AGENDA ITEM: CONSIDER APPROVAL OF THE 2011 OFFICIAL CITY FEE SCHEDULE
DISCUSSION: Introduction
The purpose of this agenda item is to consider approval of the 2011 Official
City Fee Schedule in accordance with the City Council's bylaws. The fee
schedule identifies those types of service charges and license fees charged
on a user basis to recover City- associated costs as directed by the City
Council in an effort to reduce reliance upon the property tax. The intent is
that the user who benefits should pay the ultimate cost of the service
provided.
Hi story
Staff reviews the fee schedule as a part of the annual budget process and
makes recommendations for changes or additions as needed.
Current Circumstances
Attached is the proposed 2011 Official City Fee Schedule that lists fees,
service charges, escrows and securities. New fees (including fees that
have historically been charged but haven't been reflected on the fee
schedule) and proposed changes are indicated in the table below alongside
their present amount (Please see the description of the changes following
the table):

Explanation of Chances
1 - 2. Utility Connection Charges have been segregated into two
components (sanitary sewer and water) for greater clarity.
3. Prepaid Card Initial /Replacement Fee is a new fee to cover the cost
of issuing cards for bulk water purchases.
4. Late Fee for License Renewals is an existing fee and should be added
to the Fee Schedule.
5 - 6. Body Art License Fee & Investigation Fee - Body Art should be
removed. Ordinance 110 -06 was adopted on November 15, 2010 which
rescinded section 309 of the Prior Lake City Code relating to body art
establishments, effective December 31, 2010.
7. Solicitor's Permit fee should be removed from the Fee Schedule. The
City does not collect a fee for solicitors. Individuals requesting a solicitor's
permit are only required to register with the City.
8. Peddler's Permit is an existing fee and should be added to the Fee
Schedule. This fee was previously referred to as a "Solicitor Permit" on the
Fee Schedule.

9. Change of Occupancy Permit is an existing fee and should be added
to the Fee Schedule.
10. Excavation and Grading Escrow for Residential > =1 Acre should
be expanded to reflect a minimum fee of $250. This will provide greater
incentive for property owners to comply with the required turf restoration
versus walking away from the deposit.
11. Excavation and Grading Escrow for Commercial /Developers
should be expanded to reflect a minimum fee of $250. This will provide
greater incentive for property owners to comply with the required turf
restoration versus walking away from the deposit.
12. Tree Deposit should be based on the number of inches of required
replacement with the minimum set at $500 (current rate). This will provide
greater incentive for property owners to replace the trees versus walking
away from the deposit.
13. The MCES SAC (sewer availability charge) increase of $130 from
$2,100 to $2,230 is required by the Metropolitan Council Environmental
Services. The fee helps pay the capital costs of construction of the
Metropolitan sewer interceptor system. This rate has increased
incrementally by $50 -150 each year since its inception and will continue to
increase over the next few years according to the Metropolitan Council.
14. Picnic Table Moves. Staff is recommending that the "cost per
agreement" language be modified to reflect a $15 / table cost.
15. Barricades. Staff is recommending that this new fee be added to the
Fee Schedule to reflect a portion of the cost of providing barricades to the
public.
16. Garbage Barrels. Staff is recommending that this new fee be added to
the Fee Schedule to reflect a portion of the cost of providing garbage
barrels to the public.
17. Sr. Care Overlay District Fee should be removed. As part of the
Zoning Ordinance update in 2009, the Sr. Care Overlay District was
removed from the Zoning Ordinance.
18 - 20. Sign Permit (Permanent) should be segregated into two
categories: 1) Single Tenant Buildings and 2) Multiple Tenant
Buildings. Separating the two permit types allows for a higher fee for
multiple tenant buildings to compensate for the fact that they take additional
time since staff must reconcile the proposed signage with the signage that
is currently on the building for other existing tenants. Staff reviewed the
costs associated with issuing a sign permit and determined that our existing
fee is often not sufficient to cover staff time. Other communities most
commonly charge between $75 and $150 for a sign permit.
21. Sign Permit (Temporary). Staff is recommending that this fee be
increased from $15 to $35 to cover the costs associated with issuing a sign
permit. Temporary sign permits take approximately the same amount of
time as a permanent sign permit and the increased cost would reflect that
fact.

22. Tree Preservation Lot Deposit should be based on the number of

23. Zoning Verification Letter. Staff is recommending that this fee be
increased from $10 to $35 to cover the costs associated with researching
and preparing the Zoning Verification Letter.
24. Memorial Plaques. Staff is recommending that this fee be increased
from $100 to $200 to reflect the increased costs associated with purchasing
and installing the memorial plaques.
25 — 30. Memorial Benches. Staff is recommending that the types and
styles of benches be limited to one versus the six that we currently offer.
The cost associated with purchasing this one type of bench has increased;
therefore, Staff is recommending that the fee be increased from $500 to
$850 to cover the costs associated with purchasing and installing the
memorial bench.
Conclusion
The changes approved by the City Council will be incorporated into the
2011 Official City Fee Schedule with an effective date of January 3, 2011.
ISSUES:
Prior Lake has a history of charging fees in proportion to City expenses for
services for which a discrete benefactor can be identified.
FINANCIAL
The fee schedule identifies those types of service charges and license fees
IMPACT:
charged on a user basis to recover City- associated costs.
ALTERNATIVES:
The following alternatives are available to the City Council:
1. Approve the 2011 Official City Fee Schedule as presented
2. Approve the 2011 Official City Fee Schedule subject to specific
Council amendments
3. Delay action if the Council requires additional information.
