Call to Order Troy Presley convened the meeting at 7:34 a.m. Present were: Troy Presley, Terry Gutowski, Mike Myser, Joe Passofaro, Danette Parr, Mary Viereck, Sandi Fleck, Adam Blahnik and Frank Boyles. Parr commented that Ron Ceminsky has resigned and Bob Facente has a Thursday conflict. 2. Approval of July 29, 2010, Meeting Minutes. A motion was made by Fleck, seconded by Passofaro to approve the minutes as presented. The motion carried. 3. Old Business a. Upcoming Events The Community Fall Fest will be September 20; two people are needed to represent the committee. (Troy Presley, Joe Passofaro) Passofaro said he would be at another booth, but he would be stopping by. One person needed at the Farmer's Market from 7:45 -10 a.m. Presley said he would cover the Farmer's Market from 10 a.m. -Noon. Chair Howard indicated that she and Adam Blahnik had attended the Farmer's Market before. If there are insufficient members available, the date can be changed or the plan cancelled. b. Upcoming Meet and Greet Event Joe Passofaro reported on planning for the Meet and Greet Considerable discussion commenced on the location of the event. The EDAC decided to conduct it at the Wild's beginning at 5 p.m. Start with social time followed by a short presentation and solicitation of business input. Plan to finish by 7 p.m. Finger foods will be served. Drink prices will be discounted. We will use the full banquet room. Marketing efforts will include the Chamber Email Blast, the Fall Fest and the Farmers Market The committee agreed to request RSVPs. Passofaro said he would draft and circulate a flyer to be distributed in paper and electronic form for committee comment. c. Top Six Concerns Parr said she needed input from members. Presley said committee input should be received by the September 30 meeting. The staff will prepare draft comments addressing the six areas. CR 21 Update Parr explained the Maxfield Study on the three CR 21 road improvement alternatives for downtown. Viereck said when the invites go out, people should respond to the EDAC. Pair said she needed to check with Maxfield on the responses. Six options for dates were provided and Maxfield said they would visit businesses or interview at a mutually agreed upon location. b. Discuss C-2 General Business Commercial District -Alcohol Parr said that no alcohol is allowed in C-1; C-2 can serve alcohol but only if it is 100 feet or more from a residential district. From an economic development perspective, we deal with it again and again. (Also, 300 feet from church or school, which is a distance we cannot change}. Described permitted, permitted with conditions, and CUP. Described CUP hearing/appeal process. Parr cited examples (Crossroads, Boudins, Old Snyder/NAPA site). Said the problem is that the 100-foot situation applies to all. Current restrictions are: 500-foot outdoor liquor services restricted to 7 a.m. - 10 p.m. Would the same time limit be appropriate for an indoor liquor license within 100 feet of residential? Parr: Thinking about keeping the 100-foot limitation and allow from 7 - 10 or 11 p.m. service hours. Passofaro: Questioned the 100-foot distance. Parr: Stated she tried to find out the rationale for 100 feet. Talked to a previous Planning Commission Chair. Passofaro: Suggested 75 feet with hours. Blahnik: Said rules are overly restrictive. Does not like pushing businesses away. Presler: Said NAPA had a good idea building the entry away from the residential area to minimize impacts to residential property. Passofaro: Said it is a good point to consider where the noise is emanating from. Myser: Asked what goals and objectives we are attempting to accomplish. Gutowski: Be fair to residents, but encourage business. Fleck: Retain small town with businesses and house within walking distance. Parr: Would like feedback by September 20. Gutowski: Too restrictive. Passofaro: Outlyers should not be listened to since they knew the business was there could destroy what a resident is used to. Myser: On the other hand -new development. Presler: Asked about the measurement of the 100 feet. Maybe measure from the source of noise emanation rather than the building envelope. Gutowski: Sees landlords giving space away and is concerned these restrictions will force business elsewhere. Passofaro: Need to give business an opportunity to thrive. Maybe look at noise emanation. Time -say 11 or 11:30 p.m. Keep measure but use main entrance. Supports distance/time based upon emanation source. Motion by Passofaro, seconded by Viereckto remove the 100 foot restriction and have hours of operation to 11 p.m. 5. New Business EDA and EDAC bylaws Boyles provided a status report on bylaws revision. Myser provided talking points. Next meeting will be Thursday, September 30 at 7:30 a.m. Motion by Gutowski, seconded by Passotaro to adjourn. The meeting adjourned at 8:59 a.m.
