HomeMy WebLinkAbout9E - Thomas Ryan Park Annexatio MEETING DATE: AGENDA #: PREPARED BY: AGENDA ITEM: DISCUSSION: CITY COUNCIL AGENDA REPORT June 18, 2001 f'\~ ~;ank Boyles, City Manage~ CONSIDER APPROVAL OF A JOINT RESOLUTION FOR ORDERLY ANNEXATION BETWEEN THE CITY OF PRIOR LAKE AND SPRING LAKE TOWNSHIP PURSUANT TO MINNESOTA STATUTES 414,0325. Historv: The City has acquired and developed a community park on a 38.4 acre parcel located in Spring Lake Township. The City intends to extend sewer and water to this parcel to serve the concession/restroom building and the irrigation system. If the parcel remains within Spring Lake Township, the City would pay $3800 for a building permit, $1000 of which is a park dedication fee to the Township. The City would then have to negotiate an agreement with the Metropolitan Council and the Township which would allow connection to the City's sewer and water pipes extended into the Township. Additional connection fees could be charged by the Township in association with the extension agreement. The most rational and cost-effective option is to request that the property be annexed into the City. State statute provides that the Township and City can enter into a joint resolution requesting annexation. The State Planning Department then reviews and comments upon the application within 30 days of receipt. No public hearing is necessary. Because the Council has expressed a desire to work cooperatively with the Township, I asked to be scheduled on the Township meeting agenda on April 12, 2001. The Board acted to approve the annexation resolution subject to review and approval by the Township attorney. Current Circumstances: The Township attorney reviewed the resolution and asked that all matters relating to the annexation be incorporated in the resolution. I have therefore modified the approving resolution to include the following: 1. A statement that the City will continue to maintain segments of 170th, Sunset Trail and Mushtown Road. 2. Confirmation that the City will pay a $2500 lump sum to the Township. Tt;Je annexation of this property will save the City money since the $1000 park dedication fee will not be due nor will the City need to pay sewer and water fees beyond those charged by the Metropolitan Council. 16200 Eagle Creek Ave. S.E.. I hope to have the Township attorney's feedback on the joint resolution by Monday night. Conclusion: If we are unable to reach agreement on the joint resolution, the City could annex the property by ordinance. This method of annexation does not require approval of the Township but does require a public hearing by the State Planning Department. This method is not as cooperative in nature to the joint resolution process. ALTERNATIVES: (1) Approve the Joint Resolution as submitted. (2) Approve the Joint Resolution with modifications. (3) Authorize further examination of the annexation by ordinance process. RECOMMENDED MOTION: Alternative (1). That the following described area in Spring Lake Township is in need of orderly annexation pursuant to Minnesota Statutes 414.0325 and the City and Town designate the following area for orderly annexation: Parcel 1 - Thomas Ryan Memorial Park: That part of the West One-Half of the Southeast Quarter of Section 11, Township 114, Range 22, Scott County, Minnesota described as follows: Beginning at the Northwest corner of the South 1505.50 feet (as measured at right angles) of said West One-Half of the Southeast Quarter; thence Easterly along the North line of said south 1505.50 feet to the West line of the East 198.00 feet of said West One-Half of the Southeast Quarter; thence Northerly along said West line to the centerline of a Town Road; thence Southeasterly along said centerline to the West line of the East 132.00 feet of said West One-Half of the Southeast Quarter; thence Southerly along said West line of the East 132.00 feet to the North line of the south 1193.70 feet (as measured at right angles) of said West One-Half of the Southeast Quarter; thence Westerly along said North line of the South 1193.70 feet to the West line of said West One-Half of the Southeast Quarter; thence Northerly along said West line to the point of beginning. AND That part of the West One-Half of the Southeast Quarter of Section 11, Township 114, Range 22, Scott County, Minnesota, lying Southwesterly of the Town Road, North of the South 1505.5 feet (measured at right angles) of said West One-Half of the Southeast Quarter, and lying West of the East 198.00 feet thereof. Parcel 2 - HOth Street from TH13 to the Southerly Intersection with CSAH 23: That part of 170th Street, the centerline of which is described as follows: Beginning at the Southwest corner of the Southwest Quarter (SW ~) of Section 2, Township 114 North, Range 22 West; thence North 89 degrees 56 minutes 03 seconds east along the south line of said SW~ a distance of 846.56 feet; thence northeasterly along a tangential curve concave to the northwest, a central angle of 51 degrees 11 minutes 03 seconds, a radius of 564.69 feet, a distance of 504.46 feet; thence North 38 degrees 45 minutes 00 seconds East to the westerly right-of-way line of County Road 23 and there terminating. Parcel 3 - Sunset Trail from 170th Street to TH13: That part of County Road 81 as shown and dedicated in the plat of Sunset Estates according to the recorded plat thereof, Scott County, Minnesota. JTTl 2. The proposed use of Parcel 1 (Thomas Ryan Memorial Park) is a community park and the proposed use of Parcel 2 and Parcel 3 (17dh Street and Sunset Trail) is public street. 3. The City will maintain all properties identified herein together with a segment of Mushtown Road from CSAH 23 to its intersection with The Ponds Park/Thomas Ryan Memorial Park entry roads. 4. The City will pay the Township $2500 in a lump sum upon completion of the annexation 5. That the Town and City upon passage and adoption of this resolution and upon the acceptance by the Minnesota Planning Department confer jurisdiction upon the Department over the various provisions contained in this Agreement. 6. That the subject area is or is about to become urban or suburban and is in need of or will be in need of municipal services, and the City is capable of providing them to the subject area. 7. There are zero people in the orderly annexation area. 8. The tax rate of the area to be annexed shall not be increased. The tax rate is zero since each of the properties are owned by the City and therefore not subject to taxatjon. 9. Both the Town and the City agree that no alteration of the stated boundaries of this agreement is appropriate, and that no consideration by the Board is necessary. Upon receipt of this Resolution, the Board may review and comment, but shall, within thirty (30) days, order the annexation in accordance with the terms of this joint resolution.
