HomeMy WebLinkAbout4D - Amend Creekside Estates MEETING DATE: AGENDA #: PREP ARED BY: REVIEWED BY: AGENDA ITEM: DISCUSSION: FISCAL IMP ACT: ALTERNATIVES: CITY COUNCIL AGENDA REPORT MAY 21, 2001 4D JANE KANSIER, PLANNING COORDINATOR DON RYE, PLANNING DIRECTOR CONSIDER APPROVAL OF A RESOLUTION DENYING AN AMENDMENT TO THE CREEKSIDE ESTATES PUD CHANGING THE EXTERIOR MATERIALS FOR THE 24- UNIT BUILDINGS Historv: The Creekside Estates Planned Unit Development (PUD) was approved by the City Council in December, 2000. The PUD .Plan included 102 units in three buildings (2, 24-unit senior condominium buildings and 1, 54-unit congregate care facility). The development plan called for exterior materials on the buildings consisting of approximately 2/3 brick and glass and 1/3 vinyl siding, as shown on the attached plans. Freedom Development, LLC, and Eagle Creek Development, LLC, the developers of Creekside Estates, submitted a request for a minor amendment to the approved PUD development plan. This amendment involved replacing the brick and vinyl siding on the 24-unit buildings with stucco. The resulting exterior would be primarily stucco with brick used as an accent around the entry and patio doors. Current Circumstances: The City Council considered the proposed amendment on May 7, 2001. The Council did not feel the change in building materials was consistent with the character of the development as originally approved. The Council noted the residents of the area expect the exterior of the buildings will be brick and vinyl as previously approved by the Council. The Brick exterior is more durable, maintenance free and long- lived. The Council denied a resolution approving the proposed amendment and directed staff to prepare a resolution denying the proposal. Conclusion: The attached resolution denies the proposed amendment as directed by the City Council. Bud1?et Impact: There is no immediate budget impact as a result of this request. A motion and second as part of the consent agenda adopting a resolution denying the proposed amendment to the Creekside Estates UD Plan is appropriate. 1:\Olfiles\Olpuds\creek amend\cc report2.doc Page 2 5~ RESOLUTION O~ RESOLUTION DENYING A MINOR AMENDMENT TO THE CREEKSIDE ESTATES PLANNED UNIT DEVELOPMENT TO CHANGE THE EXTERIOR BUILDING MATERIALS FOR THE 24-UNIT BUILDINGS JE MOTION BY: ~1 C't , SECOND BY: WHEREAS: the Prior Lake City Council considered the proposed minor amendment to the approved development plan for the Creekside Estates on May 7,2001; and on May 21, 2001; and WHEREAS: owners of property within the Creekside Estates PUD have been notified of the proposed minor amendment in accordance with Section 1106.607 (2) b of the Zoning Ordinance; and WHEREAS: the City Council finds the proposed minor amendment to the Creekside Estates PUD inconsistent with elements of the Comprehensive Plan and the Zoning Ordinance which stress high quality design; and WHEREAS: the City Council finds the minor amendment is inconsistent with the character of the development as originally approved inasmuch as the proposed change would decrease the cost and value of the project; and WHEREAS: the City Council finds the minor amendment is not compatible with the stated purposes and intent of Section 1105 Planned Unit Developments of the Zoning Ordinance which require a higher standard of building design; and WHEREAS: this project was approved as a Planned Unit Development which provided the City Council with the ability to require a higher standard and the approved design was deemed to be of the desired level of quality whereas the proposed changes are not. NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF PRIOR LAKE, MINNESOTA: 1. The recitals set forth above are incorporated herein as findings. 2.
