All conditions shall be met in the described sequence in order to get occupancy. The following conditions are to insure the construction site will have stable soil to support all permitted improvements and to prevent erosion. 1. An additional soil-boring test at the site to determine site conditions. 2. Foundation shall have a signed engineered foundation designed based on the soil boring information. 3. The property owner shall contract an Engineer to design the foundation and approved the location of the footings, and set bluff stabilization and erosion control requirements. 4. The property owner shall submit to the City of Prior Lake all Engineer approved site testing, foundation design, footing location, bluff stabilization and erosion control requirements for review and acceptance before the footing inspection. 5. Compaction tests are required for any fill. 6. The Engineer shall determine if all criteria was met during construction. 7. The property owner's Engineer shall submit to the City of Prior Lake a report certifying that all criteria was met during construction and has stab construct on and soil conditions at the end at the project. The purpose of the meeting was to inspect the grading and filling activity that recently occurred on yours and the � adjacent lot at 5572 Candy Cover Trail SE. The two lots contain bluffs within which grading and filling activities such as those you undertook are regulated by the City of Prior Lake through their zoning ordinance. Activities below the ordinary high water mark (OIIW) of Prior Lake (elevation 904') are regulated by DNR per Minnesota Statutes 103G.245. A considerable amount of grading has occurred on the bluff of the two lots, and rock and sand has been placed below the 4HW. My understanding is that neither you nor your neighbor secured a grading permit from the city, nor did you receive a permit from the DNR for work below the OHW. As such, the site is out of compliance and requires action on your part to correct it. The city will be advising you of what is required for the portions of the lot above the OHW. The lake elevation on the day of our meeting was 901.7'. This is 2.3 feet below the OHW. I confirmed that the rock riprap (loose, randomly placed rock shoreline protection) placed below the OHW was of the size, slope, and location on the two lots such that it conforms with that which can be done without a DNR permit. As such, the loose, sloped rock along shore needn't be removed or modified. The rock wa11s (vertical to near-vertical stacked boulders) are being addressed by the city and you can expect guidance from them under sepazate cover. A very lazge quantity of sand has been hauled on to the sites. The amount below the OHW (estimated to be the bottom rock stair) is substantially greater than allowable under permit. To conect this, you were verbally instructed to reduce the thickness of sand to no greater than 6". The width of the sand area, along the shoreline of the two lots, is accepta.ble. If you and your neighbor have not already done so, you must reduce the sand along the beach area below the OHW to a thickness of no more than 6". I am providing you until Tuesday, September 6�` to accomplish same. I will be making a follow up inspection shortly thereafter, and initiating formal enforcement action if the sand does not conform to the above. The grading/filling, rock wall, sand work performed on the two lots represent a violation of state law and local shoreland ordinance. When you were granted several variances to build in 2002, you had a property survey done. It was revised, at your request to the surveyor, to locate the bluff. Between you and the contractor that actually did the work, it is di�cult to believe that one of you did not know of the permit requirements for grading and filling in bluff areas. I am encouraging the City of Prior Lake to take full enforcement action to require restoration and revegetation the bluff area you disturbed without a permit. As was indicated by city staff at the meeting, it is not likely a permit would have been issued for the work you undertook even had you bothered to apply for one. I recommended the following: • The poured concrete footings (20"x8") should be reinforced with 2-#5 reinforcin� rods in all footings. • The wa11s should be reinforced by core-filling the block with grout and a#3 bar in-place from top of wall to the bottom every 4'-0" on center maximum in the 12 course foundation wall only. • The balance of the shorter block walls could be 6'-0" maximum for reinforced core fills. • A bond beam with 2-#4 re-bars should be installed around the house at the 12�' course level. • Insulate the back walls with 2-1" layers of polystyrene to provide adequate insulation. • Gutters should be installed although they have not been installed as of the date of this letter. • Backfilling on all walls should be done after 1 week of curing of the block walls and they should be carefully braced and construction equipment should not be allowed in the fill area. The above recommendations should insure a secure foundation wall. I made three separate inspections of the construction at the site to insure that the above recommendations were followed. These recommendations regarding footings and backfill are a result of my experience with similar installations. As a result of my inspections, I can attest that the foundations and foundation wails were installed according to my recommendations and that they will serve to structurally support the house and will serve adequately to retain the soils that surround the foundations.
