HomeMy WebLinkAbout96-107 RESOLUTION 96-107 RESOLUTION PROVIDING FOR A MINOR AMENDMENT TO THE PRELIMINARY PLAT OF EAGLE CREEK VILLAS MOTION BY: _KedrowslQ_ SECOND BY: Greenfield WHEREAS, the preliminary plat of Eagle Creek Villas was approved by the Prior Lake City Council on May 20, 1996; and WHEREAS, condition #12 states: The developer shall be responsible for the installation of public improvements as depicted on the following: a) Grading and Storm Sewer Plan, Sheet C2, Rev. 5-7-1996 b) Sanitary Sewer and Water Plan, Sheet C3, Rev. 5-7-1996 c) Paving Plan............................, Sheet C4, Rev. 5-7-1996 d) Detail Sheet............................, Sheet C5, Rev. 5-7-1996" and WHEREAS, the City Council approved a request by Eagle Creek Villas, LLC, on November 4, 1996, to revise the approved grading plan as shown on attached Exhibit A and subject to the conditions included in this resolution; and: WHEREAS, the Subdivision Ordinance, Section 6-3-3(B)3. specifies "If the City Council determines that the scope of the revisions do not constitute a new plat, the Council can order the preliminary plat amended to reflect the revisions with no additional fees charged;" and WHEREAS, the proposed amendment does not constitute a change to the plat but rather amends a condition of preliminary plat approval. NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF PRIOR LAKE, that it hereby amends the preliminary plat of Eagle Creek Villas, condition #12, (approving specific grading and utility plans) to allow a revision of the grading and utility plans subject to the following conditions: 1. The Developer shall add an extra sanitary sewer service off the existing 15" sanitary sewer line for the new building proposed to be added south of Priorwood Street and west of the creek. 4. A clean out shall be added to the combined sewer services at the connection to the sewer stub. 5. Any water shut-off curb stop boxes that are not used must be removed.
