HUTCHINS, BUILDING OFFICIAL CONSIDER APPROVAL OF A RESOLUTION AMENDING THE MUTUAL AID AGREEMENT FOR USE OF BUILDING INSPECTION PERSONNEL AND EQUIPMENT TO INCLUDE SCOTT COUNTY Introduction The purpose of this action is to authorize the City to enter into a Mutual Aid Agreement with the County of Scott, City of Savage and the City of New Prague in order to provide equipment, personnel and facilities for Building Inspection Services of all or part of each others jurisdictions when neces- sary, and in return to receive similar services when necessary due to ser- vice demands or resources. This Agreement is intended to give each juris- diction the authority to send its equipment and personnel into the contract- ing jurisdiction. Historv On June 1, 2009 the City Council approved Resolution 09-084 entering into a mutual aid agreement with the City of Savage and the City of New Pra- gue to provide equipment, personnel and facilities for Building Inspection Services when necessary, and in return to receive similar services when necessary due to service demands or resources. The County of Scott would now like to join the three cities in a mutual aid agreement. Current Circumstances Due to the economic downturn the past couple of years, the building in- spection staff has experienced layoffs and restructuring. In March of 2008, the department was restructured from the Planning and Building depart- ments into the Building and Transportation Services department. The staff consists of Director of Building and Transportation Services Jane Kansier, Building Official Robert Hutchins, Building Inspector Paul Baumgartner, Code Enforcement Officer Jesse Corrow, and Development Services As- sistant Lynda Allen. The County of Scott has experienced the same type of slow down and through attrition has decreased their staff which now consists of one field inspector and one building official. The City of Savage has experienced the same type of slow down and through attrition has decreased their staff which now consists of one field inspector, one part time building inspector and one building official. The City of New Prague has a newly created in- house building inspection department. Their one full-time building official position is responsible for all plan review of permits and inspections of same. RICouncil\2010 Agenda Reports\08 16 10\201omutual aid AGENDA REPORT.doc Staff from the three cities and county met to discuss assisting each other in time of need for inspection services. When working with a small staff, there is the potential for situations in which one or more staff are on vacation, and the remaining staff member experiences an unexpected occurrence that would prevent the staff person from performing that day's field inspec- tion duties. Another situation may occur if there is an unexpected volume of permits requiring plan review. The mutual aid agreement allows each participant to call on the others for help. Conclusion Staff is recommending we amend the existing Mutual Aid Agreement with the City of Savage and the City of New Prague to provide equipment, per- sonnel and facilities for Building Inspection Services when necessary, and in return receive similar services when necessary due to service demands or resources to include Scott County. ISSUES: There is the potential for one of the cities to over use the services of the other three cities. If that would occur, each city would need to make a de- termination on staff constraint with their workload at that time. The staff does not anticipate mutual aid to be utilized often. The City Attorney has reviewed and approved the agreement. FINANCIAL IM- PACT: There is no General Fund impact for this action. AL TERNATIVES: 1. Motion and second to adopt a Resolution authorizing a mutual aid agreement for use of building inspection personnel and equipment. 2. Defer this item and provide staff with direction. RECOMMENDED MOTION: The staff recommends Alternative #1. MN 55372 RESOLUTION 10-xxx A RESOLUTION AMENDING THE MUTUAL AID AGREEMENT FOR USE OF BUILDING INSPECTION PERSONNEL AND EQUIPMENT TO INCLUDE SCOTT COUNTY Motion By: Second By: WHEREAS, The City Building Inspections staff consists of one field inspector and one building official both of whom are available for daily field inspections; and WHEREAS, The County of Scott, the City of Savage and the City of New Prague have similar staff sizes; and WHEREAS, All four entities could have an situation where they may need assistance from the other governmental agencies; and WHEREAS, The four governmental agencies are willing to enter into a Mutual Aid Agreement for use of building inspection personnel and equipment. NOW THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF PRIOR LAKE, MINNESOTA as follows: 1. The recitals set forth above are incorporated herein. 2. The Mayor and City Manager are authorized to enter into the amended Mutual Aid Agreement with the County of Scott, City of Savage and the City of New Prague in order to provide equipment, personnel and facilities for Building Inspection Services of all or part of each other's jurisdictions when necessary, and in return to receive similar services when necessary due to service demands or resources. 3. MN 55372 CITY COUNCIL AGENDA REPORT AUGUST 16, 2010 51 JANET RINGBERG, LICENSE CLERK FRANK BOYLES, CITY MANAGER CONSIDER APPROVAL OF A TEMPORARY ON-SALE LIQUOR LICENSE FOR PRIOR LAKE ATHLETICS FOR YOUTH (PLAY) Introduction The purpose of this agenda item is to consider approval of a temporary on- sale intoxicating liquor license for Prior Lake Athletics for Youth (PLAY). Historv State statute allows non-profit organizations to apply for temporary liquor li- censes as a means to raise funds for their organizations. Temporary licenses may be issued for up to four consecutive days. The City may not issue more than three (3) four-day temporary license, four (4) three day licenses, six (6) two day licenses, or twelve (12) one day license, in any combination not to exceed 23 days per year to anyone organization or for anyone location. No more than one temporary license may be issued to anyone organization or for anyone location within any 30-day period, unless the licenses are issued in connection with an official community event. Current Circumstances PLAY is planning its third annual volunteer appreciation and fundraising event for Saturday, September 11, 2010, at Ponds Park from 5:00 p.m. until 11 :00 p.m. They are applying for a one day temporary on-sale intoxicating liquor license in order to sell margaritas at this event. PLAY has also been approved for an outdoor event permit in order to have amplified music at this event. Conclusion The Prior Lake Police Department has completed an investigation of this ap- plicant to ensure that all requirements and issues concerning public safety and compliance have been met. PLAY has provided proof of liquor liability insurance for this event. PLAY has paid a license fee of $25.00 for this event. 1.
