Historv The City Code provides that the City Council may approve the renewal of annual on-sale intoxicating, Sunday liquor, off-sale intoxicating, on-sale wine, off-sale 3.2 malt liquor, on-sale 3.2 malt liquor, and club licenses following the opportunity for a hearing and testimony. State statute requires that all licenses must expire on the same date, June 30 of each year. Current Circumstances All applicants have submitted the required documentation to renew their licenses. They have provided proof of liquor liability insurance. Prior Lake City Ordinance 301.600 states that no license shall be granted for operation on any premises for which taxes, assessments or other financial claims of the City are delinquent or unpaid. The Scott County Treasurer's records and City records show that all property taxes and money owed to the City are current for all applicants. Conclusion A public hearing has been scheduled and all applicants may be present if they wish. The City Council should provide an opportunity to be heard with respect to the renewals. Following that, the City Council may act upon the renewal request. The Prior Lake Police Department has conducted an investigation and has reported that in the past five years the following establishments have been cited with selling alcohol to minors: 2009 - Prior Lake Amateur Baseball Association 2008 - Fong's Chinese Cuisine 2007 - Viking Liquor 2006 - T J Hooligan's 2005 - Village Liquor 2005 - O'Malley's On Main R\Collncil\2010 Agenda Reports\06 2110\2010 LiqLlor License Renewals.doc The Prior Lake Police Department conducts alcohol compliance checks twice per year every year. FINANCIAL IMPACT: This is the final year for the graduated fee increase for on-sale intoxicating licenses, with this year's fee at $6,300.00. Included in this agenda report is Exhibit A which details the license type and fees for the applicants, who have paid a total of $56,900.00 for their licenses. In addition to the license fees, a total of $150.00 in late fees has been collected from applicants who were late submitting their renewal applications (three applicants @ $50.00 per late fee). ALTERNATIVES: Following the public hearing, the Council has two alternatives: 1. Motion and second to approve the renewal of the liquor licenses listed on Exhibit A for 2010-2011. 2. Deny a specific renewal request and/or provide staff with additional direction. RECOMMENDED Alternative #1. MOTION: ---- -.
