CONSIDER APPROVAL OF TWO TEMPORARY 3.2 LIQUOR
LICENSES FOR PRIOR LAKE MERCHANTS SOFTBALL
TEAM

Prior Lake Merchants softball team is requesting two temporary 3.2
liquor licenses in order to sell 3.2 beer at two softball tournaments this
summer. The ASA Co-rec State Softball Tournament will be hosted at
Mangan Fields at the Ponds Park on Saturday, July 15, 2001. The
ASA Women's District Softball Tournament will be also be held at the
Ponds Park on Friday, Saturday, and Sunday August 10, 11, 12,2001.
This will be the fourth year the City of Prior Lake Parks and
Recreation Department has hosted these tournaments. The Prior Lake
Merchants softball team has volunteered to operate the 3.2 beer
concession again this year and will once again donate 50% of the
revenue from beer sales to the Prior Lake Parks and Recreation
Department. In 1998, 1999 and 2000 the City of Prior Lake received
$800, $400.00, and $900.00 respectively from the profit of beer sales.
The Prior Lake Merchants softball team will be selling beer from a
portable dispensing trailer located by the concession building from
9:00 a.m. until 10:00 p.m. on the dates listed above.
The Issues
The Prior Lake Merchants softball team has paid the $50.00
application fee ($25.00 per license) and has provided proof of
insurance through the Minnesota Sports Federation. The Prior Lake
Police Department has found no reason to deny the applications. The.
Prior Lake Merchants do provide the prerequisite liability insurance
for each event.
Park patrol officers will focus their patrols on The Ponds Park on the
days of the tournaments. The Park and Recreation Department's
Softball League Director will also be acting as Tournament Director
and will be overseeing the operation of the beer concession stand. No
outside coolers will be allowed at this tournament to ensure the 3.2

The City Council has the following alternatives:
1. Adopt a motion as part of the consent agenda approving the
temporary 3.2 liquor licenses for the Prior Lake Merchants
softball team.
2. Approve one license but not the other.
2. Deny the temporary 3.2 liquor license requests.
Staff recommends Council approve the temporary 3.2 liquor licenses
for Prior Lake Merchants softball team for July IS, 2001 and August
10, 11, 12,2001.

CONSIDER APPROVAL OF A TEMPORARY 3.2 LIQUOR
LICENSE FOR PRIOR LAKE JA YS/MUDCA TS BASEBALL
SEASON
Current Circumstances
The Prior Lake Amateur Baseball Association on behalf of the
Jays/Mudcats baseball teams is requesting a Temporary 3.2 Liquor
License in order to sell 3.2 beer throughout the regular Jays/Mudcats
baseball season. The season runs from May 12, 2001 through August
31,2001.
The Issues
Temporary .. non-intoxicating" liquor licenses are not limited in the
number per year as are temporary intoxicating liquor licenses. The
Prior Lake Amateur Baseball Association has paid the pre-set fee of
$215.00 (43 games at $5.00 per game) with their license application.
They have liquor liability insurance coverage through the Minnesota
Joint Underwriting Association. The Prior Lake Amateur Baseball
Association has requested and been granted this temporary liquor
license since 1990. No problems have been recorded with the Prior
Lake Police Department in regard to this license.
The City Council has the following alternatives:
1. Approve the temporary 3.2 liquor license for the Prior Lake
Amateur Baseball Association.
2. Deny the liquor license request.
Staff recommends Council approve the temporary 3.2 liquor license
request for the Prior Lake Amateur Baseball Association.
