HomeMy WebLinkAbout10B - Amend Creekside PUD MEETING DATE: AGENDA #: PREPARED BY: REVIEWED BY: AGENDA ITEM: DISCUSSION: CITY COUNCIL AGENDA REPORT rvlj MAY 7, 2001 10 B JANE KANSIER, PLANNING COORDINATOR DON RYE, PLANNING DIRECTOR CONSIDER APPROVAL OF A RESOLUTION APPROVING AN AMENDMENT TO THE CREEKSIDE ESTATES PUD CHANGING THE EXTERIOR MATERIALS FOR THE 24- UNIT BUILDINGS History: The Creekside Estates Planned Unit Development (PUD) was approved by the City Council in December, 2000. The PUD Plan included 102 units in three buildings (2, 24-unit senior condominium buildings and I, 54-unit congregate care facility). The development plan called for exterior materials on the buildings consisting of brick and vinyl siding, as shown on the attached plans. The proposed amendment pertains to the required exterior materials for the 2, 24-unit buildings. Current Circumstances: Freedom Development, LLC, and Eagle Creek Development, LLC, the developers of Creekside Estates, have submitted a request for a minor amendment to the approved PUD development plan. This amendment involves replacing the brick and vinyl siding on the 24-unit buildings with stucco. The proposed building exteriors are shown on the attached plans. The developer has also prepared a model of the development that he will show the City Council during the City Council forum. Section II 07.2202 of the Zoning Ordinance requires building exteriors to consist of at least 60% Class I materials. Class I materials are defined as brick, marble, granite or other natural stone, textured cement stucco, copper, porcelain, and glass. The approved building plans include at least 60% Class I materials (brick) and with the remainder a Class II material (vinyl siding). The proposed amendment would eliminate the vinyl siding and utilize brick and stucco, both Class I materials) for the entire face of the building. In short, the percentage of Class I exterior materials will increase substantially as a result of this amendment. Section 1106.607 of the Zoning Ordinance allows the City Council to approve minor amendments to an approved PUD Plan by resolution following notification of all owners of property within the PUD. " Thp ,....uP... The major issue is whether or not the proposed amendment will change the character of the PUD. The proposed materials actually increase the Class I materials on the site, and will wear better than the vinyl siding. In effect, this amendment conforms to the standards in the Zoning Ordinance. One question the Council should consider is whether this change will affect the look of the development. There is less brick on the buildings than originally proposed. In addition, the 24-unit buildings will have a different appearance from the 54-unit congregate care building. rnnrh,..;mr The proposed amendment is minor, and will not alter the character of the PUD. The City Council has three alternatives: 1. Adopt a resolution approving the minor amendment to Creekside Estates PUD Plan as proposed. 2. Deny the proposed amendment. In this case, the Council should direct the staff to prepare a resolution with findings of fact for the denial of these requests. 3. WHEREAS the Prior Lake City Council considered the proposed minor amendment to the approved development plan for the Creekside Estates on May 7,2001; and WHEREAS owners of property within the Creekside Estates PUD have been notified of the proposed minor amendment in accordance with Section 1106.607 (2) b of the Zoning Ordinance; and WHEREAS the City Council finds the minor amendment to the Creekside Estates PUD consistent with certain elements of the Comprehensive Plan and the Zoning Ordinance; and WHEREAS the City Council finds the minor amendment is in harmony with both existing and proposed development in the area; and WHEREAS the City Council finds the amendment would result in an opportunity to address the full range of the marketplace; and WHEREAS the City Council finds the minor amendment is compatible with the stated purposes and intent of the Section 1105 Planned Unit Developments of the Zoning Ordinance; and WHEREAS the City Council finds the proposed minor amendment adequately provides for internal organization, uses, circulation, public facilities, recreation areas and open space. NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF PRIOR LAKE, MINNESOTA: 1. The recitals set forth above are incorporated herein. 2.
