HomeMy WebLinkAbout9B - Traffic Signal at Commerce MEETING DATE: AGENDA # PREPARED BY: AGENDA ITEM: DISCUSSION: CITY COUNCIL AGENDA REPORT October 20, 2003 9B Bud Osmundson, Director of Public Works CONSIDER APPROVAL OF A RESOLUTION (1) AUTHORIZING THE MAYOR AND CITY MANAGER TO ENTER INTO A TRAFFIC CONTROL SIGNAL AGREEMENT WITH MNDOT, THE CITY OF SAVAGE, AND SCOTT COUNTY FOR THE INSTALLATION, OPERATION AND MAINTENANCE OF A TRAFFIC SIGNAL ON STATE TH 13 AT THE INTERSECTION OF BOUDIN STREET, COMMERCE AVENUE, AND SOUTH PARK DRIVE; AND THE TEMPORARY TRAFFIC SIGNAL AT CH 42 & TH 13, and (2) AUTHORIZING PAYMENT TO MNDOT FOR STATE FURNISHED MATERIALS FOR THE BOUDIN/COMMERCE/SOUTH PARK SIGNAL. The Boudin/Commerce/South Park intersection with TH 13 is now complete and the signal is operating. MnDOT has requested that the Cities of Prior Lake and Savage enter into the attached Traffic Control Signal Agreement for the operation and maintenance of this signal. The agreement also covers the installation and maintenance of a temporary signal system at CH 42 and TH 13, which was installed with the same project. Our previous Cooperative Agreement with Savage outlined that the costs of the installation of the B/C/South ParkfrH 13 signal be split 50/50. The purpose of this agenda item is to approve Traffic Control Signal Agreement No. 85606R between MnDOT, the City of Savage, and Scott County and to authorize a lump sum payment of $9,500 for State furnished materials for the signal. This agreement is a standard MnDOT agreement, which we are a party to at other intersections within the City. It outlines the responsibilities for maintenance and providing electrical power. MnDOT is responsible for major maintenance such as repair needed due to knockdowns and operations of the signal including timing, at both the B/C/South ParkfrH 13 and the CH 42frH 13 signals. The Cities are responsible for electrical power, maintenance of the luminaries (the lighting), the replacement of the signal light lamps, and painting of the poles on the B/C/SPfrH 13 signal. The County is responsible for all of the above maintenance items on the CH 42frH 13 signal, and through a previous agreement with Savage, the City of Savage pays for the electrical power costs. The City of Savage has paid for the electrical power costs for the CH 42/TH 13, and the Rutgers/CH 42 signal lights in the past. Now with the addition of the B/C/South ParkfTH 13 signal they have requested that the two Cities enter into a separate agreement to share in the cost of providing electrical power and maintenance of the 3 signal lights since they are on our common borders. B5606R WITH MNDOT, THE CITY OF SAVAGE, AND SCOTT COUNTY FOR THE INSTALLATION, OPERATION, AND MAINTENANCE OF A SIGNAL SYSTEM AT TH 13 AND BOUDIN/COMMERCE/SOUTH PARK AND A TEMPORARY SIGNAL SYSTEM AT CH 42 AND TH 13 MOTION BY: SECOND BY: The City of Savage and the City of Prior Lake have mutually agreed that improvements were needed on Trunk Highway 13 (TH13) at the Boudin Street/ Commerce Avenue/ South Park Drive intersection, and Through a Cooperative Agreement between the two Cities, permanent improvements to this intersection including a signal light, concrete medians, and other appropriate safety improvements, have been constructed, all at the Cities' cost, and A temporary signal has been constructed at County State Aid Highway at TH 13 as part of the same project, and The City of Prior Lake and the City of Savage have been asked to contribute a lump sum of $9,500 each toward the cost of State furnished materials for the total project, and MnDOT has requested that the City of Prior Lake, the City of Savage, and Scott County enter into a Traffic Control Signal Agreement outlining the responsibilities for the installation, operation, and maintenance of the two signal systems on this project. NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF PRIOR LAKE, MINNESOTA, that: 1. The recitals set forth above are incorporated herein. 2. The City enter into a Traffic Control Signal Agreement with the State of Minnesota Department of Transportation, the City of Savage, and Scott County for the following purposes, to wit: · To install a new traffic control signal with street lights, emergency vehicle pre-emption, interconnect and signing on Trunk Highway No. 13 at South Park Drive/Boudin Street/Commerce Avenue; and remove an existing traffic signal system and replace with a temporary signal system on Trunk Highway No. 13 at County State Aid Highway No. 42 in accordance with the terms and conditions set forth and contained in Agreement No. 85606R, a copy of which was before the City Council. RECITALS Minnesota Statutes Section 161.20 authorizes the Commissioner of Transportation to enter into agreements with any governmental authority for the purposes of constructing, maintaining and improving the Trunk Highway system_ The parties desire to install new traffic control signals including street lights, interconnect and signing, (Traffic Control Signal(s)) on Trunk Highway No. 13.at South Park Drive/Boudin Street/Commerce Avenue [Permanent Signal System] and remove an existing traffic control signal system and replace with a temporary traffic control signal system including street lights, interconnect, video cameras, and signing, (Traffic Control Signal(s)) on Trunk Highway No. 13 at County State Aid Highway No. 42 [Temporary Signal System]. The City of Savage requests and the State agrees to the installation of Emergency Vehicle Pre-emption Systems, (EVP System(s)), as a part of the Permanent Signal System and the Temporary Signal System. It is in the public's best interest for the State to provide a new cabinet and controller (State-furnished Materials) 85606R -2- for the Permanent Signal System and a temporary cabinet and controller for the Temporary Signal System. The City of Savage, the City of Prior Lake, the County, and the State will participate in the maintenance and operation of the new Traffic Control Signals and EVP Systems. CONTRACT 1. The City of Savage will prepare the necessary plan, specifications and proposal, (Preliminary Engineering) . The City of Savage will also perform all necessary construction inspection, (Construction Engineering) . 