PEDESTRIAN UNDERPASS ON CSAH 82
HISTORY
CSAH 82 from CSAH 21 to CSAH 17 is in both the City of Prior Lake
and Scott County Capital Improvement Programs (CIP) to be
reconstructed in 2004 and 2005. Scott County has entered into a contract
with TKDA to complete the plans and specifications for the CSAH 82
project. Funding for this project will be through a cooperative agreement
between the City of Prior Lake and Scott County. The City's estimated
share of the cost for street and utilities is $3,000,000.
A public informational meeting was held on April 29, 2003. Several
comments were received regarding trails and pedestrian safety. In
addition, the Public Works Director received a letter regarding pedestrian
safety that is attached to this report. The County has identified one
additional traffic signal to be constructed at the CSAH 82/CSAH 83
intersection in conjunction with this project. Staff felt that an additional
pedestrian crossing should be considered along CSAH 82 between CSAH
21 and CSAH 83 and requested a proposal from TKDA to prepare a
feasibility study that will investigate two potential locations for a
pedestrian underpass.
CURRENT CIRCUMSTANCES
On October 3, 2003, the City received a proposal for the work described
above in the amount of $16,500. TKDA proposes to prepare a feasibility
study that evaluates two locations for a potential pedestrian underpass.
The sites are located east of Drake Avenue and West of Wilds Parkway.
The feasibility study includes a preliminary design of the underpass,
impacts on the proposed storm sewer and other utilities, and a preliminary
design of trail connections. The detailed proposal is attached to this
report.

Staff recommends that the City Council authorize TKDA to complete the
feasibility study of the CSAH 82 underpass.
ISSUES:
The proposal is for a feasibility study and preliminary design. The fee
does not include final design costs. TKDA will not provide final design
costs until the study is complete and impacts to other utilities is
determined. The final project cost for the underpass is estimated at
$150,000, including construction and design costs which will be the
City's responsibility.
FINANCIAL IMPACT: The funding for the feasibility study is proposed from the Collector Street
Fund.
ALTERNATIVES:
There are two alternatives for the City Council to consider:
1. Approve a resolution that authorizes the City to enter into its standard
professional services contract with TKDA to provide engineering
services for the CSAH 82 pedestrian underpass feasibility study for a
fee not to exceed $16,500.00.
2. Deny this item for a specific reason and provide staff with direction.

A RESOLUTION APPROVING TOLTZ, KING, DUVALL, ANDERSON & ASSOCIATES, INC. TO
PREPARE A FEASIBILITY STUDY FOR THE CSAH 82 PEDESTRIAN UNDERPASS

WHEREAS, Scott County has retained Toltz, King, Duvall, Anderson & Associates, Inc. (TKDA) to
prepare plans and specifications for CSAH 82 improvements; and
WHEREAS, the City of Prior Lake identifies the CSAH 82 improvement project in the 2005 Capital
Improvement Program; and
WHEREAS, the City's 2020 Vision and Strategic Plan identifies the pedestrian safety as a high
priority.
NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF PRIOR LAKE, MINNESOTA,
THAT:
1. The recitals set forth above are incorporated herein.
2. The Mayor and City Manager are hereby authorized to enter into a contract with TKDA in the
name of the City of Prior Lake for the CSAH 82 Pedestrian Underpass Feasibility Study in the
amount not to exceed $16,500.00.
3. The source of funding for this project will come from the Collector Street Fund.

Dear Ms. McDermott:
Pursuant to communications with you, we propose to provide Engineering Services in
connection with a Feasibility Study for a Pedestrian Underpass in conjunction with Scott
County's CSAH 82 Project, hereinafter called the Project.
Our services will be provided in the manner described in this Proposal subject to the terms and
conditions set forth in the attached "General Provisions of Architect-Engineer Agreement" dated
October 1993. Hereinafter, the City of Prior Lake is referred to as the OWNER.
I. PROJECT DESCRIPTION
The OWNER desires a study of the feasibility of incorporating a pedestrian underpass into
proposed Scott County project on CSAH 82. The study will investigate a potential underpass
under CSAH 82 at two locations identified by the OWNER. These locations are east of Drake
Avenue NW at proposed CSAH 82 Station 144+00 and west of Wilds Parkway at Station
121+50.

