CONSIDER APPROVAL OF A RESOLUTION AMENDING
THE WILD OAKS CONDITIONAL USE PERMIT TO ALLOW
PORCHES AND DECKS ON THE TOWNHOUSE UNITS
History: On May 17, 1999, the City Council approved a Conditional
Use Permit for the Wild Oaks development. The approved plan calls
for 21 units on 9.5 buildable acres, for a density of 2.2 units per acre,
and 13% lot coverage. The plan calls for a townhouse style
development consisting of 2- and 3-unit buildings. There are six 2-
unit buildings, and three 3-unit buildings. The 2-unit buildings are
rambler style structures with walkout foundations and the 3-unit
buildings are 1 Yz-story structures with lookout foundations. All of the
units have attached double garages and pitched roofs. Exterior
materials include brick and stucco on the front and vinyl siding on the
side and rear of the buildings. Each of the units will contain
approximately 1,400 square feet of finished floor area on the main
level.
Current Circumstances: The developer has submitted a request for an
amendment to the approved CUP plan. This amendment involves a
change in the size of the townhouse units, and the addition of porches
and decks to the townhouse units. Attached to this report are copies of
the approved site plan and building plans, and the proposed site plan
and building plans.
The proposed plans will increase the size of units 1, 3-6, and 8 by 376
square feet on the main floor and 40 square feet on the second level.
Units 2 and 7 will increase in size by 296 square feet on the first level
and 40 square feet on the second level. All of these units will also
have an optional 12' by 12' porch and 10' by 12' deck. Units 9-21
will not increase in area, but will include an option for a 120 square
foot porch and a 10' by 13' deck addition.

The additions to the units will increase the lot coverage and the
impervious surface of the development as follows:

The additional lot coverage and impervious surface are still below the
maximum percentages allowed by the ordinance. The. proposed
amendment will not affect the density, the grading or the landscaping
approved as part of the original CUP.
The Zoning Ordinance allows the City Council to approve mmor
amendments to an approved CUP plan by resolution. A mmor
amendment includes changes or modifications that do not affect
required parking, required yards, floor area ratios, ground floor area
ratios, signage, building height, density, covenants or other agreements
required as part of the approved plan. In this case, the proposed
amendment does affect the floor area of the buildings, although the
floor area is consistent with the maximum floor area permitted in the
district. Since this does not qualify as a minor amendment to the CUP,
the proposal requires a public hearing before the Planning Commission
and review and approval by the City Council.
The Planning Commission considered this amendment at a public
hearing on October 8, 2001. At the hearing, the developer stated the
porches and decks should have been included with the original plans.
There was no other public testimony. The Planning Commission
recommended approval of this amendment subject to the following
conditions:
1. The townhouses must meet the setbacks approved as part of the
original CUP. This includes the required yards and the 30' setback
from the 100-year flood elevation of the wetlands.
2. The porch elevation must be at least 3' above the 100-year flood
elevation of the adjacent pond or wetland.
3. The developer must submit an approved modified Watershed
District permit to the City prior to the issuance of any building
permits for these units.
The Issues: The major consideration in reviewing this amendment is
whether or not the proposed amendment will change the character of
the approved plan. The proposed amendment does not affect the
density or the layout of the approved CUP. The sizes of the units have
been increased, and allow the option of porches and decks. According
to the developer, these additions will increase the value of the units.

The exterior materials will still be brick and vinyl siding. The
amendment will not affect the parking spaces, the setbacks or other
ordinance requirements.
The Council should be aware that there was considerable
neighborhood input when this project was originally proposed. The
neighborhood wanted the number of units kept to a minimum in hopes
that trees and topographical features could be preserved. A possible
increase of a total of 2,800 square feet could be argued to be contrary
to that original neighborhood concern, although the amendment will
not increase the number of units or require the removal of any
additional trees. Notice of the Planning Commission public hearing to
discuss this amendment was mailed to the owners of property within
500 feet of the site. No representatives of the neighborhood spoke at
the hearing.
In their original comments, the Watershed District stated that revised
runoff calculations and a modified Watershed District permit would be
required. Upon further review of the proposal, the Watershed District
has determined the increase in impervious surface and lot coverage are
insignificant, and that a modified permit is not necessary.
Cnnr/m.:inn' The proposed amendment is consistent with the
approved CUP, and will not alter the character of the approved plan.
Hudgpt Impflrt. There is no immediate budget impact as a result of
this request. The construction of new dwellings will provide
additional tax base to the City.
The City Council has three alternatives:
1. Adopt a resolution approving the amendment to the Wild Oaks
CUP as proposed.
2. Deny the proposed amendment. In this case, the Council should
direct the staff to prepare a resolution with findings of fact for the
denial of these requests.
3. Defer consideration of this item for specific reasons.

