REQUIREMENTS FOR THE SUBDIVISION OF PROPERTY lOCATED IN
SECTION 23, TOWNSHIP 115, RANGE 22

DISCUSSION:
History: Joseph and Carolyn Kinney and Chuck and Carol Pavlish are the
joint owners of an 8-acre parcel of land located adjacent to Pike Lake on the
north side of CSAH 42 and west of Pike lake Trail in the North Y, of the
Southwest Yo of Section 23, Township 115, Range 22 (parcel 3 on the
attached survey). The Pavlish's also own a 12-acre parcel directly south of
the subject lot (parcel 4), while the Kinney's own a 14-acre parcel directly east
of the subject parcel (parcel 2). The attached letter explains the
circumstances of this ownership.
Current Circumstances: The property owners are proposing to dissolve
their joint ownership in parcel 3, and subdivide it into 2 separate 4-acre
parcels. This property is zoned ASD (Agricultural Shoreland District). There
is no sewer and water service available to this site. The minimum lot area for
parcels in the ASD District is 10 acres. In order to meet the minimum lot area,
each of the 4-acre parcels will be attached to the adjacent property.
The Issues: The subdivision of unplatted land (lands described by metes and
bounds) is regulated by Sections 1006.104 through 1006.106 of the City
Subdivision Ordinance. These sections state the following:
1006.104 Conveyance Bv Metes And Bounds. No division of one or
more parcels in which the land conveyed is described by metes and bounds
shall be recorded if the division is a subdivision, as defined by the Subdivision
Ordinance. Building permits will be withheld for buildings or tracts that have
been subdivided and conveyed by this method without City approval and the
City may refuse to take over tracts as streets or roads or to improve, repair or
maintain any such tracts.
1006.105 Exceptions. The provisions of Section 1006.104 do not apply
where all the resulting parcels, tracts, lots, or interests will be twenty (20)

acres or larger in size and five hundred feet (500) in width for residential uses
and least five (5) acres or larger in size for commercial and industrial uses.
1006.106 Council Resolution WaivinQ ReQuirements. In any case in
which compliance with the foregoing restrictions will create an unnecessary
hardship and failure to comply will not interfere with the purpose of this
Section, the Council may waive such compliance by the adoption of a
resolution to that effect and the conveyance may then be filed.
The 48 acres of land presently owned by the Kinney's and the Pavlish's
includes 4 lots of record. This proposed subdivision will eliminate one of
these lots. As they currently stand, one house may be built on each of the
parcels. To do anything more, the property must be platted and public
services extended. At that time, the City will prepare a Development Contract
and collect the appropriate development fees. Therefore, waiving the platting
requirements at this time will not interfere with the purpose of the Subdivision
Ordinance.
Conclusion: The staff recommends the City Council waive the platting
requirements and allow the property owners to convey a portion of parcel 3 to
each of the adjacent lots. As a condition of approval, the property owners
must submit a deed or a certificate of survey describing the entire combined
parcels.
FISCAL IMPACT:
BudQet Impact: There is no budget impact as a result of this proposal.
Al TERNA TIVES:
The City Council has three alternatives:
1. Adopt a resolution waiving the platting requirements and allowing the
property owners to convey a portion of parcel 3 to each of the adjacent
lots, subject to the listed condition.
2. Deny the resolution and require the property be platted.
3. Defer this item and provide staff with specific direction.
RECOMMENDED

RESOLUTION OF THE PRIOR LAKE CITY COUNCIL WAIVING THE PLATTING REQUIREMENTS AND
ALLOWING THE CONVEYANCE OF PROPERTY IN SECTION 23, TOWNSHIP 115, RANGE 22
MOTION BY:
SECOND BY:
WHEREAS: Joseph and Carolyn Kinney and Chuck and Carol Pavlish are the owners of property
located in Section 23, Township 115, Range 22: and
WHEREAS: The property owners have asked the City Council to waive the platting requirements for
this property and allow them to convey two parcels of land to the adjacent parcels; and
WHEREAS: Future subdivision of the property will require platting and the extension of City services,
including sewer and water; and
WHEREAS: the City Council has found that waiving the platting requirements for this conveyance will
not interfere with the purpose of the Subdivision Ordinance; and
WHEREAS: the City Council has approved the conveyance of this property by metes and bounds.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF PRIOR LAKE,
MINNESOTA:
1. The recitals set forth above are incorporated herein as if fully setforth.
2. The platting requirements are hereby waived.
3. The property owners may convey a portion of parcel 3 to each of the adjoining parcels.
4. Conveyance of this property is subject to the condition that the property owners submit a deed or a
certificate of survey describing the entire combined parcels.

Attached is a survey of 48 acres that Chuck and Carol Pavlish and
Carolyn and Joe Kinney bought from the Scherers in 1985. The four of us
formed a partnership and divided the 48 acres into 4 parcels that we
thought made best use of the land and lake because we were told by the
planning commission that we could only put 4 houses on the 48 acres but
that they could be side by side if we desired instead of each parcel being
1 0 acres or more. As a result, parcel #3 is only 8 acres.
Dear Council Members,
Chuck and Carol had first pick of parcels and chose #4 for their
building site, Carolyn and Joe chose parcel #2 and we held parcels 1 and 3
in partnership. Carolyn and Joe then sold their interest in parcel #1 to
Chuck and Carol, which left parcel #3 in joint partnership.
In the process of setting up a trust, Carolyn and Joe were told that
they would have to dissolve the partnership on the land, so we had the
remaining parcel in the partnership (parcel 3) divided into parcel # 3A and
#38. Then, we were told we couldn't obtain those parcels deeded without
going through the platting process. Neither the Pavlishes nor the Kinneys
have a desire to platt their land at the present time.
We would like, with the council's permission, to have the platting
process waived and have parcel 3A added to parcel #2 and parcel 38 added
to parcel #4 thereby eliminating parcel #3 and clearing the hurdle of the
land partnership for the Kinney trust.
