DISCUSSION:
History
Proposed street reconstruction improvements to Evanston A venue,
St. Paul Avenue, Jordan Avenue, Minnesota Street, Dakota Street,
Oak Street and Memorial Trail (Project #01-11) are in the
approved 2001 Capital Improvement Program. Resolution 01-05
authorizing preparation of plans and specifications for the projects
was approved by the City Council on January 22, 2001.
Public informational meetings were held in January and March of
2001 to provide affected property owners the opportunity to
discuss the projects. All of the meetings were well attended. Plans
were available at the March open house for review and City staff
was in attendance to answer questions from the public.
Current Circumstances
This project includes storm sewer, sanitary sewer, water main,
concrete curb and gutter, aggregate base, bituminous surfacing,
sidewalk, and appurtenant work. The engineer's construction cost
estimate is $1,507,150. Indirect costs are estimated at 28%, and
include engineering (17%), administration (5%), and financing
(6%) for a total estimated project cost of $1,726,500. The
construction of this project is proposed to be funded through
assessments, tax levy, Collector Street and Trunk Reserve funds.
Issues
The Council held an informational meeting at the March 19th
council meeting to discuss the following five issues that were
raised at the public hearing:

Attached is a one-page summary addressing each of the issues
raised by the neighborhood residents. A copy of this position paper
was distributed to the attendees of the March 19th informational
meeting. Items 2 through 5 have been incorporated in the final
plans and specifications or will be addressed during the project
construction.

The estimated assessment rate for this project based on the
Feasibility Report was $4,219.44 per unit or $52.01 per front foot.
Using the current engineer's estimate and the recommendations
outlined above, the estimated assessment rate is $4,408.00 per unit
or $54.33 per front foot.
Conclusion
The staff will provide a brief summary of the plans and
specifications.
The staff believes it is appropriate for the City Council to approve
project plans and specifications and authorize solicitation of bids
for the 2001 Improvement Project #01-11, Evanston Avenue, St.
Paul A venue, Jordan Avenue, Minnesota Street, Dakota Street,
Oak Street, and Memorial Trail. The actual bid amounts will

verify the estimated assessments. If the Council has concerns at
that stage, they could direct appraisals to determine the degree of
benefit.
FINANCIAL IMPACT:
The total cost of this year's projects are estimated to be $1,831,500
and will be recovered through special assessments, Collector Street
and Trunk Reserve funds in addition to tax levy for bond
repayment. The table below outlines the project costs based on the
engineer's current estimate.

pursuant to Resolution 01-05, adopted on January 22, 2001, the City Engineer has
prepared plans and specifications for the utility improvement.
NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF PRIOR LAKE,
MINNESOTA that
1. Such plans and specifications, a copy of which is attached hereto and incorporated herein by this
reference, are hereby approved.
2. The City Manager shall prepare and cause to be inserted in the official paper and in the
Construction Bulletin an advertisement for bids for the making of the improvement pursuant to the
attached plans and specifications. The advertisement shall be published not less than 21 days prior
to bid opening, shall specify the work to be done, and shall state that the bids will be received by
the City Manager until 10:00 a.m. on Friday, May 18,2001, at which time the bids will be publicly
opened at City Hall at 16200 Eagle Creek Avenue SE by the City Engineer. No bids will be
considered unless sealed and filed with the City Manager and accompanied by a cash deposit,
cashier's check, bid bond, or certified check payable to the City of Prior Lake in the amount of
five (5) percent of the amount of such bid.
3. The City reserves the right to reject any and all bids for any reason as determined solely by the
City.

