impact on the community and its
businesses; and
the concept of a Lakefront Jazz & Blues Festival in Lakefront Park (hereinafter "Event") adjacent
to downtown Prior Lake is consistent with the City's 2030 Vision and Strategic Plan for promoting
its business districts and a sense of community pride; and
Operator desires to organize and sponsor its first Lakefront Jazz & Blues Festival in Lakefront
Park; and
the Event proposes multiple activities, including entertainers, food and retail vendors, alcohol
service and sales, and children's activities for a projected crowd of 10,000 people; and
when the Event is open it is necessary for the City to close Lakefront Park to vehicular traffic;
and
the City desires to clearly specify the responsibilities of the parties hereto and the terms under
which the Operator will be permitted to operate the Event at the site identified herein.
NOW THEREFORE, the parties agree as follows:
1. The recitals set forth above are incorporated herein as if fully set forth.
2. Property: The Operator will limit the location of the Event to Lakefront Park in the area(s) depicted on
the Site Map attached as Exhibit A (hereinafter referred to as "Property").
3. Event Date and Hours of Operation:
(a) Event Date: The Event is scheduled for Saturday. July 10. 2010 and may operate only between the
hours of 11 am through 11 pm on the Event date.
(b) Set - Up Hours: Vendors and deliveries may begin setting up for the Event after 9am on Friday, July
9, 2010, and on the Saturday morning of the Event beginning at 8am.
(c) Site Clean-Up Hours: Vendors, volunteers, participants, entertainers and Rotarians must exit the
park no later than 12:30am on Sunday, July 11, 2010. Removal of all equipment, and general clean-up of
the park must be complete by noon on Sunday, July 11, 2010.

