HomeMy WebLinkAbout5H - Permitting Agreement with the Prior Lake Spring Lake Watershed District MEETING DATE: AGENDA #: PREPARED BY: PRESENTED BY: AGENDA ITEM: DISCUSSION: ISSUES: FINANCIAL IMPACT: 4646 Dakota Street SE Prior Lake, MN 55372 CITY COUNCIL AGENDA REPORT JULY 19,2010 5H STEVE ALBRECHT, DIRECTOR OF PUBLIC WORKS STEVE ALBRECHT CONSIDER APPROVAL OF A RESOLUTION EXTENDING THE PERMITTING AGREEMENT WITH THE PRIOR LAKE SPRING LAKE WATERSHED DISTRICT Introduction The purpose of this agenda item is to extend the existing permitting agreement with the Prior Lake Spring Lake Watershed District (PLSLWD). This agreement allows the City of Prior Lake to issue storm water permits for projects without requiring a second permit from the PLSLWD. Historv In 2007 the City of Prior Lake entered into permitting agreements with the PLSLWD and Scott WMO (Water Management Organization) for storm water permits. These agreements streamlined storm water permitting and reduced overlap among multiple jurisdictions. Current Circumstances The original agreement with PLSLWD will expire based on the adoption of the revised Water Resources Management Plan if it is not extended. At the June PLSWD meeting, its Board approved a two year extension to the agreement. Conclusion This agreement streamlines storm water permitting within the City of Prior Lake and reduces jurisdictional overlap. City staff believes this agreement and partnership is beneficial to the residents of Prior Lake and should be extended accordingly. Failure to extend the agreement would result in multiple storm water permits being required for projects in Prior Lake. This both increases project costs, timelines and permit compatibility issues. Since 2007 the City has been responsible for permitting and no additional costs are anticipated. Without the agreement PLSLWD costs would most likely increase impacting Prior Lake taxpayers due to increased staffing or consultant costs related to permits. Deny this Resolution RECOMMENDED Alternative #1 MOTION: Reviewed by: FD / VOL<: Frank Bo~es, City Manager 2 4646 Dakota Street SE Prior Lake, MN 55372 RESOLUTION 10-xxx A RESOLUTION EXTENDING THE MEMORANDUM OF AGREEMENT WITH THE PRIOR LAKE SPRING LAKE WATERSHED DISTRICT FOR LOCAL WATER PLANNING AND REGULATION Motion Second By: By: WHEREAS, In 2007 the City of Prior Lake entered into an Memorandum of Agreement with the Prior Lake Spring Lake Watershed District for permitting storm water activities; and WHEREAS, The agreement has streamlined the permitting process, reduced permitting costs and eliminating jurisdictional overlap which often resulted in confusion with regards to the project process; and WHEREAS, The current agreement will expire if not extended; and WHEREAS, The PLSLWD approved extension of the agreement for a period of two years at its June 2010 meeting. NOW THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF PRIOR LAKE, MINNESOTA as follows: 1. The recitals set forth above are incorporated herein. 2. The Mayor and City Manager are authorized to extend the agreement for a period of two years. PASSED AND ADOPTED THIS 19th DAY OF JULY, 2010.
