HomeMy WebLinkAbout8B - Amend Creekside Estates MEETING DATE: AGENDA #: PREPARED BY: REVIEWED BY: AGENDA ITEM: DISCUSSION: CITY COUNCIL AGENDA REPORT AUGUST 6, 2001 8B JANE KANSIER, PLANNING COORDINATOR DON RYE, PLANNING DIRECTOR CONSIDER APPROVAL OF A RESOLUTION APPROVING AN AMENDMENT TO THE CREEKSIDE ESTATES PUD TO ALLOW A 10' BY 25' DECK ON THE BACK OF THE 24-UNIT BUILDINGS History: The Creekside Estates Planned Unit Development (PUD) was approved by the City Council in December, 2000. The PUD Plan included 102 units in three buildings (2, 24-unit senior condominium buildings and I, 54-unit congregate care facility). The development plan called for 12' by 10' decks for individual units in the 24-unit buildings. The approved plans, however, did not include a 10' by 25' deck off of the common library on the back of the 24-unit buildings. The proposed amendment would allow this deck. Current Circumstances: Freedom Development, LLC, and Eagle Creek Development, LLC, the developers of Creekside Estates, have submitted a request for a minor amendment to the approved PUD development plan. This amendment involves the addition of a 10' by 25' open deck, located off of the common library in the back of each of the 24-unit buildings. The attached drawings show the proposed deck on the site plan and on the building elevations. The amendment also includes the addition of four windows on the third level of the building, above the entry. These windows are also shown on the attached building elevations. The underlying zoning for this PUD is R-4. The proposed deck will not increase the ground floor area of the building. It should be noted that the deck on Lot 2, Block 1, currently encroaches into the utility easement off of the back of this building. The property owners have filed a petition to vacate this easement. The City Council will consider that petition on August 6, 200 I. The addition of the windows also does not affect the floor area or density of the development. The windows are more of an aesthetic addition to the building. Section 1106.607 of the Zoning Ordinance allows the City Council to approve minor amendments to an approved PUD Plan by resolution following notification of all owners of property within the PUD' A minor amendment includes "changes that increase conformity with Ordinance J:\Olfiles\OJpuds\creek library-deck\cc report.doc Page J 16200 Eagle Creek Ave. S.E., Prior Lake, Minnesota 55372-1714 / Ph. (612) 447-4230 / Fax (612) 447-4245 AN EQUAL OPPORTUNITY EMPLOYER FISCAL IMP ACT: AL TERN A TIVES: RECOMMENDED MOTION: REVIEWED BY: requirements; decreases in residential density, leasable floor area, building height, impervious surface and/or required parking provided such decreases have a minimal impact on the overall character of the approved Final PUD Plan as determined by the Zoning Administrator; minor building additions and floor plan modifications that do not increase parking requirements or reduce useable open space; and changes that are specified as minor amendments in the approved Development Contract. " TI1I? Tsr;:IlPr;:' The major issue is whether or not the proposed amendment will change the character of the PUD. The proposed decks are consistent with the style and the use of the approved buildings. The addition of this feature does not increase the density of the development. The construction of new dwellings will provide additional tax base to the City. The City Council has three alternatives: 1. Adopt a resolution approving the minor amendment to Creekside Estates PUD Plan as proposed. 2. Deny the proposed amendment. In this case, the Council should direct the staff to prepare a resolution with findings offact for the denial of these requests. 3. Defer consideration of this item for specific reasons. Staff recommends alternative # 1. A motion and second adopting a . resolution approving the minor amendment to the Creekside Estates PUD Plan is appropriate. 1 :\0 1 files\O 1 puds\creek library-deck\cc report. doc Page 2 RESOLUTION 01~ RESOLUTION APPROVING A MINOR AMENDMENT TO THE CREEKSIDE ESTATES PLANNED UNIT DEVELOPMENT TO ALLOW A 10' BY 25' DECK ON THE BACK OF THE 24-UNIT BUILDINGS AND TO ALLOW THE ADDITION OF WINDOWS TO THE 3RD STORY OF THE BUILDING MOTION BY: J5 SECOND BY: fr14 WHEREAS: the Prior Lake City Council considered the proposed minor amendment to the approved development plan for the Creekside Estates on August 6,2001; and WHEREAS: owners of property within the Creekside Estates PUD have been notified of the proposed minor amendment in accordance with Section 1106.607 (2) b of the Zoning Ordinance; and WHEREAS: the City Council finds the minor amendment to the Creekside Estates PUD consistent with certain elements of the Comprehensive Plan and the Zoning Ordinance; and WHEREAS: the City Council finds the minor amendment is in harmony with both existing and proposed development in the area; and WHEREAS: the City Council finds the amendment would result in an opportunity to address the full range of the marketplace; and WHEREAS: the City Council finds the minor amendment is compatible with the stated purposes and intent of the Section 1106 Planned Unit Developments of the Zoning Ordinance; and WHEREAS: the City Council finds the proposed minor amendment adequately provides for internal organization, uses, circulation, public facilities, recreation areas and open space. NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF PRIOR LAKE, MINNESOTA: 1. The recitals set forth above are incorporated herein.