4. City Responsibilities: In order to facilitate the use of this site, and to help the Event be successful, the
City will provide the following:
(a) Condition of the Property: City will assure that the Property is presented to Operator in a good
condition, and poses no extraordinary safety or other hazards, consistent with the routine upkeep of the
Property.
(b) Parkina.:.
· There will be no public parking within the Property.
· The front entrance of the Property will be open to shuttle only traffic for entrance.
· Permit parking and vendor parking only will be permitted within the Property and will enter at
the rear entrance of the Property off of Rutledge, and exit through the main gate on Kop
Parkway.
· City shall provide and install No Parking signs for along both sides of Ridgemont from Main
Avenue to just north of the entrance to the parking lot adjacent to the Lakefront Park tennis
Courts, and along the west side of Ridgemont thereafter. Parking will be permitted along one
side of Rutledge and is currently posted as such. Signs will be posted 24 hrs. in advance, in
approximately 20 yard increments.
· City shall provide barricades and staff for managing the front gate access.
· The City shall provide two electronic message boards during the Event to identify parking and
shuttle information.
(c) Maintenance and Set-up:
· City will provide on-site supervision of all set-up activities, and assist with any issues or
problem-solving on Friday night and all day Saturday.
· General utilities for the Event, not including the electrical requirements set out in 5(e) below,
shall be included in the service fee paid by Operator.
· The Lakefront Park Pavilion shall be reserved for the exclusive use of the Operator during the
Event. The fee for this facility is included in the service fee identified in 5(a) below.
(e) Event Staffina.: The City shall provide the following staff members for the event:
· Two maintenance staff members on Friday during set-up supervising and assisting in set-up.
· Four maintenance staff members on Saturday during set-up and duration of the event for on-
site supervision, directing vendors, and trouble-shooting any issues.
· Two maintenance staff members on Saturday during the duration of the event to manage the
front gate shuttle access.
· Two police officers on-site from approximately Noon - 4pm, Saturday.
· Four police officers on-site from approximately 4pm-8pm, Saturday.
· Six police officers from approximately 8pm to midnight on Saturday for on-site support and
traffic control on Highway 13.
· One maintenance staff member to direct clean-up volunteers from 7am-11 am on Sunday.
5. Operator Responsibilities: In its operation of the Event, and in consideration for the use of public
property and the services provided by the City, the Operator is responsible for the following:
(a) Service Fees: Operator agrees to pay to City for services outlined in 4 above, Six Thousand
Two Hundred and No/100 Dollars ($6,200.00) payable prior to June 7,2010. In the circumstance that
the Event is cancelled due to inclement weather or other circumstance beyond the Operator's or City's
control, the Service Fee shall be refunded less any expenses already incurred by the City. In the
circumstance that the City determines, in its sole discretion, that additional staff is required in order to
protect the health or safety of the public or the facilities, Operator shall be responsible for reimbursement
of any additional costs.
(b) Security Deposit: Operator agrees to provide a check in the amount of Fiye Thousand and
No/100 Dollars ($5,000) as a security deposit for any damage incurred to the Property or its facilities as a
result of the Event. The Security Deposit shall not be applied in cases of normal wear and tear for an
Event of similar size and type. The City shall determine in its sole discretion if any damage exists to the
Property and shall advise the Operator within 5 days following the Event. If the City, in its sole discretion,
determines that no extraordinary damage exists and that the City has not incurred additional costs other
than outlined herein, the Security Deposit will be refunded to the Operator within 14 calendar days.
(c) Permits and Licenses: Operator acknowledges that additional permits and licenses may be
required, including but not limited to outdoor event license, liquor license, sign permits, fireworks permit,
golf car permits, electrical inspections, and Department of Health Special Event Food Stand license.
Operator shall be responsible for submitting and complying with all State and local permit and license
requirements.
(d) Staffina and Volunteers: Operator shall be responsible for providing the following minimum staff
and volunteers and shall be responsible for the actions, training, and direction of all volunteer staff.
· Operator shall be responsible for providing a Prior Lake Rotary Club operations contact who
shall be have authority to make on-site decisions and be responsible for coordinating all
aspects of the Event with City staff, including being on-site during set-up on Friday, and the
Event on Saturday.
· Operator shall provide a contact list of Event leaders who are assigned to and responsible for
planning various parts of the Event (attached hereto as Exhibit E)
· Operator shall provide five (5) volunteers to assist in the set-up for the Event on Friday, July
9, 2010.
· Operator shall provide two (2) volunteers to manage VIP and vendors access at the Rutledge
entrance to Lakefront Park for the duration of the Event.
· Operator shall provide all volunteers in the number determined appropriate by Operator to
serve as security stewards, alcohol sales and servers, and parking/shuttle stewards.
· Operator shall provide a minimum of twenty (20) volunteers to assist in the clean-up of the
Event on Sunday, July 11,2010 at 7am.
(e) Maintenance:
· Set up: Operator shall provide City with a probable schedule and timeline for arrival and set-up of
all tents, vendors, garbage cans, portable toilets, sign age, and staging a minimum of two (2)
weeks prior to the Event.
· Tents/Staging/Fencing: Only weighted (rather than staked) tents or fencing are permitted on
any hard surface, including parking lots, courts, patios or rinks, within the Property. Staked tents
or fencing may be permitted in grass areas only with the pre-approval of all locations by City
maintenance staff. City staff must approve and supervise the location of any staking for the stage
trusses. Operator shall bear all costs for any damage to the irrigation system as a result of using
staked tents, trusses, or fencing.
· Electrical: Operator will provide generators for all electrical service serving its alcohol sales,
vendors, and entertainers. Operator will schedule and assure that all State inspections and
permits have been acquired.
· Garbage: Operator shall provide an appropriate number of trash cans (as recommended by a
vendor experienced in such events) to be placed intermittently throughout the park. Operator
shall also provide all trash removal by 11 am the following day. City staff shall approve the
locations and placement of all trash cans and removal.
· Portable Toilets: Operator shall provide an appropriate number of portable toilets (as
recommended by a vendor experienced in events of this size) to be placed as approved by City
staff. Portable toilets shall be removed from the park by 11 am the following day. City staff shall
approve the locations and placement.
· Golf Carts: Golf Carts shall be permitted strictly for Operator's use only on the pathways within
Lakefront Park, and in limited instances on the grass. City staff shall have final authority to limit
or change the use of golf carts on the grass if they determine they are creating wear patterns or
other damage to the Property, or risk to the public.
· Clean up: The Operator must police the site for litter and other debris during the Event and leave
the site in a clean manner. Refuse must be removed from the site by the Operator or Operator's
vendor prior to 12pm (noon) on the day following the Event.
(D Parkina / Shuttles:
· Operator shall provide a shuttle, parking and signage plan, including projected timing of
shuttle routes and emergency contingencies, to the City by April 1, 2010 (attached here as
Exhibit B).
· Operator shall be responsible for providing and posting all directional and identification signs
for all parking locations.
(g) Use of Prooertv Facilities: The Service Fee outlined in 5a herein shall include the access and
use of any buildings, restrooms, concession facilities, and amenities on the Property. Operator shall be
responsible for the supervision, activities and condition of the facilities consistent with the City's
Reservation Policy attached hereto as Exhibit C.
7. Minimum Insurance Reauirements: Operator shall provide a Certificate of Insurance naming the City of
Prior Lake as an additional insured in a minimum amount of $2 million general liability. If the Event involves the
sale of alcohol, the Operator is required to provide a minimum of $1 million in liquor liability insurance. Attached
hereto as Exhibit O.
8. Indemnification: Operator shall defend, indemnify, and hold harmless the City and its employees,
subcontractors, attorneys, agents, and representatives from and against all claims, damages, losses, costs and
expenses, including attorney's fees, which may be incurred by or asserted against the City or for which the City
may be held liable, which arise out of or result from the operation of the Event at the site, except liability caused
solely by the negligence of the City.
9. Cancellation Due to Weather Conditions. Facility Condition or Other Public Safety Emeraency:
The City shall retain final authority to close the public park, facility or right-of-way based upon inclement weather,
risk to the public, or risk of damage to the public facility. Such determination will be reasonable as they relate to
the site. Under no circumstances shall the City bear any costs related to cancellation of the Event due to weather
conditions, facility conditions or other public safety emergency. If it is determined that a park, facility or right-of-
way shall be closed, the City shall notify the Operator immediately. Operator shall have communication
procedures in place to advise its staff, vendors, and participants of the cancellation.
10. Revocation of Permit. The City reserves the right to terminate this Agreement at any time and at the
sole discretion of the City Manager. The Operator waives any rights it may have in law or in equity for recourse
against the City in the event the City withdraws its permission for the Event to operate at the site. Further, the City
shall bear no responsibility, in any form or manner, to relocate or assist the Operator in relocating the Event.
Failure to abide by any of the conditions set forth in this Permit may result in revocation of this permit by the City.
If the City withdraws its permission to allow the Event to operate at the site, the City will provide the Operator
fourteen (14) calendar days notice. The fourteen day notice does not apply in cases of closure related to section
9 herein.
IN WITNESS WHERE, this Permit has been executed as of the date first written above.

