Home My WebLink About4F - 2000-2001 Liquor Renewals MEETING DATE: AGENDA #: PREPARED BY: AGENDA ITEM: DISCUSSION: CITY COUNCIL AGENDA REPORT JUNE 18,2001 4F JANET RINGBERG, LICENSE CLERK CONSIDER APPRO V AL OF 2000-2001 LIQUOR LICENSE RENEW ALS Current Circumstances The Prior Lake City Code provides that the City Council must approve the renewal of On-Sale Intoxicating, Sunday Liquor, Off-Sale Intoxicating, Off-Sale 3.2 Malt Liquor, On-Sale Intoxicating, and Club Licenses. All of the licenses expire on June 30 of each year. Attached is a list of the establishments requesting renewal of their liquor licenses. The Issues The Prior Lake Police Department has completed a background check for each of the licensees and has reported that no license violations occurred in the past year. All applicants have provided the City with renewal applications, fees and proof of liquor liability insurance. Prior Lake City Ordinance 301.600 states that no license shall be granted for operation on any premises on which taxes, assessments or other financial claims of the city are delinquent or unpaid. The Scott County Treasurer's records show that all property taxes for each of the renewal applicants are current except for Hollywood Bar & Grill. The City Ordinance states that if delinquent taxes, assessments or other financial claims are against a landowner, and the applicant or license holder in the case of renewal is a tenant of and has no financial interest in the land, then the City Council may, in its discretion, grant a license to an applicant so long as the applicant is not delinquent on any financial obligations to the city. Hollywood Bar & Grill is a tenant of Priordale Mall and they have no financial interest in the land. Scott County records show Priordale Mall Investors are responsible for paying the property taxes for Priordale Mall and all its tenants. All tenants of Priordale Mall Investors who have liquor licenses were given notice that the City would look closely at non-payment of property taxes this year. Copies of the letters were sent to PriOl'dale Mall Investors and to City Manager, Frank Boyles. The City Council has the following alternatives: 1. Adopt a motion as part of the consent agenda approving the liquor licenses for 2001-2002. 2. Remove this item from the consent agenda for fmiher discussion. 3. Deny the renewals. Staff recommends Council approve the 2001-2002 liquor license renewals as part of the consent agenda. The forms and instructions are as follows: 1. Minnesota Department of Public Safety Form - Sign and make changes as needed. 2. Provide a Certificate of Insurance - Insurance coverage must cover the period of the license exactly. 3. Worker's Compensation Insurance Information Form and Form SP:C1 - fill out and return. 4. License Questionnaire and Employee Information Form - fill out and return. 5, Affidavit of Compliance for Instructional Program - complete training, fill out and return. Please submit these forms, along with your check for the amount indicated below, to the Licensing Department of the City of Prior Lake by May 4, 2001. Any applications received after May 4, 2001 must include a $50.00 late charge with the application fee (City Ordinance Sec. 301.700). On-Sale Intoxicating Sunday On-Sale $5,300.00 $ 200.00 Total $5,500.00 Buyer's cards should be submitted directly to the state. Pursuant to Section 301.600 of the City Ordinance, all applicants or their landlords must be current on their financial obligations to the state, county, and city. This includes property taxes and city sewer and water bills. We have not aggressively enforced this provision in the past. This letter is to provide you with an early notice that we will enforce this requirement for the 2001-2002 licenses and thereafter. Failure to meet these financial obligations by June 8, 2001 will result in the removal of your license renewal request from the council agenda, causing your license to expire June 30, 2001. Reinstatement of your license renewal will then be considered on the next available agenda after your obligations have been met.
