HomeMy WebLinkAbout9C - Downtown TIF District MEETING DATE: AGENDA #: PREP ARED BY: AGENDA ITEM: DISCUSSION: ALTERNATIVES: CITY COUNCIL AGENDA REPORT APRIL 16,2001 9C DONALD RYE, PLANNING DIRECTOR CONSIDER APPROVAL OF A RESOLUTION CALLING FOR A PUBLIC HEARING TO CONSIDER MODIFICATION OF THE DEVELOPMENT PROGRAM FOR DEVELOPMENT DISTRICT 1 AND THE ESTABLISHMENT OF A TAX INCREMENT FINANCING PLAN FOR TAX INCREMENT DISTRICT 1-3 (Lakefront Plaza) History On February 20, the City Council adopted a conceptual agreement with Randy Simpson and Ken Beske for the development of a mixed-use project in the Downtown area known as Lakefront Plaza. Among other things, the agreement called for the Developers to submit an application for Tax Increment Financing and pay the fee of $12,000. The City would then prepare a Tax Increment Financing Plan with the assistance of Ehlers and Associates. Current Circumstances The Developers have submitted the application and fee for Tax Increment Financing. At this time, the next step in the process is to approve the attached resolution setting the date for a public hearing on the Tax Increment Financing Plan. The resolution also directs the staff and Ehlers Associates to prepare the Tax Increment Financing Plan according to the attached schedule. Issues The primary issue is whether the Council desires to take the next step in this process. By adopting this resolution, the Council still has the option to discontinue the process if it is determined the Project does not meet the City policy and statutory requirements for a TIF proj ect. The Council has three alternatives. 1. Adopt the attached resolution 2. Deny the attached resolution 3. J ON THE PROPOSED ADOPTION OF THE MODIFICATION TO THE DEVELOPMENT PROGRAM FOR DEVELOPMENT DISTRICT NO. 1 AND THE PROPOSED ESTABLISHMENT OF TAX INCREMENT FINANCING DISTRICT NO. 1-3 THEREIN AND THE ADOPTION OF THE TAX INCREMENT FINANCING PLAN THEREFOR. BE IT RESOLVED by the City Council (the "Council") for the City of Prior Lake, Minnesota (the "City"), as follows: Section 1. Public Hearing. This Council shall meet on June 4,2001, at approximately 7:30 P.M., to hold a public hearing on the proposed adoption of the modification to the Development Program for Development District No.1, the proposed establishment of Tax Increment Financing District No. 1-3 (a redevelopment district), and the proposed adoption of the Tax Increment Financing Plan therefor, all pursuant to and in accordance with Minnesota Statutes, Sections 469.174 through 469.179, inclusive, as amended, in an effort to encourage the development and redevelopment of certain designated areas within the City; and Section 2. Notice of Public Hearing, Filing of the Program and Plan. City staff is authorized and directed to work with Ehlers and Associates, Inc., to prepare the modification to the Development Program for Development District No. I and the Tax Increment Financing Plan for Tax Increment Financing District No. 1-3 and to forward documents to the appropriate taxing jurisdictions including Scott County and Independent School District No. 719. The City Clerk is authorized and directed to cause notice of the hearing, together with an appropriate map as required by law, to be published at least once in the official newspaper of the City not later than 10, nor more than 30, days prior to June 4, 2001, and to place a copy of the Program and Plan on file in the City Clerk's office at City Hall and to make such copy available for inspection by the public.