PURPOSE: The residents of Prior Lake value recreation and open space and have
provided for park facilities throughout the City. City parks and park facilities are intended
for the use and enjoyment of all residents and park visitors. To assure all residents and
park visitors are able to enjoy the City parks and facilities, it is necessary to regulate
activities and conduct within the park facilities. This Section regulates the use of City park
facilities to promote, protect and provide for the health, welfare, safety and comfort of
residents and park visitors within the City. The regulations in this Section are also
intended to protect the environment and the natural resources entrusted to our care.
AUTHORITY: The City Manager shall administer the parks and recreation policies of the
City. The City Manager may delegate or assign any or all of the duties and
responsibilities of this Section to other City personnel. The actions of the other City
personnel shall have the same force and effect as if taken by the City Manager. The City
Manager shall have the right to issue administrative rules and regulations governing the

The City Manager may declare any park facility or portion thereof closed to the public at
any time and for any interval of time or for certain uses, as the City Manager shall find
reasonably necessary to preserve the health, welfare and safety of a park visitor or the
park facility. The City Council shall annually establish fees for the various permits
required by this Section.
DEFINITIONS: For the purpose of this Section, the terms defined in this subsection shall
have the meanings given them in this Section. Any undefined term used in this Section
shall have its usual and customary meaning:

Public Ways & Property
Domestic Animal: A dog or cat.
Drugs: Any substance defined as a controlled substance by Chapter 152, Minnesota
Statutes or other statutes of Federal laws or regulations.
Intoxicating Liquor. Any liquor which is intoxicating pursuant to State law and includes
ethyl alcohol, distilled, fermented, spirituous, vinous and malt beverages containing in
excess of three and two-tenths percent (3.2%) alcohol by weight.
Motorized Recreational Vehicle: Any self-propelled, off-the-road or all-conveyance
vehicle, including but not limited to, a snowmobile, minibike, amphibious vehicle,
motorcycle, go-cart, trail bike, dune buggy or four-wheel drive.
Nonintoxicating Liquor: Malt A beverage containing not more than three and two-
tenths percent (3.2%) alcohol by weight.
Nude: Means the showing of the human male or female genitals, pubic area or buttocks
with less than a fully opaque covering, or the showing of the female breast with less than
a full covering or any portion thereof below the top of the nipple.
Park Means a park, playground, swimming pool, lake, pond, stream, trail, nature area,
open space area or recreation center under the control of the City. Park shall also mean
any other property owned, leased, used or controlled, wholly or in part, by the City for park
or recreational use. Park shall include roadways and parking areas within the parks.
Park Visitor. Any person, firm, partnership, association, corporation, governmental unit,
company or organization of any kind within a park.
Vehicle: Any motorized, propelled, animal-drawn or human-powered machine used to
convey people, animals or property.
Watercraft: Boat, canoe, raft or any other object or apparatus used to carry people,
animals or property on water.
Weapon: Any device from which shot or projectiles of any type can be discharged by
means of an explosive, gas, compressed air or otherwise propelled, including but not
limited to firearms, bows and arrows, slings and spring guns.
Wildlife: All living creatures, not human, wild by nature, endowed by sensation and
power or voluntary motion, including quadrupeds, mammals, birds, fish, amphibians,
reptiles, crustaceans and mollusks.

PARK HOURS: With the exception of Memorial Park, Ponds Park and Thomas Ryan
Memorial Park, all parks will close at 10:00 p.m. each day and shall remain closed until
5:00 a.m. on the following day.

. Thomas Ryan Memorial park will close no later than 11 p.m. No inning shall start
after 10:30 p.m. and, whenever staff monitoring the park usage determine the
games to be completed, the park will close at 10 p.m. and shall remain closed until
8:00 a.m. on the following day.

Activities Permitted After Closinq. The following activities may continue in parks
before or after the parks normal closing hours:
~ City-sponsored and supervised activities which, because of the nature of the
activity, cannot be held during the time when the parks are open.
~ Activities conducted pursuant to a Parks and Recreation Department permit
issued under subsection 702.1000.
~ From November 15th to March 15th, during the hours of 10:00 p.m. and 5:00 a.m.,
individuals may drive on designated and posted roadways within a park facility for
the sole purpose of gaining access to a lake for snowmobiling or ice fishing.
~ City employees, equipment or agents conducting maintenance, construction or
repair work on the property or buildings.
~ Overnight mooring of boats in City-owned slips with required City permit.

