o~ P~~+P H U 4646 Dakota Street SE ~Nxsso~A Prior Lake, MN 55372 CITY COUNCIL AGENDA REPORT MEETING DATE: OCTOBER 4, 2010 AGENDA #: 10C PREPARED BY: ROSS BINTNER, WATER RESOURCES ENGINEER PRESENTER: ROSS BINTNER, WATER RESOURCES ENGINEER AGENDA ITEM: CONSIDER APPROVAL OF A RESOLUTION APPROVING PLANS AND SPECIFICATIONS AND AUTHORIZING ADVERTISEMENT FOR BIDS FOR THE 2011 WATER QUALITY MAINTENANCE AND RETROFIT PROJECT (CITY PROJECT #11-012) DISCUSSION: Introduction The purpose of this agenda item is to seek approval from the City Council for the plans and specifications and authorize advertisement for bids for the 2011 Water Quality Pond Maintenance Project (#11-012). History The City of Prior Lake owns the majority of the storm water conveyance and treatment systems in the City that provide flood protection and water quality treatment of rainwater runoff. Periodic maintenance is required to keep the system in good working order, and maintain the mandated average designed level of service for pollutant removal. The City of Prior Lake inspects its entire storm water system on a 3-5 year rotating basis. The result of these inspections trigger minor maintenance work that is completed annually by City Staff. Inspections also lead to large full maintenance projects which occur biennially (currently every odd year). On June 7, 2010, Council accepted quotes and authorized surveying and testing in preparation for the City's biennial water quality maintenance project. On August 17 2010, City Staff held a public informational meeting, offering residents affected by the project, the opportunity to comment on the proposed plans. At the open house, 10 people were present. City Staff explained the proposed design and took comments on the proposed plans. The informational meeting resulted in several site visits to review site specific issues, and draft plans were again shared with residents. Current Circumstances In addition to the typical storm sewer, pond excavation, turf establishment, tree planting, erosion control, and appurtenant work associated with major maintenance, this project includes modifying outlet control structures and creation of outlet filtration system. This is the first time a maintenance project will be fully paired with system retrofit to add additional treatment capacity to the system. The construction of this project is proposed to be funded through the Water Quality Utility Fund. http:l/finance1/teams/am/October 4 2010/October 4, 2010/2011 Water Quality Agenda.doc Maintenance of City water quality ponds entails the winter excavation of years of collected muck and sediment. This material is left over from sediment and nutrient laden water flowing to the pond over the course of its design life. As a pond continues to fill,. its effectiveness at reducing further pollutant decreases until it must be restored to its original design volume. In addition to restoring water quality ponds to their design volume, vegetation restoration and pipe repairs are planned. While the majority of work will take place in the winter months, some spring vegetation planting and turf establishment is planned. Retrofit of the water quality system includes re-plumbing portions of the system, creation of new outlet structures and pipes, and creation of outlet filtration systems. This portion of the project is part of a federal 319h grant titled "Assessing Iron Enhanced Sand Filtration Trenches" and is eligible for state and local grant funding. Staff has applied for a variety of state and federal grants and sought partnerships with the Prior Lake Spring Lake Watershed District, Scott Soil and Water Conservation District, and the University of Minnesota as part of this project. While the final grant amounts are not yet available, there is significant interest in the maintenance and retrofit approach used by this project and the innovative technologies it installs. Conclusion At this point the project design is complete and it is appropriate to seek City Council authority to advertise for bids. A copy of the plans and specifications is available in the Engineering Department for review. Once the bids are received, City Staff will present the bids to the City Council for award. If the bids received are. higher than expected, the City Council can elect not to move forward with awarding a contract. ISSUES: Contamination Three ponds scheduled for maintenance have PAH contamination to the extent that sediment from these sites must be disposed of in a permitted landfill. Bid prices from the 2009 project indicated about a 30-50% maintenance cost premium should be anticipated on these sites. Grants The following grants and partnerships have been sought: • $398,000 Federal 319h (includes local and state partner project commitments.) • $124,900 Board of Water and Soil Resource (BWSR) Watershed partnership, 2011 State comprehensive competitive grant. • $25,000-$50,000 BWSR 2010 Anoka Directed Clean Water Fund (Subwatershed Storm water Retrofit Program). • $50,000 Prior Lake Spring Lake Watershed District partnership project. The 319h grant added a water quality study to the scope of the project. The watershed .partnerships and Anoka Directed grant could possibly displace local funding and modify the scope of the project. Additional City Council actions may be required to accept grant funding and modify the scope of the project if pending applications are successful. http:llfinance1/teams/amlOctober 4 201010ctober 4, 201012011 Water Quality Agenda.doc 2 Park Restoration Restoration of Westbury Park (Site 15) is planned to include the City's second prairie restoration site. Costs for initial prairie seeding and the 5 year maintenance effort required for successful establishment are not included in the resolution, but will instead be included in the utility budget process. This item will be discussed in detail at an upcoming Parks Advisory Committee meeting. FINANCIAL This project will be funded through the City Water Quality utility, capital IMPACT: outlay budget item #49420-530. The bid is set up to provide the maximum water quality benefit on the selected sites, under the water quality capital improvement budget of $350,000. The bid is structured to have a "base bid" and a variety of "alternate bid" items. The order of alternates is structured to perform the most cost effective projects first. If the low bid includes one or more of the alternate bid items priced over the budgeted amount of $350,000 those alternates can be dropped from the 2011 project, or with potential grant funds, a decision could be made to add to the project budget. ALTERNATIVES: The alternatives are as follows: 1. Approve Resolution 10-XXX approving plans and specifications and authorizing advertisement for bids for the 2011 Water Quality Maintenance and Retrofit Project (#11-012). 2. Deny this item for a specific reason and provide staff with direction. 3. Defer this item until a future date. The recitals set forth above are incorporated herein. 2. The plans and specifications for the 2011 Water Quality Pond Maintenance Project #11-012, a copy of which is attached hereto and incorporated by reference herein, are hereby approved. 3. The City Manager shall prepare and cause to be inserted in the official newspaper of the City and in the Construction Bulletin an advertisement for bids for the making of the improvement pursuant to the attached plans and specifications. The advertisement shall be published not less than 21 days prior to the bid opening, shall specify the work to be done, and shall state that the bids will be received by the City Manager at which time the bids will be publicly opened at City Hall at 4646 Dakota Street SE by the City Engineer. No bids will be considered unless sealed and filed with the City Manager and accompanied by a cash deposit, cashier's check, bid bond, or certified check payable to the City of Prior Lake in the amount of five (5) percent of the amount of such bid. 4.