2. The City of Savage with its own resources or by contract will install a new Traffic Control Signal and EVP System on Trunk Highway No. 13 at South Park Drive/Boudin Street/Commerce Avenue [Permanent Signal System] and remove an existing traffic control signal system and replace it with a temporary traffic control signal system including street lights, interconnect, video cameras, and signing, on Trunk Highway No. 13 at County State Aid Highway No. 42 [Temporary Signal System] pursuant to the plans and specifications for City Project Nos. 01-07 and 03-04 (Savage) and State Aid Project No. 201-010-02 (Prior Lake) all at the cost and expense of the City of Savage and the City of Prior Lake. 3. The State will furnish materials to be installed with the City of Savage and the City of Prior Lake work provided 85606R -3- in Paragraph 2. The lump sum cost for the State-furnished Materials for the Permanent Signal System is $19,000.00. The City of Savage's and the City of Prior Lake's share of the cost of State-furnished Materials is 50 percent, $9,500, each. 4. The City of.Savage has requested and the State has agreed to provide, at no cost, a temporary cabinet and controller for the Temporary Signal System. The City of Savage shall return the cabinet and controller undamaged to the State when the permanent signal system at Trunk Highway No. 13 and County State Aid Highway No. 42 is installed. 5. Upon execution of this agreement and receipt of State's written request, the City of Savage and the City of Prior Lake will make a payment to the State of their share of the lump sum amount as specified in Paragraph 3. 6. The construction work will be under the direction and supervision of the City of Savage. The State will have the right to periodically inspect the construction work. 7. The City of Savage will be responsible for the cost and application to secure an adequate power supply to the service pad or pole and pay all monthly electrical service expenses necessary to operate the Permanent Signal System and Temporary Signal System, luminaires, and EVP Systems. 8. Upon completion of this project [Permanent Signal System], the City of Savage will, at its cost and expense: (1) maintain the luminaires and all its components, including 85606R -4- replacing the luminaire when necessary; (2) relamp the new traffic control signal; and (3) clean and paint the new traffic control signal and luminaire mast arm extensions. The State will, at its cost and expense, be responsible for major maintenance, operation (including timing), and perform all other traffic control signal maintenance. 9. Upon completion of this project [Temporary Signal System], the City of Savage will, at its cost and expense, maintain the luminaires and all its components, including replacing the luminaire when necessary and painting the mast arm extensions. The County will, at its cost and expense, relamp the temporary traffic control signal and be responsible for maintaining the video detection system. The State will, at its cost and expense, perform all other traffic control signal maintenance 10. The EVP System will be installed, operated, maintained, or removed in accordance with the following conditions and requirements: a) All maintenance of the EVP System (Permanent Signal System and Temporary Signal System) including timing, will be performed by the State. b) Emitter units may be installed only on authorized emergency vehicles, as defined in Minnesota Statutes Section 169.01, 85606R -5- Subdivision 5. Authorized emergency vehicles may use emitter units only when responding to an emergency. The City of Savage will provide the State's Assistant District Engineer or his/her designated representative a list of all vehicles with emitter units. c) Malfunction of the EVP System must be reported to the State immediately. d) In the event the EVP System or its components are, in the opinion of the State, being misused or the conditions set forth in Paragraph b above are violated, and such misuse or violation continues after the City of Savage receives written notice from the State, the State may remove the EVP System. Upon removal of the EVP System pursuant to this Paragraph, all of its parts and components become the property of the City of Savage. 11. Each party will be solely responsible for its own acts and omissions, and the results thereof, to the extent authorized by law. The State's liability is governed by the Minnesota Tort Claims Act, Minnesota Statutes Section 3.736. Minnesota Statutes Chapter 466 and other applicable law govern 85606R -6- liability of the County. Each party will be solely responsible for its own employees for any Workers Compensation Claims. 12. Any amendment to this Agreement must be in writing and will not be effective until it has been executed and approved by the same parties who executed and approved the original Agreement, or their successors in office. 13. If the State fails to enforce any provisions of this Agreement, that failure does not waive the provision or its right to enforce it. 14. This Agreement contains all negotiations and agreements between the parties. No other understanding regarding this Agreement, whether written or oral, may be used to bind either party. 15. Minnesota law governs this Agreement. Venue for all legal proceedings arising out of this contract, or its breach, must be in the appropriate state or federal court with competent jurisdiction in Ramsey County, Minnesota. 16.