702.500: GENERAL CONDUCT WITHIN CITY PARKS: It shall be unlawful for any person in a
park to:
(1) Use threatening, abusive, insulting, obscene or indecent language or to act in an
indecent, lascivious or improper manner, commit any nuisance, appear nude or semi-
nude, or to do any act which constitutes a breach of the public peace.
(2) Disturb, harass or interfere with any park visitor or park visitor's property.
(3) Deposit, scatter, drop or abandon any bottle, can, broken glass, cigarette butts, sewage,
waste or other material, except in receptacles provided for such purpose.
(4) Enter a park with glass beverage bottles or glass beverage containers.
(5) Gamble or participate in any game of change unless it is part of an organized City-
sponsored event.
(6) Drop, throw or otherwise leave unattended lighted matches, burning cigars, cigarettes,
tobacco, paper or other combustible materials.
(7) Sell, solicit or carry on any business or commercial enterprise or service in a park without
first obtaining a permit from the City.
(8) Use any loudspeaker or other amplifying system or devise without a permit from the
Department of Parks and Recreation.

(9) Play the game of golf, engage in putting, practice swinging, or the striking of any golf balls
or other objects in any park, except for Frisbee golf in designated areas.
(10) Remove any animal, living or dead from a park. Any animal removed from a park or
taken contrary to the provisions of this Section or State Statutes shall be considered
contraband and subject to seizure and confiscation.
(11) Skateboard or rollerblade on other than designated trails and equipment.
(12) Use of the skate park contrary to the rules and policies promulgated and posted from time
to time by the City.

702.600: RESTRICTED ACTIVITIES.
(1) Camoinq. It shall be unlawful for any park visitor to camp in a park except with written
permission of the City.
(2) Horseback Ridinq. It shall be unlawful to ride a horse or other animal within any park
unless in possession of a permit issued by the City, or as part of an organized community
event.
(3) Swimmina. It shall be unlawful for any park visitor to wade or swim within a park except
at beaches designated for that purpose, and then only during such hours as may be
designated by the City, take bottles or glass of any kind, except eyeglasses, into a
designated beach area, and/or use air mattresses, inner tubes or other inflatable devices.

(4) Aircraft. Hot Air Balloons and Parachutes. No park visitor shall use any land or body
of water within a park for a starting or landing field for aircraft, hot air balloons or
parachutes, without first obtaining a permit from the City.
(5) Boatinq. It shall be unlawful for any park visitor to:
).>- Launch or land any boat, yacht, canoe, raft or other watercraft upon any water,
lagoon, lake, pond or wetland within a park except at locations and times
designated for that purpose unless sponsored by the City.
).>- Operate any watercraft in a designated swimming area or other prohibited area.
).>- Operate any watercraft in a park in violation of Minnesota Statutes, Chapter 361
"Waters and Watercraft Safety."
).>- Moor a boat in a City slip or on park shoreline before or after the hours the park is
open, unless first obtaining a boat slip rental permit from the City.
).>- Moor a boat at any time in a slip reserved exclusively for lake enforcement
personnel.
).>- Moor a boat without first obtaining a permit therefore from the City if designated as
a "reserved" slip.
).>- Fish, water ski, innertube, swim or dive from, or within 50 feet of a City-owned
dock.
).>- Beach any watercraft at Lakefront Park between the dock and swimming area at
City of Prior Lake

any time.
~ Obstruct or interfere with another who is using the City-owned dock in accordance
with this ordinance and City policies.
~ Obstruct or fail to follow the direction of a City employee or agent in the
administration of City-owned boat slips in accordance with this section and City
policies.

(6) Fishina. It shall be unlawful for any park visitor to:
~ Fish in a park in violation of any provision of Minnesota Statutes, Chapter 101,
except as part of Department of Natural Resources sponsored fishing in the
neighborhood (FIN) event or program. (amd. Ord. 105-09 - pub 4/23/05)
~ Fish in a designated swimming area.
~ Leave any structure or shelter designed for ice fishing in any park for more than
forty-eight (48) hours.
(7) Bicvclina. It shall be unlawful for any park visitor to operate a bicycle except on park
designated trails, bikeways and roadways, and except as close to the right-hand side
thereof as conditions will permit. (amd. Ord. 105-09 - pub 4/23/05)
(8) Meetinas. Soeeches. Demonstrations and Parades. It shall be unlawful for any park
visitor to conduct public meetings, assemblies, entertainments, parades or
demonstrations within a park without first obtaining a written permit from the City, and
then only in the area designated in the permit. (amd. Ord. 105-09 - pub 4/23/05)
(9) Tobacco-related oroducts. It shall be unlawful to use any tobacco-related products on
the grounds of Jeffers Pond Elementary School Park. (amd. Ord. 105-22, pub 9/17/05)
702.700: DOGS AND CATS: It shall be unlawful for any park visitor to bring a dog or cat into a
park, with the exception of seeing-eye dogs and police dogs, unless:
(1) The dog or cat is properly licensed.
(2) The dog or cat shall be restrained at all times. The pet owner is liable for any action taken
or damage caused by the dog or cat.
(3) All dogs or cats shall be restrained at all times on adequate leashes not longer than six (6)
feet.
(4) Park visitors who bring dogs or cats into a park must have in their possession tools or
equipment suitable for the removal of animal fecal material and shall promptly and
effectively remove from the ground or surface of any park and any park facilities all fecal
material deposited by a dog or cat under their control and care. Park visitors removing
animal wastes from park surfaces shall dispose of it in a sanitary manner, which may
include depositing it in any designated waste receptacle located in the public park.
(5) Park visitors bringing a dog or cat into a park shall not permit the animal to disturb, harass
or interfere with any park visitor or any park visitor's property, or wildlife.
(6) No dog or cat shall be permitted on beach area, nature center area, park building, skating

