CONSIDER APPROVAL OF A RESOLUTION APPROVING
SPECIAL ASSESSMENT DEFERRAL FOR THE 2001 STREET
IMPROVEMENT PROJECT
DISCUSSION:
Introduction
The purpose of this agenda item is to consider approval of the
deferment application for special assessments on PIN# 25 004 0 1 7 0
owned by Anni Lung in the amount of $5,057.80.
History
At its regular meeting of October 15, 2001 the City Council adopted
the assessment roll for Project 01-01 Frog Town street
improvements. On October 23, 2001 Anni Lung submitted an
application for deferment of her special assessment.
Current Circumstances
Prior Lake City Code, Section III allows for the defem1ent of
assessment principal and interest if the following four criteria are
satisfied:
1. Applicant must be 65 years of age or older.
2. The qualifying property must be the homestead of the
applicant.
3. Annual gross income shall not exceed the income limits as
set forth by family size according to Attachment A of
Ordinance 86-3. (2000 income limitation for one individual
is $25,703.00)
4. Total special assessment to be deferred must exceed
$lOOO.OO.
The application for the deferment of special assessments for this
parcel is complete and the applicant meets all City requirements.
Also, the principal amount continues to accrue interest on the unpaid
balance while deferred.
The reason the resolution identifies the property owner by name is
that the deferment is for that specified person that qualifies as

opposed to the owner of the property. Change in ownership would
result in the removal of the deferment status and would require all
prior year deferred installments to be paid in full unless the new
owner could qualify.

WHEREAS, property owned by Anni Lung has been specially benefited by City Project 01-
11; and

WHEREAS, the property identified as PIN #25 004 017 0 has accordingly been assessed in
the amount of$5,057.80; and
WHEREAS, Anni Lung has submitted an application requesting deferment of such special
assessments in accordance with State Statute and City Code; and
WHEREAS, staff has examined the application and finds it to conform to State Statute and
City Code requirements.
NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF PRIOR LAKE, it
does hereby approve the application and request of Anni Lung for deferment of the annual
special assessment installments (including interest) on the certified amount of $5,057.80
spread against the property PIN# 25 004 017 0 pursuant to improvements specially
benefiting the property by City Project 01-11, and
FURTHER, the Finance Director is directed to administer the deferment in accordance
with State Statute and City Code.