TO ALLOW PORCHES AND DECKS ON THE TOWNHOUSE UNITS

Conditional Use Permit for the Wild Oaks townhouse development on November 5,
2001; and

WHEREAS:
WHEREAS: The amendment does not affect the density, the layout, the design, the required
parking, required yards, signage, building height, covenants or other agreements
required by the original plan; and
WHEREAS: the City Council finds the amendment to the Wild Oaks CUP consistent with certain
elements of the Comprehensive Plan and the Zoning Ordinance, including the goal of
providing a variety of affordable, high quality housing; and.
WHEREAS: the City Council finds the amendment is in harmony with both existing and proposed
development in the area; and
WHEREAS: the City Council finds the amendment would result in an opportunity to address the full
range of the marketplace; and
WHEREAS: the City Council finds the amendment is compatible with the stated purposes and intent
of the Section 1108.200 (Conditional Use Permits) of the Zoning Ordinance in that it
does not increase the approved density of the site; and
WHEREAS: the City Council finds the proposed amendment adequately provides for internal
organization, uses, circulation, public facilities, recreation areas and open space.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF PRIOR LAKE, MINNESOTA:
1. The recitals set forth above are incorporated herein.
2. The Wild Oaks Conditional Use Permit is amended to allow porches and decks on the townhouse
units as shown on Exhibit A to this resolution, subject to the following conditions:
a) The townhouses must meet the setbacks approved as part of the original CUP. This includes the
required yards and the 30' setback from the 1 OO-year flood elevation of the wetlands.
b) The porch elevation must be at least 3' above the 100-year flood elevation of the adjacent pond
or wetland.
Passed and adopted this 5th day of November, 2001.

In response to your letter dated August 21,2001:.
Item 1: I have attached the list of property owners that was prepared by Old Republic
Title.
Item 2: . Per our discussion no longer an issue.
Item 3: Units I, 3, 4, 5, 6 & 8 have an additional 376 square feet on the main floor, 40
square feet on the second floor, 144 square feet in the optional porch and a 10x12 deck.
Units 2 and 7 have an additiona~ 296 square feet on the main floor, 40 square feet on the I
second floor, 144 square feet in the optional porch and a IOx12 deck.
Units 9-21 have an additional 120 square feet in the optional porch and a 10x13 deck.
Impervious surface increased 0.9% to 11.1 % and lot coverage increased 1.9% to 15.7%.
See attached calculation sheet.
All setbacks, landscaping, tree preservation and grading remain the same as the original
conditional use permit. All units including porches and deck remain inside the original
building pad.
Item 4: The proposed amendment is for the inclusion of decks and porches on every
unit. In addition we would like to increase main floor square footage of units 1-9 as
mentioned above. Units 9-21 remain the same except for the inclusion of optional decks
and porches.

Planning Commission Minutes
October 8. 2001
Planning Coordinator Jane Kansier presented the Planning Report on file in the office of
the City Planning Department.
The developer has submitted a request for an amendment to the approved CUP plan.
This amendment involves a change in the size of the townhouse units, and the addition of
porches and decks to the townhouse units, The proposed plans will increase the size of
units 1,3-6, and 8 by 376 square feet on the main floor and 40 square feet on the second
level. Units 2 and 7 will increase in size by 296 square feet on the first level and 40
square feet on the second level. All of these units will also have an optional 12' by 12'
porch and 10' by 12' deck. Units 9-21 will not increase in area, but will include an
option for a 120 square foot porch and a 10' by 13' deck addition.
The staff felt the proposed amendment would not alter the character ofthe approved CUP
and recommended approval ofthe amendment, subject to the following conditions:
1, The townhouses must meet the setbacks approved as part of the original CUP. This
includes the required yards and the 30' setback from the 100-year flood elevation of
the wetlands.
2. The porch elevation must be at least 3' above the 100-year flood elevation of the
adjacent pond or wetland.
3. The developer must submit an approved modified Watershed District permit to the
City prior to the issuance of any building permits for these units.