rink, or any athletic fields located in: Memorial Park, Ponds Park, Lakefront Park, Thomas
Ryan Memorial Park, or any other Athletic Complex in the City.
702.800: VEHICLES. City Code provisions and State law provisions relating to the operation of
vehicles upon streets and highways shall apply within all parks and upon all park property.
In addition, Minnesota Statues, Section 169 is hereby specifically adopted by reference
except those provisions which by their nature have no application. It shall be unlawful for
any park visitor to:
(1) Operate any vehicle within a park except upon designated roadways and parking areas.
(2) Operate a vehicle in a park at a speed in excess of posted speed limits.
(3) Park or leave a vehicle standing within a park except at a designated parking area during
regular park hours.
(4) Operate a vehicle which emits excessive or unusual noise, noxious fumes, dense smoke
or other polluting matter.
(5) Operate a vehicle in a reckless or careless manner in a park.
(6) Wash, polish, grease, change oil or repair any vehicle in a park.
Motorized Recreation Vehicles. It shall be unlawful for any park visitor to operate a
motorized recreation vehicle within a park except on designated roadways and parking
areas, or to operate a snowmobile within a park other than on designated trails within the
park for snowmobile traffic.
702.900: SPECIAL USE. No park visitor or group shall have special use of all or any portion of a
park unless they have first reserved the property with the City and procured a permit from
the City. Unless a special use permit is procured and a reservation is made, use of park
property will be on a first come - first serve basis. (amd. Ord. 105-09 - pub 4/23/05)
702.1000: PARK OPERATION AND PERMITS.
702.1001 Liabilitv. The City shall not be liable for any loss, damage or injury sustained by a park
visitor. Any person using a park shall do so at their own risk.
702.1002 Permits Reauired. A permit shall be obtained from the City before participating in any of
the following activities in a City park:
~ Carnivals, Community Celebrations, public meetings, assemblies, entertainments,
parades or demonstrations regardless of the number.
~ Gathering of 25 or more park visitors, including picnics or political gatherings.
~ Contests and Exhibitions, including among other things those requesting exclusive
use or charging admission, regardless of the number.
~ Bringing kegs or barrels of intoxicating liquors, malt liquors or wine into a park.
~ Bringing intoxicating liquor other than beer into a park.
~ Using or Being in a park during closed hours. (amd. Ord. 99-09-pub. 8/7/99).

702.1003 Aoolication for Permit. The City Manager or designee shall issue a permit upon finding
that: (amd. Ord. 105-09 - pub 4/23/05)
(1) The proposed activity or use of the park will not unreasonably interfere with or distract
from the enjoyment of the park by other park visitors, or disturb residentially zoned
properties and park visitors in proximity to the park.
(2) That the proposed activity or use will not unreasonably interfere with or detract from the
promotion of public health, welfare, safety, comfort and recreation; provided that this does
give right to exclusive use of park facilities.
(3) That the proposed activity or use is not reasonably anticipated to entice violence, crime or
disorderly conduct.
(4) That the proposed activity will not entail unusual, extraordinary burden or expense for the
City.
(5) That the facilities desired have not been reserved for some other use at the day and hour
required in the application.
702.1004 Denial of Permit. Within five (5) days after the receipt of a completed application, the
City Manager or designee shall apprise an applicant in writing for the reasons for refusing
to issue a permit, and any aggrieved park visitor shall have the right to appeal in writing
within five (5) days of mailed notice to the City Manager which then shall consider the
application under the standards set forth in subsection 702.1003 above, and sustain or
overrule the decision within fourteen (14) days. The decision of the City Manager shall be

702.1005 Conditions of Permit. A permittee shall be bound by all parks rules and regulations and
all applicable ordinances as if the same were fully inserted in the permit. The City may
impose any reasonable conditions on a permit that in its discretion will protect the health,
welfare, safety, comfort and recreation in the park. The park visitor to whom a permit is
issued shall be liable for any loss, damage, or injury sustained by any park visitor
wherever by reason of the negligence of the park visitor(s) to whom the permit was
issued. Within 24 hours after the expiration of the permit, a permittee shall remove from
the park all trash, in the nature of boxes, papers, cans, garbage and other refuse, and all
installations and equipment, and restore the premises to their condition prior to the
permittee's use of the park.
The City shall have the authority to revoke a permit upon finding a violation of any rule or
ordinance, condition imposed on the permit, or upon good cause. A permit under this
Section may not be transferred to any party other than the applicant.
702.1100: PROTECTION OF PROPERTY, STRUCTURES AND NATURAL RESOURCES.

