CONSIDER APPROVAL OF A RESOLUTION ORDERING PREPARATION
OF A FEASIBILITY REPORT FOR THE 2011 RECONSTRUCTION
IMPROVEMENT PROJECT, CITY PROJECT #11-011
Introduction
The purpose of this agenda item is to initiate the process for local
improvements set forth in the 2011 portion of the 2011-2015 Capital
Improvement Program in accordance with Minnesota Statutes (M.S.),
Chapter 429.
Historv
The City uses the Five Year Capital Improvement Program and a Pavement
Management Program to plan its infrastructure improvements and the
financing for capital improvements. The proposed 2011 street reconstruction
program includes street and utility improvements to the Boudin's
neighborhood. Due to the size of the project, it is scheduled for construction
in 2011 and 2012.
The M.S. Chapter 429 process applies to all projects that will be financed in
whole or part through special assessments or bond proceeds. The first step
in the process is for the Council to order the preparation of a Feasibility
Report for the improvement projects.
The Feasibility Report will address street reconstruction in the Boudin's
neighborhood. In particular for the following streets: Boudin Street, Denese
Street, Grayling Circle, Lois Avenue, Natalie Road, Rutgers Road, Timothy
Avenue and Watersedge Trail.
Current Circumstances
This project is in the 2011 Capital Improvement Program. Because of the
poor condition of the subsurface infrastructure which includes sanitary sewer
and watermain, this area was not considered for pavement resurfacing. The
City continues to have utility issues which would not allow for the resurfacing
without significant potential repairs required within 10 years of the completion
of the work. The project requires special assessments and financing through
bond proceeds, and therefore requires the City to follow the requirements of
M.S. Chapter 429.
Conclusion
The Feasibility Report is the first step in the reconstruction process and will
provide the details needed for the City to make decisions on how to proceed.
The City is required to assess a minimum of 20% of the cost of a public
improvement project completed through the Chapter 429 process and

financed through G.O. bonds. The Feasibility Report will determine the
estimated costs of improvements and methods of financing. The Feasibility
Report will also determine if the assessment will meet the minimum
requirement as set forth in the Chapter 429 process.
The preparation of the Feasibility Report is only the first step in the public
improvement project process. Following receipt of the Feasibility Report, the
Council will direct City staff to abandon or proceed with the improvement
project, depending upon whether the requirements for the Chapter 429
process are being met. If the Chapter 429 process is to proceed, the Council
can then schedule a Public Hearing to consider resident feedback on the
project. Following a Public Hearing, the Council will consider whether to
move forward by authorizing the preparation of plans and specifications.
Once completed, the City Council will be asked to approve the plans and
specifications, authorize advertisement for bids and then award the contract.
Because this project is large in scale, construction will be completed over a
two year timeframe. The City is anticipating major sewer and watermain
improvements with this project. These deep utility repairs will require
considerable time to complete. The City is also planning to bond for the
improvements over two years.
FINANCIAL
IMPACT:
Rather than completing two separate projects for this neighborhood, City
staff is proposing to design and bid this neighborhood as one project to be
constructed over a two year timeframe. This approach assures that each
property owner pays the same assessment rate regardless of which year it
was constructed. While the Brooksville Hills project was completed under
two separate contracts, each project had a different assessment rate. The
Brooksville Hills assessment rates were fairly close; but because of the
distribution of houses in the Boudin's neighborhood, there is a higher risk of
dissimilar assessments. An economy of scale is another advantage to
designing and bidding as one project as it reduces the duplication of some of
the activities related to bidding a project. One disadvantage to bidding this
project as one project is that it will require additional consultant assistance.
The Feasibility Report will study the financial implications of completing the
project design and bidding as one project.
The financial impact of this project will be further analyzed in the Feasibility
Report. Preparation of the Feasibility Report will require surveying, sewer
televising, and soil borings. The costs for these items will be drawn from a
construction fund account specifically for this project. Staff will solicit quotes
for these services to be reviewed and approved by the City Council.
There are three alternatives for the City Council to consider:
1. Approve a resolution ordering preparation of a Feasibility Report for
2011-2012 street reconstruction for the Boudin's neighborhood.
2. Deny this item for a specific reason and provide staff with direction.
3. Table this item until some date in the future

A RESOLUTION ORDERING PREPARATION OF FEASIBILITY REPORT
FOR THE 2011 RECONSTRUCTION IMPROVEMENT PROJECT

WHEREAS, It is necessary to determine the feasibility of undertaking the construction of
improvements to Boudin Street, Denese Street, Grayling Circle, Lois Avenue,
Natalie Road, Rutgers Road, Timothy Avenue and Watersedge Trail including
the construction of storm sewer, sanitary sewer and watermain repairs,
aggregate base, concrete curb and gutter, bituminous surfacing, street lights,
and appurtenant work; and
WHEREAS, it is proposed to assess the benefited property for all or a portion of the cost of
the improvements, pursuant to Minnesota Statutes, Chapter 429,
NOW THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF PRIOR LAKE,
MINNESOTA as follows:
1. The recitals set forth above are incorporated herein.
2. That the proposed improvements be referred to the City Engineer for study and that the City
Engineer is instructed to report to the Council with all convenient speed advising the Council
in a preliminary way as to whether the proposed improvements are necessary, cost-effective
and feasible and as to whether they should best be made as proposed or in connection with
other improvements, and the estimated costs for the improvements as recommended.
3. The City Engineer is directed to solicit quotes for surveying, televising, and soil borings for
the project.
