CONSIDER APPROVAL OF A RESOLUTION AMENDING TO
THE CRYSTAL CARE SENIOR CARE OVERLAY DISTRICT
BY REVERSING THE FLOOR PLAN OF THE BUILDING
History: The Crystal Care Senior Care Overlay District was approved by the
City Council on June 4, 2001. The approved plan calls for a 60-unit assisted
living facility in a 3-story building, consisting of 52,517 square feet of floor
area. The south wing of the building, which is devoted to memory care, is a
single story structure. The proposed amendment is to reverse the building
footprint so that the 3-story wing of the building will be located on the south
side of the site.
Current Circumstances: Crystal Care, LLC, the developer of the Senior
Care facility, has submitted a request for a minor amendment to the
approved development plan. This amendment involves the rearrangement of
the building on the site. The attached drawings show the proposed
arrangement and building elevations. The proposal is in response to
concerns by some of the neighboring residents about this development.
These concerns are identified in the attached letter.
The Zoning Ordinance allows the City Council to approve minor
amendments to an approved plan by resolution. A minor amendment
includes changes or modifications that do not affect required parking,
required yards, floor area ratios, ground floor area ratios, signage, building
height, density, covenants or other agreements required as part of the
approved plan. In this case, the proposed amendment does not change the
density, floor area or setbacks of the buildings. It merely reconfigures the
building footprint so the higher part of the structure is directed further away
from the neighboring residences.
The Issues: The major issue is whether or not the proposed amendment will
change the character of the approved plan. The proposed amendment does
not affect the design or the size of the approved building. It merely
rearranges the site. As a condition of approval of this amendment, the
developer should be required to submit a new landscaping plan identifying
any changes in the placement of the landscaping.

The City Council has three alternatives:
1. Adopt a resolution approving the minor amendment to the Crystal Care
Senior Overlay District as proposed.
2. Deny the proposed amendment. In this case, the Council should direct
the staff to prepare a resolution with findings of fact for the denial of
these requests.
3. Defer consideration of this item for specific reasons.
Staff recommends alternative # 1. A motion and second adopting a
resolution approving the minor amendment to the Crystal Care Senior Care
Overlay District is app priate.

RESOLUTION APPROVING A MINOR AMENDMENT TO THE CRYSTAL CARE SENIOR CARE
OVERLY DISTRICT TO REVERSE THE FLOOR PLAN OF THE BUILDING

WHEREAS: the Prior Lake City Council considered the proposed minor amendment to the approved
development plan for the Crystal Care Senior Care Overlay District on July 2, 2001; and
WHEREAS: The amendment is a minor amendment in that it does not affect the required parking,
required yards, floor area ratio, ground floor area ratio, signage, building height, density,
covenants or other agreements required by the original plan; and
WHEREAS: the City Council finds the minor amendment to the Crystal Care Senior Care Overlay
District consistent with certain elements of the Comprehensive Plan and the Zoning
Ordinance, including the goal of providing a variety of affordable, high quality housing;
and
WHEREAS: the City Council finds the minor amendment is in harmony with both existing and
proposed development in the area; and
WHEREAS: the City Council finds the amendment would result in an opportunity to address the full
range of the marketplace; and
WHEREAS: the City Council finds the minor amendment is compatible with the stated purposes and
intent of the Section 11 06A Senior Care Overlay District of the Zoning Ordinance in that
it does not increase the approved density of the site; and
WHEREAS: the City Council finds the proposed minor amendment adequately provides for internal
organization, uses, circulation, public facilities, recreation areas and open space.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF PRIOR LAKE, MINNESOTA:
1. The recitals set forth above are incorporated herein.
2. The Crystal Care Senior Care Overlay District is amended to reverse the building floor area as
shown on Exhibit A to this resolution, subject to the following conditions:
a) The developer must revise the landscaping to reflect the new site design for the site.
b) All of the other conditions of Resolution #01-72 approving the original Senior Care Overlay
District must be complied with.
Passed and adopted this 2nd day of July, 2001.

It was a pleasure to talking with you, Ms. :Pratt, and MT. Davis last night. I apprecate your
willingness to di9CUS~ my ~ighbor' s and my concerns. While I was sarry to hDYt; missed the
Council meeting, 1 hope it went according to your expectations.
With all due re~"pcet to your architect. I believe as an interested Prior Lake resident adjacent to
your site>> I bave a viewpoint flom real-life experience at this location. As be admitted, things do
appear diffci:ent from vrhen it is covered with snow.
Before you arrived last night>> Mr. Davis and I discussed. a fe-.lr points. ! would like to presep:t
them to you as you consider our suggestion. Please keep in mind we are not suggesting to Uum
the entire site plan end.for-end, just trading pla.ces of the three-story residents quarters with the
one-story memory care: quarters. As 1 have heard from othcr.a who have gone through this
process. getting the plans appro\'ed is the h:u:d pan. not liO much in malcing changes.
. Noise coming from Highway 13 is a very real intrusion. The way the building would la)'
out if you accepted our su.ggestion would move the m.ajority ofyuur residents from
absorbing the full force of the highway noise, to the quieter side of the lot. If the three-
story section ofbulld.ing reJDaiDs where it is plmned,. it will stick out and above Ule
heighI of the surrounding trees and buildings. The hill on the other end of the property is
situated funhcr from the bigh......ay and the tall trees on that side provide a very effective
sound butIer and "white noise'>> effect for those of yow residen1s ~ho C1ljOY open
windows. In nun. the memory care residents in the one.-stoxy side of the building would
enjoy the same noise: filtration and masking si.nce it is obvioUsly lower than its
surroundings.
. Mr. Davis indicated it was planned to have Ring Road circle around the memory care side
ofthe building to a deliverylrecciving and l'arking area in tbe rear of the building.
Leaving the plan for Ring Road as it is and IX1.oving the assisted-care section of building
to the water tower and hill-side oftbc lot would dilIIlpetl the effect ofheadligbt glare and
related s{Jundlj for the residents as well as the neighbors.