II. SERVICES TO BE PROVIDED BY TKDA
Based on TKDA'S understanding of the Project, we propose to provide the following services:
A. INVESTIGATION
TKDA will investigate the feasibility of constructing a pedestrian underpass at the two
locations described in SECTION I. For each location, perform the following tasks:
I. Create a preliminary design of the underpass including plan and end cross section
view.
2. Determine the impact of the proposed underpass on the proposed CSAH 82 storm
sewer. This includes creating an alternative storm sewer design concept.
3. Determine the impact of the proposed underpass on the inplace and proposed
CSAH 82 utilities.
4. Create a preliminary design of the connections to the northerly trail and southerly
path based on tie-in points specified by the OWNER. This design will include a
plan, profile, cross sections, and construction limits of the proposed trail/path
connections.
B. COST ESTIMATE
Develop an opinion of probable construction cost for each of the two underpass
alternatives.
III. ADDITIONAL SERVICES
If authorized by you, we will furnish or obtain from others Additional Services of the types listed
below which are not considered as basic services under this Proposal. Additional Services shall
be billable on an Hourly Rate basis as defined in Article 3 ofthe General Provisions, and such
billings shall be over and above any maximum amounts set forth in this Proposal.
A. Analysis of any site other than the two locations specified in SECTION I.
B. Detail design of the box culvert, trail connections, utility relocations, or retaining walls.
C. Additional field surveys or designer site visits.

D. Geotechnical analysis that may be required (to locate ground water elevation, muck, etc.).
E. Additionaltraffic analysis, right-of-way platting, environmental documentation, or public
participation.
F. Alignments, profiles, and cross sections for trail connections other the proposed CSAH
82 northerly trail and southerly path.
G. Construction phase services.
N. OWNER'S RESPONSIBILITIES
The OWNER'S responsibilities shall be as set forth in Article 8 of the General Provisions and as
further described or clarified hereinbelow:
A. Designate one individual to act as the OWNER'S representative with respect to the work
to be performed, and such person shall have complete authority to transmit instructions,
receive information, interpret and define policies, and make decisions with respect to
critical elements pertinent to the Project.
B. Provide reviews of materials furnished by TKDA in a reasonable and prompt manner so
that the Project schedule can be maintained.
C. Desired size and use for the underpass (pedestrians vs. bikes vs. mixed-use).
V. PERIOD OF SERVICE
We would expect to start our services promptly upon receipt of your acceptance of this Proposal
and to complete SECTION II services within five weeks.
VI. COMPENSATION
Compensation to TKDA for services provided as described in SECTION II of this Proposal
shall be on an Hourly Rate basis as described in Article 3 of the attached General Provisions in
an amount not to exceed $16,500. Our detailed Project Fee Estimate and current Hourly Rate
Schedule is attached.

The level of effort required to accomplish SECTION II services can be affected by factors
which are beyond our control. Therefore, if it appears at any time that charges for services
rendered under SECTION II will exceed the above, we agree that we will not perform services
or incur costs which will result in billings in excess of such amount until we have been advised
by you that additional funds are available and our work can proceed.
VII. CONTRACTUAL INTENT
We thank you for the opportunity to submit this Proposal and are willing that this letter and
attachments constitute a contract between us upon its signature by an authorized official of City
of Prior Lake and the return of a signed copy to us. This Proposal will be open for acceptance
for 60 days, unless the provisions herein are changed by us in writing prior to that time.

3. Outside professional and technical services with costs defined as the amount billed
TKDA plus 10%.
4. Identifiable reproduction and reprographic costs.

** For hours worked over 8 hours per day or 40 hours per week, whichever is greater,
individuals will be paid one and one-half times the above rates where required by Local,
State and/or Federal Government Wage and Hour Regulations.

Dear Mr. Osmundson:
Since moving to Prior Lake in 2000 and buying a townhouse in the Glynwater
South addition, we have become more and more aware of the hazards of Co. Rd. 82
and the lack of foot and bike access to the downtown Prior Lake area. It is well within
walking distance from our townhouse on the South side of 82 to the Wagon Bridge,
library, city government offices, etc., but impossible to get to safely since 82 is very
busy and the new GlynWater Park does not provide access to 21. We hope your input
to TKDA, Greg IIkka, the Shakopee Mdewakanton Sioux Community, and other Prior
Lake park and city officials will prompt them to take our concerns into consideration.
Prior Lake, with its many lakes and parks has the potential of becoming a truly
beautiful, well-planned community. It is our hope that the final design of Co. Rd. 82 will
be safe, functional, and aesthetically pleasing, with as little infringement as possible
on the private properties abutting it.
