CONSIDER APPROVAL OF A RESOLUTION IN SUPPORT OF LEGISLATION
TO RESTRICT THE SALE OF PHOSPHORUS LAWN FERTILIZER.
History: Mayor Mader received a letter on March 16th, which I distributed to the
City Council at the March 19th meeting. The letter, from the Mayor of Shorewood,
requests the City's support for legislation intended to restrict the sale of
phosphorus law fertilizers. Because the Council had not had sufficient time to
review the letter or the draft legislation, this request was deferred for
consideration this evening.
Current Circumstances: I have received a copy of Senate File 1789 which is
attached. The bill prohibits the application of phosphorus containing fertilizers
except when warranted by soil test, for new lawns or when organic fertilizer is
used which does not contain a natural phosphorus content of more than 2%.
Plant food phosphorus is also regulated. Public information is also required.
Finally, the bill prohibits the sale of any fertilizer containing phosphorus after
August 1, 2002.
Conclusion: The proposed legislation is consistent in its intent to the ordinance
the City Council adopted in August 2000. Because the legislation bans
phosphorus containing fertilizers after August 2002, the City may be able to
modify its ordinance accordingly at that time, although our ordinance is
substantially more specific. The Council should decide whether it wishes to
support this bill through passage of the attached resolution. Attached for your
information is a list of agencies and the positions they have taken on this subject.
(1) Adopt the attached resolution in support of state legislation relating to the
restrictions on the use and sale of phosphorus lawn fertilizers.
(2) Adopt the resolution with modifications.
(3) Take no action.
As the Council desires.

A RESOLUTION RELATING TO THE RESTRICTIONS ON THE USE
AND SALE OF PHOSPHORUS LAWN FERTILIZERS

WHEREAS, the City of Prior Lake is tributary to significant fresh water resources; and
WHEREAS, there has long been established a well-documented relationship between the use of
phosphorus lawn fertilizers and the degradation of water quality; and
WHEREAS, as a matter of policy, the City of Prior Lake desires to reduce the use of phosphorus lawn
fertilizers and has adopted an ordinance prohibiting this practice; and
WHEREAS, subject to unique circumstances, regional soil conditions have an abundance of natural
phosphorus; and
WHEREAS, industry leading fertilizer manufacturers and retailers have failed to produce and market
low phosphorus lawn fertilizers to the public; and
WHEREAS, over two decades of public education has had minimal effect when in competition with
corporate advertising and their refusal to formulate to local needs; and
WHEREAS, the City of Prior Lake finds it important to encourage the reduction in the use of
phosphorus lawn fertilizers.
NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF PRIOR LAKE, MINNESOTA
that:
1. The City of Prior Lake declares its commitment to phosphorus lawn fertilizer reduction by
encouraging the adoption of legislation restricting the use and sale of phosphorus lawn
fertilizers.
2. Such legislation should require that displays of such fertilizer must be clearly marked as
containing phosphorus, and must be separated from the display of other fertilizers, and that for
each sale of such fertilizer the seller must provide the buyer with a copy of the appropriate
printed consumer information,
3. The City of Prior Lake does request and encourage its state legislative delegation to consider
and enact legislation to regulate and limit the use and sale of phosphorus lawn fertilizers.

Approximately 80% of lawns in our region have naturally very high levels of phosphorus.
Over 75% of homeowners fertilize their lawns with phosphorus two or more times each
year.