702.1101 Damaoina or Removina Prooertv Prohibited. No park visitor shall willfully deface,
vandalize or otherwise cause the destruction of park property.
702.1102 Flowers. Trees and Shrubs. No park visitor shall willfully and without authority cut, pluck
or otherwise remove or injure any flowers, shrubs, trees or other plant material growing in
or around any park. No park visitor shall introduce any form of vegetation within a park
without the permission of the City. (amd. Ord. 105-09 - pub 4/23/05)
702.1103 Birds or Animals. No park visitor shall willfully or without authority kill, trap, hunt, pursue
or in any manner disturb or interfere with any species of wildlife in any park. No park
visitor shall release any insect, fish or animal in any park or public land without permission
from the City. (amd. Ord. 105-09 - pub 4/23/05)
702.1104 Fires. No park visitor shall ignite a fire in any park, except in places provided by the City
with receptacles manufactured for such purposes. The igniting of fires may be further
limited or prohibited by park rules. No park visitor igniting or attending a fire shall leave
the area before the fire has been completely extinguished.
702.1105 Excavations. No park visitor shall dig trenches or make other excavations within a park.
702.1200 USE OF ALCOHOL WITHIN A PARK FACILITY: Intoxicating liquors and
nonintoxicating malt liquor may only be consumed and displayed in a park, subject to the
following provisions:
(1) Intoxicatina Liauors. No park visitor shall have in their possession or bring into a park
any intoxicating liquor, except beer in cans, without first having obtained a permit from the
City. (amd. Ord. 105-09 - pub 4/23/05)
(2) Roadwavs and Parkina Lots. No park visitor shall display or consume intoxicating
liquors or nonintoxicating malt liquor on or within thirty (30) feet of any roadway or parking
lot within a park.
(3) Prohibited Areas. No park visitor shall possess, display or consume intoxicating liquors
or nonintoxicating malt liquor within areas the City has designated that such possession,
display or consumption is prohibited.
(4) Quantities. No park visitor shall bring into a park intoxicating liquors or nonintoxicating
malt liquor in kegs or barrels, except as provided in this Subsection. Groups, associations
or organizations desiring to bring intoxicating or nonintoxicating malt liquor into parks in
kegs or barrels may do so only after obtaining a permit for such use from the City. The
City shall grant the permit if in the judgment of the City Manager the use for which the
permit is sought will not interfere with the health, welfare, safety and use of the park by the
general public or the quiet use and enjoyment of any residentially zoned property in

The City shall establish minimum criteria an applicant must meet in order to obtain a
permit. The City may impose restrictions and conditions on the use for which the permit is
issued. The use for which the permit is granted shall only be conducted within the area
designated in the permit.

(5) Minnesota Statutes, Chapter 340A is hereby specifically adopted by reference except
those provisions which by their nature have no application.
(6) Thomas Ryan Memorial Park shall be alcohol-free including intoxicating and non-

(7) Jeffers Pond Elementary School Park shall be alcohol-free, includinging intoxicating

702.1300 RESTITUTION, ENFORCEMENT AND PENALTIES: In addition to any other penalties
provided by this Section, any park visitor violating the provisions of Section shall make
restitution to the City for the full value of the damage caused, including, but not limited to,
the cost of repairs, replacement and any fees the City may have incurred, including legal,
in enforcing the provisions of this Section.
A park visitor guilty of violating any provision of this Section shall be guilty of a
misdemeanor, which is punishable by a fine of not more than one thousand dollars
($1,000), or by imprisonment for a period not to exceed ninety (90) days, or both. (amd.

The Chief of Police shall have the principle responsibility of enforcing the provisions of this
Section. In addition, designated Prior Lake parks employees may, in connection with their
duties imposed by law, diligently enforce the provisions of this Section and eject from
parks, park visitors acting in violation of this Section.
The City Manager shall have the authority to revoke for good cause any permit or
reservation issued by the City. Nothing in this Section shall prevent employees or agents
of Prior Lake from performing their assigned duties. No person shall impersonate any
employee of the City parks nor interfere with, harass nor hinder any employee in the
discharge of his duties. Nothing in this Section is intended to waive the application of
State law within parks. The City Attorney is responsible for the prosecution of violations of

