HomeMy WebLinkAbout8A - 2001 Improvement Project DATE: AGENDA #: PREPARED BY: SUBJECT: DISCUSSION: CITY COUNCIL AGENDA REPORT MARCH 19, 2001 8A SUE MCDERMOTT, CITY ENGINEER NEIGHBORHOOD INFORMATIONAL MEETING FOR 2001 PUBLIC IMPROVEMENT PROJECT AND CONSIDER APPROVAL OF A RESOLl-l,.TION ORDERING THE IMPROVEMENTS. \ 0/-l0 HISTORY On January 22, 2001 a public hearing was held for the 2001 Improvement Project to determine if plans and specifications should be prepared for Council consideration. The 2001 Improvement Project includes reconstruction of Evanston Avenue, St. Paul Avenue, Jordan Avenue, Minnesota Street, Dakota Street, Oak Street, and Memorial Trail including sanitary sewer, water main, storm sewer, aggregate base, concrete curb and gutter, bituminous surfacing, sidewalk and appurtenant work. The City Council adopted Resolution 01-05 authorizing the City Engineer to prepare plans and specifications for the improvements. The Council also directed staff to hold an informational meeting to address the following issues that were raised at Public Hearing: 1. Assessment method: unit versus front footage 2. Sidewalks 3. Tree replacement 4. Alleys 5. Memorial Trail: one-way versus two-way traffic Attached is a one-page summary addressing each of the issues raised by the neighborhood. A copy of this position paper will be distributed to the public at the informational meeting. CURRENT CIRCUMSTANCES The special assessment committee met on February 22, 2001 to discuss the five issues. Notes from the meeting are attached summarizing the assessment committee's recommendations. In addition, the Council requested a parcel-by-parcel assessment method comparison. A draft assessment roll is attached to this report that shows each property's proposed assessment utilizing the front footage and unit methods as well as each property's estimated market value based on information from the Scott County Assessor's office. The properties highlighted in blue represent the parcels located on Oak Street and a portion of Evanston Avenue that would be assessed 100% as a first time improvement. This resolution is required by Minnesota Statues, Chapter 429 and requires a four- fifths vote. Passing this resolution does not authorize the construction of the project. The Council has opportunities to cancel this project when it is brought back for approval of plans and specifications and award of contract. A flow chart summarizing the steps in the M.S. 429 process is attached to this report. ISSUES The purpose of this informational meeting is to address the issues that were raised at the public hearing. A summary of the special assessment committee's recommendations is as follows: 1. Retain the front footage method of assessment. 2. Sidewalks should be constructed beginning at CSAH 44 down Jordan Avenue to Minnesota Street to Evanston Avenue to CSAH 21. Sidewalk constructed on the south side of Memorial Trail will be aligned so as to avoid tree removal. 3. Tree replacement should be handled as in the past. Staff will work with property owners to replace trees that are removed on private property. 4. Staff will discuss installation of curb cuts at the alley locations or vacation of the alleys. 5. Memorial Trail is proposed to be constructed to a 20-foot width and can be signed or striped for two-way or one-way traffic. AL TERNA liVES: There are two alternatives for the City Council to consider: 1. Direct staff to continue with preparation of plans and specifications based on the recommendations of the Special Assessment Committee, and pass the attached resolution that orders the 2001 Improvements. 2. Direct staff to continue with preparation of plans and specifications with amended recommendations. RECOMMENDED A motion and second adopting a resolution ordering the 2001 improvements. PAUL AVENUE, JORDAN AVENUE, MINNESOTA STREET, DAKOTA STREET, OAK STREET, AND MEMORIAL TRAIL MOTION BY: JF SECOND BY: MG I WHEREAS, on December 18, 2000, the City Council adopted Resolution 00-129 accepting the Feasibility Report and calling for a Public Hearing to be held on the 2001 Improvement Project which includes the reconstruction of Evanston Avenue, St. Paul Avenue, Jordan Avenue, Minnesota Street, Dakota Street, Oak Street, and Memorial Trail including sanitary sewer, water main, storm sewer, aggregate base, concrete curb and gutter, bituminous surfacing, sidewalk and appurtenant work; and WHEREAS, ten days mailed notice and two weeks published notice of the hearing was given, and the hearing was held on the 22nd day of January, 2001, at which time all persons desiring to be heard were given an opportunity to be heard thereon. NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF PRIOR LAKE, MINNESOTA: 1. Such improvement is necessary, cost-effective and feasible as detailed in the feasibility report. 2. Such improvement is hereby ordered as proposed in the Council Resolution 00-129 adopted December 18,2000. 3. The City Council declares its official intent to reimburse itself for the costs of the improvement from the proceeds of the tax exempt bond. Passed and adopted this 19th day of March, 2001. Method of Assessment: Residents who attended the Public Hearing expressed concern about of the front footage methodology. On the other side, persons with smaller lots believe they overpay with the unit method. The recommendation of the special assessment committee is to retain the front footage method for the following reasons: · 45 of the 78 single-family residential units (nearly 60%) have front footages of 80 feet or less, with 31 of these lots having frontages of 60 feet or less. · The front footage method is the application that is most familiar to the residents as a result of the informational meetings and the public hearing. · The front footage application is the most equitable because the cost is directly proportional for the most part to the size of the lot. 2. Sidewalks: There are no special assessments for sidewalks. All sidewalks are paid for from other sources. Sidewalks are to be constructed beginning at CSAH 44 down Jordan Avenue to Minnesota Street to Evanston Avenue to CSAH 21. The sidewalk will connect the County Road, the Park and the School. A sidewalk cannot be constructed economically on the east side of St. Paul Avenue because of lot grades and setbacks. A sidewalk is also proposed along Memorial Trail in the park and will be located so as not to disturb existing trees. 3. Tree Replacement: As with any City reconstruction project, tree removal will be kept to a minimum. By decreasing the width of Memorial Trail to 20 feet, only two pines on park property will have to be relocated with a tree spade and the oaks will remain undisturbed. As many as five trees on private property may be removed depending on storm sewer and watermain final design. Several trees will be removed within the right of way including an area along the north side of Oak Street. Three of the trees are approximately 20" in diameter. Staff will continue to work with property owners to locate sewer and water services so that tree removal is minimized. Trees on private property (not right-or-way or public property) that die within twelve months of project completion, will be replaced with 2-3 caliper-inch trees from the City's nursery stock if the City determines that the tree loss was related to the project. 4. Alley: The City will discuss installation of curb cuts or vacation of the alley with affected residents. 5. Memorial Trail (east/west only): Memorial Trail will be built to a 20-foot width in accordance with the City's past practice considering the State Uniform Fire Code. As previously mentioned, narrowing the width of the street results in saving trees. The street can be striped and signed for two-way or one-way traffic.
