AN AMENDMENT TO THE WENSMANN 1sT ADDITION PUD
TO ALLOW PORCHES AND LARGER DECKS ON THE
TOWNHOUSE UNITS
History: The Wensmann 1st Addition Planned Unit Development (PUD)
was approved by the City Council in August 2000. The PUD Plan included
a mixed-use development consisting of 50 single-family units and 129
townhouse units. The development plans included split entry or two-story
walkout townhouses with attached double garages and decks. The
proposed amendment is to allow porches and larger decks on the townhouse
units.
Current Circumstances: Wensmann Realty, Inc., the developer of
Wensmann 1st Addition, has submitted a request for a minor amendment to
the approved PUD development plan. This amendment involves the
addition of porches and larger decks to the townhouse units. The attached
drawings show proposed building elevations and the additional floor area.
The underlying zoning for this PUD is R-2 (Low to Medium Density
Residential). The R-2 district allows a maximum ground floor area of 0.30.
The ground floor area of the townhouse portion of the original plan is 0.242.
The ground floor area of the plan with the addition of the porches is 0.279.
The amendment does not include any change in setback requirements. In
other words, all of the units, whether constructed with decks or porches,
must meet the minimum setback requirements. These include a minimum
25' rear setback and a 30' setback from the 100 year flood elevation of any
NURP pond or wetland.
Section 1106.607 of the Zoning Ordinance allows the City Council to
approve minor amendments to an approved PUD Plan by resolution
following notification of all owners of property within the POO. A minor
amendment includes "changes that increase conformity with Ordinance
requirements; decreases in residential density, leasable floor area, building
height, impervious surface and/or required parking provided such decreases
have a minimal impact on the overall character of the approved Final PUD

Plan as determined by the Zoning Administrator; minor building additions
and floor plan modifications that do not increase parking requirements or
reduce useable open space; and changes that are specified as minor
amendments in the approved Development Contract. "
Thp l~m('s' The major issue is whether or not the proposed amendment will
change the character of the PUD. The proposed porches and decks are
consistent with the style and the use of the approved townhouses. The
addition of these features does not increase the density of the development,
and will actually increase the value of the units.

character ofthe PUD.
Rudgpf Tmpn('f' There is no immediate budget impact as a result of this
request. The construction of new dwellings will provide additional tax base
to the City.
The City Council has three alternatives:
1. Adopt a resolution approving the minor amendment to the Wensmann 1 st
Addition PUD Plan as proposed.
2. Deny the proposed amendment. In this case, the Council should direct
the staff to prepare a resolution with findings of fact for the denial of
these requests.
3. Defer consideration of this item for specific reasons.

RESOLUTION APPROVING A MINOR AMENDMENT TO THE WENSMANN 1ST ADDITION
PLANNED UNIT DEVELOPMENT TO ALLOW PORCHES AND LARGER DECKS ON THE
TOWNHOUSE UNITS

WHEREAS: the Prior Lake City Council considered the proposed minor amendment to the
approved development plan for the Wensmann 1st Addition on June 18, 2001;
and
WHEREAS: owners of property within the Wensmann 1st Addition PUD have been notified of
the proposed minor amendment in accordance with Section 1106.607 (2) b of
the Zoning Ordinance; and
WHEREAS: the City Council finds the minor amendment to the Wensmann 1 st Addition PUD
consistent with certain elements of the Comprehensive Plan and the Zoning
Ordinance, including the goal of providing a variety of affordable, high quality
housing; and
WHEREAS: the City Council finds the minor amendment is in harmony with both existing and
proposed development in the area; and
WHEREAS: the City Council finds the amendment would result in an opportunity to address
the full range of the marketplace; and
WHEREAS: the City Council finds the minor amendment is compatible with the stated
purposes and intent of the Section 1105 Planned Unit Developments of the
Zoning Ordinance in that it does not increase the approved density of the site;
and
WHEREAS: the City Council finds the proposed minor amendment adequately provides for
internal organization, uses, circulation, public facilities, recreation areas and
open space.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF PRIOR LAKE,
MINNESOTA:
1. The recitals set forth above are incorporated herein.

2. The Wensmann 1 st Addition PUD Final Plan is amended to allow porches and larger decks
to the townhouse units as shown on Exhibit A to this resolution.
3, The addition of the porches and the larger decks will not affect or decrease the required
setbacks, including, but not limited to, the minimum 25' rear yard setback and the minimum
30' setback from the 1 DO-year flood elevation of a NURP pond or wetland.
Passed and adopted this 18th day of June, 2001.

Enclosed is a revised coversheet to the POO plan previously approved and a complete set of building plans
with porch and larger deck options shown. -

Weare requesting a minor ~endment to the PUD A~eement for the Wensmann 15t Addition to allow
'customers to build larger than_standard decks and also have'the availability of porches as an option. !?
addition to the obvious benefit the homeowner will receive by allowing fOT the-additional space, the
structures wilI also help to "Break up" the back of the buildings that face Co. Rd. 82. It will give more
dimension and character to the rear elevations.
In the Glynwater Addition, porches were added on approximately six units out of the total of78, and larger
decks on approximately 20 homes. As history will show amending the PUD will not change the basic
plan, but will offer an option to the homeowners that choose to invest the additional money in their homes.
We are available to answer any questions regarding this request and would like to present our case to the
City Council at the earliest possible date.
