The PUD Plan included 102 units in three buildings (2, 24-unit senior condominium buildings and 1, 54-unit congregate care facility). --f.It1t;. ...: ~1 ';~:, Current Circumstances: Freedom Development, LLC, and Eagle Creek Development, LLC, the developers of Creekside Estates, have submitted a request for a minor amendment to the approved PUD development plan. This amendment involves the rearrangement of interior floor space in the 54-unit building. The revisions include rearranging mechanical rooms to enlarge the community and lobby area on the first floor, the addition of a card room and an activity room on the second floor, and the removal of a beauty salon and the addition of a guest room on the third floor. The attached drawings show the approved and the proposed floor plans. Section 1106,607 of the Zoning Ordinance allows the City Council to approve minor amendments to an approved PUD Plan by resolution following notification of all owners of property within the PUD, A minor amendment includes "changes that increase conformity with Ordinance requirements; decreases in residential density, leasable floor area, building height, impervious surface and/or required parking provided such decreases have a minimal impact on the overall character of the approved Final PUD Plan as determined by the Zoning Administrator; minor building additions and floor plan modifications that do not increase parking requirements or reduce useable open space; and changes that are specified as minor amendments in the approved Development Contract. " rile Issues: The major issue is whether or not the proposed amendment will change the character ofthe PUD. The amendment does not change the number of units or the total floor area of the building. The amendment also does not affect the exterior appearance of the building. The major change is the addition of the guest room, This room is a sleeping room with a bath. The guest room may affect the parking for this use; however, the PUD currently provides at least one parking space per unit, which exceeds the Zoning Ordinance requirement of 0.5 spaces per unit for elderly housing. The construction of the new building will provide additional tax base to the City. The City Council has three alternatives: 1. Adopt a resolution approving the minor amendment to Creekside Estates PUD Plan as proposed. 2. Deny the proposed amendment. In this case, the Council should direct the staff to prepare a resolution with findings offact for the denial of these requests. 3, Defer consideration ofthis item for specific reasons. Staff recommends alternative # 1. WHEREAS: owners of property within the Creekside E~tates PUD have been notified of the proposed minor amendment in accordance with Section 1106.607 (2) b of the Zoning Ordinance; and WHEREAS: the City Council finds the minor amendment to the Creekside Estates PUD consistent with certain elements of the Comprehensive Plan and the Zoning Ordinance; and WHEREAS: the City Council finds the minor amendment is in harmony with both existing and proposed development in the area; and WHEREAS: the City Council finds the amendment would result in an opportunity to address the full range of the marketplace; and WHEREAS: the City Council finds the minor amendment is compatible with the stated purposes and intent of the Section 1106 Planned Unit Developments of the Zoning Ordinance; and WHEREAS: the City Council finds the proposed minor amendment adequately provides for internal organization, uses, circulation, public facilities, recreation areas and open space. NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF PRIOR LAKE, MINNESOTA: 1. The recitals set forth above are incorporated herein. 2. As you are aware we met with Don Rye, the city planner of Prior Lake, early on September 2ih and reviewed the changes based on the plans that we submitted to the city. It was Mr. Rye's opinion at that time that these were minimal changes and would not constitute a major amendment process. Hopefully after review of the enclosed information you will concur with Mr. Rye's thoughts on this matter. The information that you requested is as follows: 1.) The applicant is the only owner within the PUD. 2.) The changes requested utilize more storage space on the garage level, a more spacious lobby area on the first floor, a more spacious activity room and an added card room on the second floor, and an enlarged party room and guest room added to the third floor. All this has been added without increasing the footage on the plan of the building as approved by the city council.
