Prior Lake, MN 55372-1714 MEETING DATE: AGENDA #: PREPARED BY: NOVEMBER 3, 2003 5E JANE KANSIER, PLANNING COORDINATOR AGENDA ITEM: CONSIDER APPROVAL OF A RESOLUTION APPROVING THE COMMON INTEREST COMMUNITY NUMBER 1136 (BLUFF HEIGHTS APARTMENTS) CIC PLAT DISCUSSION: History: In July, 2002, the City Council approved a conditional use permit for the construction of the Bluff Heights apartment building. This building includes 49 apartment units. The building is located on an existing, platted lot. Current Circumstances: At this time, the developer is requesting approval of a Common Interest Community (CIC) plat. The purpose of a CIC plat is to allow the subdivision of the 49-unit apartment building into 2 lots. This is somewhat unique in that most CIC plats will create a lot around the four walls of an individual unit. This CIC plat will create 2 units. Unit 1 consists of 39 of the apartment dwellings which will be owned by the applicant. Unit 2 consists of 10 apartments to be owned by the Scott County HRA. CIC plats are typically done following the actual construction of the buildings in question. The CIC plat does not change the number of units or the density of the development. Staff has reviewed the CIC plat and finds it consistent with the approved conditional use permit. The Issues: This request is similar to Creekside Commons. The difference is that there is no tax increment and the rules related thereto. Bluff Heights apartments were approved as a general occupancy building with no restrictions on age or income, while Creekside Commons was approved as a PUD for senior housing and the TIF plan was approved as senior rental housing. CIC plats do not require a development contract. II _ FISCAL IMP ACT: ALTERNATIVES: RECOMMENDED MOTION: REVIEWED BY: Conclusion: A copy of the CIC plat is attached to this report. Staff will be available to discuss the details of this plat with the Council. Budf(et Impact: There are no budget impacts with the approval of this CIC plat since the building has already been built. The City Council has three alternatives: 1. Adopt a Resolution approving the Common Interest Community Number 1136 (Bluff Heights Apartments) CIC Plat. 2. Deny the resolution approving the CIC plat. 3. Defer this item and provide staff with specific direction. The staffrecoffimends adoption of Alternative #1 as part of the consent agenda. Page 2 .,. . r__ 16200 Eagle Creek Avenue B.IiSOLUTION 03-XX Prior Lake, MN 55372-1714 RESOLUTION OF THE PRIOR LAKE CITY COUNCIL APPROVING THE COMMON INTEREST COMMUNITY NUMBER 1136 (BLUFF HEIGHTS APARTMENTS) CIC PLAT MOTION BY: SECOND BY: WHEREAS: on July 15, 2002, the City Council approved Resolution #02-118 approving a Conditional Use Permit for the construction of a 49-unit apartment building known as Bluff Heights Apartments; and WHEREAS: the Bluff Heights Apartments building is located on an existing, platted lot; and WHEREAS: The City Council has found that the Common Interest Community Number 1136 (Bluff Heights Apartments) CIC Plat is in substantial compliance with the approved Conditional Use Permit for the Bluff Heights Apartments; and WHEREAS: The City Council has approved the Common Interest Community Number 1136 (Bluff Heights Apartments) CIC Plat. NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PRIOR LAKE, MINNESOTA, that it should and hereby does require the following conditions to be met, prior to release of, and recording of said plat: 1. The recitals set forth above are incorporated herein as if fully setforth. 2. The CIC plat and all pertinent documents must be filed with Scott County within 60 days from the date of final plat approval. Failure to record the documents by January 3, 2004, will render the CIC plat null and void. 3. The Mayor and City Manager are hereby authorized to execute the CIC Plat on behalf of the City. Passed and adopted this 3rd day of November, 2003.