2001 Public Improvement Project - Resident Concerns

1. Method of Assessment: Residents who attended the Public Hearing expressed concern
about of the front footage methodology. On the other side, persons with smaller lots believe
they overpay with the unit method. The recommendation of the special assessment committee
is to retain the front footage method for the following reasons:
. 45 of the 78 single-family residential units (nearly 60%) have front footages of 80 feet or
less, with 31 of these lots having frontages of 60 feet or less.
. The front footage method is the application that is most familiar to the residents as a
result of the informational meetings and the public hearing.
. The front footage application is the most equitable because the cost is directly
proportional for the most part to the size of the lot.
2. Sidewalks: There are no special assessments for sidewalks. All sidewalks are paid for from
other sources. Sidewalks are to be constrl,lcted beginning at CSA!-i 44 down Jordan Avenue to
Minnesota Street to Evanston Avenue to CSAH 21. The sidewalk will connect the County
Road, the Park and the School. A sidewalk cannot be constructed economically on the east
side of St. Paul Avenue because of lot grades and setbacks. A sidewalk is also proposed along
Memorial Trail in the park and will be located so as not to disturb existing trees.
3. Tree Replacement: As with any City reconstruction project, tree removal will be kept to a
minimum. By decreasing the width of Memorial Trail to 20 feet, only two pines on park
property will have to be relocated with a tree spade and the oaks will remain undisturbed. As
many as five trees on private property may be removed depending on storm sewer and
watermain final design. Several trees will be removed within the right of way including an area
along the north side of Oak Street. Three of the trees are approximately 20" in diameter. Staff
will continue to work with property owners to locate sewer and water services so that tree
removal is minimized. Trees on private property (not right-of-way or public property) that die
within twelve months of project completion, will be replaced with 2-3 caliper-inch trees from the
City's nursery stock if the City determines that the tree loss was related to the project.
4. Alley: The City will discuss installation of curb cuts or vacation of the alley with affected
residents.
5. Memorial Trail (east/west only): Memorial Trail will be built to a 20-foot width in accordance
with the City's past practice considering the State Uniform Fire Code. As previously mentioned,
narrowing the width of the street results in saving trees. The street can be striped and signed
for two-way or one-way traffic.

INTRODUCTION
On June 19, 2000, the Prior Lake City Council adopted Resolution 00-53, which ordered the
preparation of a feasibility report for Project 01-11 that includes street and utility
improvements to Evanston A venue, St. Paul Avenue, Jordan Avenue, Minnesota Street,
Dakota Street, Oak Street and Memorial Trail located within Sections 1 & 2, Township 114,
Range 22, Scott County, Minnesota.
SCOPE
This report evaluates the feasibility of reconstructing the streets and replacing utilities in the
project area. All existing infrastructure elements (streets, sanitary sewer, water main, etc.)
were evaluated, improvements recommended, cost estimates of the proposed improvements
prepared and funding strategies developed in this report.
DESCRIPTION OF PROJECT
The project area is known as Frogtown and includes Evanston Avenue, St. Paul Avenue,
Jordan Avenue, Minnesota Street, Dakota Street, Memorial Trail and Oak Street. Exhibit 1
shows the project area.
Evanston Avenue, St. Paul Avenue, Jordan Avenue, Minnesota Street, Dakota Street, and
Memorial Trail have failing bituminous surfaces, bituminous curb and segments of concrete
curb. A portion of Evanston Avenue and Oak Street has gravel surfaces. The existing road
widths vary from 26 feet to 39 feet with the exception of Memorial Trail. Memorial Trail is
currently a one-way street with a 12-foot wide surface. There are some existing reinforced
concrete storm sewers and culverts that carry storm water runoff to an existing ditch system
and ultimately to the DNR pond located adjacent to Lakefront Park. The majority of these
streets were originally paved in 1963. The streets no longer meet minimum design standards
and it is not cost effective to continue to patch the streets.
The water main system was installed in 1939 and 1953 and consists of 6-inch cast iron pipe
and some ductile iron pipe. A major portion of the water main within the project area was
installed in 1939.
The sanitary sewer system was installed between 1960 and 1963 and consists of 8-inch
vitrified clay pipe. A 12-inch reinforced concrete trunk sewer main replaced the 8-inch main
on Evanston in 1973. The sanitary sewer within the project area was televised in September
2000. The televising report indicated numerous cracked joints, cracked pipes, sags in the
pipe, and roots. Residents in the area have reported numerous backups and have had to
continually hire "Roto-Rooter" to clean their services. In addition, the City has had to repair
and replace segments of the sewer due to failure, two in the past two months.