The Lakefront Park Pavilion located at 5000 Kop Parkway is available for small group use on a
rental basis by residents, civic groups, commercial groups and non-resident groups, as scheduled
by the Recreation Department. The policies that follow are needed to insure the proper use and
control of the facility so that all people may equally enjoy them. As a renter you are responsible for
reviewing all of the information provided.
RESERVATION PROCEDURE
Requests for use of the Lakefront Park Pavilion should be directed to the City of Prior Lake
Recreation Department at 952-447-9820 or 952-447-9800. Reservations will occur on a first
come, first serve basis. An official reservation form accompanied by a $200 damage deposit and
non-refundable reservation deposit of $50 (resident)/$85 (non-resident) must be submitted to
hold a reservation. We require your full reservation deposit payment and damage deposit to be
submitted in two separate checks. Sorry, we do not accept credit cards. Your damage deposit will
be promptly returned after your rental, barring any deductions. If deductions are made, there may
be a waiting period for you to receive your balance. Renters will be issued an invoice listing final
payment, due two weeks before your reservation. If final payment is not received two weeks prior
to your reservation, your rental date and time will be released and your reservation deposit
forfeited. Sorry, we do not take reservations over the phone or on-line. Reservations received
before January 1 are subject to rate increases in the next calendar year. You may tour the Pavilion
by contacting Nancy at City Hall at 952-447-9820. Tours are available Tuesday - Thursday, 8:00
a.m.- 4:00 p.m.
RENTAL PERMIT
A rental permit will be issued to you to confirm your rental approximately one week prior to your
rental date. Permits will not be issued until receipt of the official reservation form, deposits, and
full rental fee. Your initial rental deposit of $50/$85 will be applied to your total rental fee. The
"contact person" listed on the official reservation form must coincide with that person's proper
address, must be a minimum of 21 years of age, and is solely responsible for supervision of the
rental. If discrepancies are discovered, the City of Prior Lake reserves the right to deny your
permit. Residents may not reserve any City faCility for a non-resident and/or business. Permit
holders will not assign, transfer, or sublet to others the use of the facilities. Any violations will
result in the forfeiture of your reservation and any fees paid to date.
GROUP SIZE
The Lakefront Park Pavilion is designed for small group gatherings. The maximum capacity
allowed for a rental group is 150 people. This includes the outside areas. In accordance with fire
codes the maximum building capacity is posted at 61 people, so please plan accordingly in regards
to your group size and possible weather conditions. Youth groups shall be chaperoned on a ratio
of one adult for each ten (10) or fewer youth under the age of 18. The number of youth attending
and the names of the chaperones shall be submitted with the facility use contract.
RENTAL HOURS OF USE
The hours available for the rental of the Lakefront Park Pavilion are as follows*:
7:00 a.m. - 12:00 midnight, Monday-Friday
8:00 a.m. - 12:00 midnight, Saturday and Sunday
*Does not include official city holidays and special events. Holidays are rented on a case-by-case
basis. December 15 through March 1 is available on a limited basis due to the operation of the
Lakefront Pavilion as a warming house. Please contact the Recreation Department to inquire about
availability.

GAZEBO
The gazebo located adjacent to the Lakefront Park Pavilion may be included in your rental, if
available, for no additional fee. If your group is interested in using the gazebo, please make the
indication on your reservation form.
OUTDOOR TENTS
If your group wishes to use outdoor tents, please note the size and desired location of any tents you
wish to set up. All tents must be freestanding, you are not allowed to pound any stakes into the
ground due to underground utilities and irrigation lines. Tents must be set up and taken down the
day of your rental. Prior Lake Rental has freestanding tents of various sizes available for rental.
Please contact them directly to inquire. The City of Prior Lake reserves the right to deny the size
and or quantity of any outdoor tent set up requests.
SET UP & CATERING
Groups are allowed one hour free of charge for set up immediatelyprior to your rental time. Your
set up time must be specifically listed on your rental application to receive it free of charge.
Groups are responsible for their own room set up. Deliveries and pick-up of equipment, food, or
other items must be completed during the rental period listed on the permit. If more than an hour
or a different time frame is requested for set up, standard rental fees will apply. No food or
beverage can be sold.
Decorations are allowed however should not cause damage to the facility. If it is necessary for
your group to mount items on the walls, please use drafting tape on the wood portion of the wall
only. The use of pins, tacks or nails on the walls is strictly prohibited. The use of fog/smoke
(special effect fogging) machines is prohibited. Candles, rice, confetti and bird seed are not
permitted.
BUILDING ATTENDANT
A Building Attendant will be assigned to your event to open and close the Pavilion. The Attendant
will not be present for the duration of your event. If there are any facility operation questions or
circumstances you feel the Building Attendant needs to be aware of, please notify them at the
beginning of your event.
AMENITIES
Please be respectful of the building and its contents. If any city property is damaged, please inform
the Building Attendant at the conclusion of your event. Resolution of any damages will be handled
on a case-by-case basis.
Rental groups are allowed to use: the Pavilion common area, restrooms, Mechanical Room floor
sink, and Concession Stand refrigeration, sinks, telephone, outdoor porch area, and outdoor porch
area grill. You must provide your own charcoal.
Amenities included in rental: 10 round, 60" tables, up to four, 8' rectangular banquet tables,
approximately 90 indoor chairs and the 12 square, 46" picnic tables located in the outdoor porch
area. Each round table seats six adults comfortably, but can accommodate eight. Each outdoor
table can accommodate a maximum of eight adults. Banquet tables are recommended for serving
only, not to seat guests, based on the size of the indoor portion of the building.
Groups are not allowed to use the concession eauipment includin2: the freezer. coffee. nacho. or
hot chocolate/cappuccino machines inside the concession area or any of the concession
sutJtJlies. Any items used or missing will be assessed through your damage deposit on a case-by-
case basis.
CLIMATE CONTROL
The Lakefront Park Pavilion is pre-programmed for heating and air conditioning throughout the
year. The temperature inside the building will be set at a comfortable level appropriate for the
season your rental takes place. The fireplaces and ceiling fans located inside of the building are

available for use during your rental. Please inform the Building Attendant if you wish to use those
amenities at the start of your rental time.
ALCOHOL
By law, private groups are not allowed to sell alcohol at any public facility and are not eligible to
apply to the city for a permit. Any activity operating with the intent of distributing alcoholic
beverages free of charge must state their intent on the reservation form. Alcohol can only be
displayed and served in the interior of the Pavilion or porch area of the Pavilion. All bevera!Z:es
must be served in cans. Dlastic bottles. or Dlastic CUDS onlv. NO GLASS! No alcohol other than
beer in cans is allowed beyond the Pavilion or porch area in accordance with City Park Ordinance.
A club or charitable, religious or non-profit organization in existence for at least three (3) years
are the only groups that may be issued a temporary license for the on-sale of malt liquor and wine
in connection with a social event within the city. All groups selling 3.2 malt liquor beverages at a
function held in the Lakefront Park Pavilion will be required to secure liquor liability insurance
(dram shop) in the minimum amount of $500,000 with the City of Prior Lake named as an
additionally insured party. Groups intending to sell hard liquor may apply for a temporary on-sale
liquor permit. A certificate of insurance must be submitted at the time of final payment in these
cases. If your organization is interested in selling alcoholic beverages at your event, please contact
the City of Prior Lake Finance Department and allow at least 30 days prior to your rental to secure
the proper forms and assist you through the process.
NO SMOKING
The entire Lakefront Park Pavilion is a smoke free facility. Renters are responsible for ensuring
that members of their group do not smoke within any area of the building.
AMPLIFIED MUSIC
Rental groups of 50 or more planning on having outdoor amplified music live or recorded, must
obtain a permit from the City of Prior Lake Finance Department. Please contact Janet at 952-447-
9840 for more information and allow at least 30 days prior to your rental to secure the proper
forms and assist you through the process.
PARK USERS
Please be aware that Lakefront Park remains open to the public during your event. Other activities,
sporting events, and parking congestion may occur. If you have questions regarding other
scheduled park activities, please inquire at the City Hall Reception Desk, 952-447-9820 or 952-
447-9800. "Private Party" signs are provided in the Mechanical Room at the Pavilion for your
group to place outside the Pavilion during your rental, if desired. Please make sure to return the
signs upon completion.
EMERGENCIES
An emergency contact number will be provided on your rental permit if there are any issues at the
start of your rental. Any issues that occur during your rental should be directed to the assigned
Building Attendant or, if the situation warrants, the Prior Lake Police Department.
CONCLUSION OF THE RENTAL
At the conclusion of your rental, your group is required to return the Pavilion to the original
condition including:
1. Vacuuming indoor carpeted areas (vacuum is located in the Mechanical Room).
2. Emptying all indoor trash containers, placing the contents in the large trash barrels
outside and replacing the trash bags (supplied).
3. Returning all tables and chairs to the original configuration.
4. Removing any wall hangings, decorations, tablecloths, etc.

The Building Attendant will assess the final condition of the building and surrounding areas.
Please do not leave the building unattended at the conclusion of your event. Contact the Building
Attendant if your group plans to leave early. No keys will be issued. The Building Attendant will
provide their name and contact number at the start of your rental.
Rental groups will be assessed an $85 late checkout fee if they are not ready to vacate the Pavilion
by the conclusion of the rental period listed on the permit. If applied, the fee will be deducted
from the damage deposit.
RENTAL FEES
Rental fees are charged on a per hour basis and will not be pro-rated. There is a 4-hour minimum
rental for Saturdays, Sundays and Holidays. There is a 2-hour minimum rental Monday through
Friday. A $200 damage deposit must accompany all rental fees. See "Reservation Procedure"
section. School District #719 and non-profit civic groups are exempt from damage deposit
requirement.

Join us at Lakefront Park from 12 noon until 11 PM for a
spectacular Jazz and Blues concert. This is a FREE,
family focused event. "Lil' Louie's Music Camp" is a
special area just for kids with activities like painting, jazz
dance, crafts and musical games from 1 p.m. - 7 p.m. The
kids area will also include inflatables open from 1 p.m. - 6
p.m. Great food and cold beverages will be available to
satisfy everyone's taste. No coolers, please!

Other Details: All parking will be offsite. Patrons will either walk or ride free shuttles to
the event. Set Up: 7/09/10, 9am - 10pm and 7/10/10, 8am - Noon. Clean up 7/10/10 until
1230am and 7/11/10, 9am until noon. Expected Attendance: 5,000 plus.
On street parking will be restricted on both sides of Ridgemont from Main to the tennis
court parking lot entrance and on the west side of Ridgemont there after and one side of
Rutledge.