Proposed improvements include 7-ton design street reconstruction with storm sewer,
concrete curb and gutter, driveway restoration, and bituminous surfacing. Street widths for
Evanston Avenue, St. Paul Avenue, Jordan Avenue, Memorial Trail, Minnesota Street,
Dakota Street, Oak Street, and Credit River Road are proposed to be 32 feet. Memorial Trail
is proposed to be 24' wide. The typical street section is shown on Exhibit 2. Sidewalks are
proposed along one side of Jordan Avenue, Minnesota Street, and Evanston Avenue to
connect the existing trail systems on CSAH 44 and CSAH 21 (see Exhibit 1). Street lights
are proposed to be re-installed in existing locations at all intersections.
Sanitary sewer will be replaced to correct the failing system. A new sanitary sewer main
will be installed on Oak Street to eliminate existing long service lines. The water main will
be replaced with 8" mains and additional fire hydrants will be added to the project, as the
existing hydrant spacing is not in conformance with City requirements. New water main
pipe will be installed on a portion of Evanston Avenue, Oak Street, and Memorial Trail to
loop the system and eliminate long services. See Exhibits 3 and 4 for proposed sanitary
sewer and water main locations.
The costs outlined in this report also include an option for residents to have their sewer and
water services replaced from the right-of-way line to the house. Residents who opt to do
this would be required to sign an agreement waiving the right to appeal with that portion of
the assessment that is associated with the service costs. For the purposes of this report, 30
sewer and water service replacements were estimated.
The existing right-of-way is 66 feet wide on all of the streets except Jordan where it is 60
feet wide. Temporary construction easements or right-of-entry agreements will be necessary
for driveway restoration due to the topography of the area. Acquisition of additional
easements will be pursued where the existing roadways lie outside of the existing right-of-
way.
The storm sewer system improvements will include a new outlet pipe beneath T.H. 13 to
carry storm water runoff from the project area to the DNR pond, which is adjacent to
Lakefront Park. The DNR pond (#159P) located south of Kop Parkway is a landlocked
basin. In 1996 and 1997, the water elevation of this pond was at an elevation that resulted in
flood damage to the property at 16100 Evanston Avenue. This pond is in need of an outlet to
not only protect property owners from future flooding, but to accommodate future downtown
redevelopment as well. A lift station is being proposed at the southwest corner of the pond
that will discharge into the pond located near City Hall and through the storm sewer system
to Prior Lake. The existing 24-inch culvert under T.H. 13 has settled over time creating a
back slope. A parallel 24-inch outlet pipe is being proposed under T.H. 13. This will provide
the necessary capacity to pass storm flows from the east side of T.H. 13 to the west side.
Proposed storm sewer improvements are shown on Exhibits 5 and 6.
The benefiting property owners will be assessed for street, storm sewer and utility service
construction. The property tax levy will be used to finance the City's portion of the street
reconstruction costs. The Trunk Reserve Fund will be used to finance the water, sanitary
sewer and trunk storm sewer improvements. The Collector Street Fund will be used to fund
sidewalk improvements.

From an engineering standpoint, this project IS feasible, and can be accomplished as
proposed.
ESTIMATED COST
The following costs were prepared based upon an Engineer's Estimate and are subject to
change, depending on the final design of the project, required easements and/or right of way,
soil conditions, bids received, and actual work performed.

The improvement cost can be assessed on a unit basis or an adjusted front footage basis to
the benefiting properties as per the Assessment Policy adopted by the City Council on
February 21, 1989, and as amended. Both methods are shown for the project. The following

With a total estimated project cost of $1,993,080, an estimated bond issue of $1,075,000, the
assessed amount of $488,970 would be equivalent to 45% of the total bond issue. Minnesota
Statutes Chapter 429 Special Assessment Bond issue requires that a minimum of 20% of the total
bond issue amount be recovered through special assessments.

The proposed improvement is necessary, cost effective, is feasible from an engineering standpoint
and should be made as proposed.
The total estimated cost of the recommended improvements is $1,933,080. A portion of this project
is proposed to be assessed to the benefiting property owners and the remainder through other funding
sources.
